ORDINANCE NO. 2003JVl~ AN ORDINANCE APPROVING AND AUTHORIZING AN ENGINEERING AGREEMENT BETWEEN THE CITY OF LA PORTE AND PBS&:J, TO PERFORM AN AERATION STUDY AT THE LITTLE CEDAR BAYOU WASTEWATER TREATMENT PLANT, APPROPRJ:ATING NOT TO EXCEED $ 5 8, 090 . 00 , TO FUND SAID CONTRACT, HAK:ING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, a copy of which is on file in the office of the City Secretary. The City Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. City Council appropriates the sum not to exceed $58,090.00 from City of La Porte Capital Improvement Fund No. 43, Project No. GEN882, to fund said contract. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the city for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. . . section 3. Gillett Agenda Date Requested: Appropriation Source of Funds: Fund 43 Department: Public Works Account Number: 043-9892-882-1100 Report: Resolution: Ordinance: xx Amount Budgeted: $100,00000 Exhibits: Ordinance Amount Requested: $58,090.00 Exhibits: Professional Services Agreement Budgeted Item: YES Exhibits: SUMMARY & RECOMMENDATION In May, 2000, the City issued a Request for Qualifications (RFQ) to select a consultant to perform an engineering study of the solids handling process at the City's Little Cedar Bayou Wastewater Treatment Plant. The Firm of CDM was selected, and subsequently designed the improvements funded by the recent bond issue. Phase" of the Wastewater Treatment Plant Improvements includes the examination and possible improvements to the aeration process of the Plant. Funds remaining from the bond issue were set aside, in the amount of$100,000, in the FY 03- 04 General Obligation Bond Fund (Fund 43) to perfoml the Study. The firm of CDM was primarily selected on the personnel available to perform the initial study, and subsequently used for the design ofthe improvements identified. Since that time, the principal personnel have been transferred to the firm's Fort Worth office, and are not available for this Project. The firm ofPBS&J, Inc. was the second ranked firm in the initial RFQ. The principal personnel are still available to perfrom all work associated with the Phase II Improvements at the Plant. A scope of work has been developed, and PBS&J has submitted a proposed Professional Services Agreement for consideration. Although $100,000 is available, the total cost to perform the Phase II Study is $58,090.00. Action Required bv Council: Approve an Ordinance authorizing the City Manager to execute a Professional Service Agreement with PBS&J to perform an Aeration Study of the Little Cedar Bayou Wastewater Treatment Plant in an amount of $58,090.00.
