City of La Porte, Texas, Ordinance No. ~003-;J.(p~ ~ AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE CITY OF LA PORTE AND BAY AREA HOUSTON ECONOMIC PARTNERSHIP ("CONTRACTOR"), SOI(C) (6) NOT FOR PROFIT ORGANIZATION, FOR ECONOMIC DEVELOPMENT SERVICES APPROPRIATING NOT TO EXCEED $20,000 TO FUND SAID CONTRACT, MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, PROVIDING AN EFFECTIVE DATE HEREOF. ******* BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorized the contract, agreement, or other undertaking described in the title ofthis ordinance, in substantially the form as shown in the document which is attached hereto and incorporated herein by this reference. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. City Council appropriates the sum not to exceed $20,000 from the City of La Porte Community Investment Fund Account No. 036-6061-565 to fund said contract. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereofhas been discussed, considered and formally acted upon. Summarizing, we have found Bay Area Houston to be very open and flexible in providing services that are specific to their various clients while pursuing their objective to provide and promote regional economic development services. Earlier, staff provided Council with general information about the Bay Area Houston Economic Partnership. The November 8, 2003 Council Retreat included a specific proposal for Economic Development Services. Based on input received at the retreat the following modifications were made to the proposal: Item I: The survey section was modified to add "the image of La Porte" to the perception of La Porte as a place to do business. Item 2: Was modified to specifically include tourism (although implied). Item 3: Was modified to include a specific reference to developing a more diversified tax base. (Although this is referenced in the general provisions of the proposal). Item 8: The national keep it sold effort relating to education offederal officials on the importance of NASA was replaced with: [J An outreach program to discuss issues with local industry and develop a program to address their concerns and focus on retention and growth. Fee: The fee was reduced (to compensate for modifications) from $25,OOO/yr to $20,OOO/yr payable in two installments, 151 within 30 days of effective date of Agreement and 2nd within 30 days of the semi-annual meeting and first progress report. The term of the Agreement is for 3 years. It includes provisions for termination of convenience by the City and termination for cause by either the City or Bay Area Houston. We have also provided for Council's information a matrix, which summarizes economic development services that are provided to Bay Area Houston's other governmental clients. Additionally, we would like to secure Council's approval to utilize the recently completed La Porte photo-collage (featured on our Ready for Business Magazine) as the flag/symbol, which will be utilized by Bay Area Houston to represent La Porte.
