ORDINANCE NO. 03-2664-B AN ORDINANCE APPOINTING UP TO THREE ADDITIONAL MEMBERS TO THE AD HOC CODE RECOMMENDATION COMMITTEE OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1: The City Council of the City of La Porte hereby appoints the following additional members to the City of La Porte Ad Hoc Code Recommendation Committee, for the term beginning on the effective date hereof, and expiring on completion of the duties of said ad- hoc committee. /(f) bf!,{1- De.- -+ i t-- tJ aJ r~ ll-(lr} ~1'11-fd The members of the Committee serve at the pleasure of the City Council. Section 2: If any section, sentence, phrase, clause or any part of any section, sentence, phrase or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City HaIl of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. . . Finan /t~A- . 10/16/2003 J;::( Building Code Ad Hoc Committee At the October 13, 2003 City Council Meeting it was requested that staff supply the City Council a list of Ad Hoc committee members and which council member made the appointment. George Finch (HV AC), who was appointed at the last meeting of City Council, has declined due to a scheduling conflict. To assist Council with infonnation on the "pros and cons" of the various codes, an Ad Hoc Code Recommendation Committee ordinance was approved at the September 22,2003 meeting. With the passage of the original ordinance #2003-2664, staffwas provided with nine (9) committee appointments. On October 13, 2003, Council approved Ordinance #2003-2664A and staff received two (2) additional appointments. However, as noted in the attached memo, one (I) of the appointments has noted a conflict and will be unable to selVe on the committee. This means ten (10) of the possible thirteen (13) positions have been filled to date. One (I) vacant position in each of the following categories remains: architect, hvac and master electrician. If Council desires, a list of city licensed master electricians can be provided for their convenience. The list includes over 200 names. A city list does not exist on state licensed architects and hvac contIactors. AJso, the Assistant Fire Chief is aware of an architect who lives in La Porte and has provided staff with his name. The name provided was Hurdis Rhodes, but staff is not familiar with the individual.
