ORDINANCE NO. 03-2664-A AN ORDINANCE APPOINTING UP TO FOUR ADDITIONAL MEMBERS TO THE AD HOC CODE RECOMMENDATION COMMITTEE OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1: The City Council of the City of La Porte hereby appoints the following additional members to the City of La Porte Ad Hoc Code Recommendation Committee, for the term beginning on the effective date hereof, and expiring on completion of the duties of said ad- hoc committee. George Finch - HVAC Ronald P. Holt - Layperson The members of the Committee serve at the pleasure of the City Council. Section 2: If any section, sentence, phrase, clause or any part of any section, sentence, phrase or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3: All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. They are shown in the trade they are to represent on the Committee, as staff understood. If staff is wrong in the placement of an individual, the item on the next agenda will allow for the correction. All nine appointees confirmed their interest in serving, and seven attended the Boards and Commission's Orientation Dinner, Monday, September 29. At that dinner, it was decided they would meet weekly on Monday nights at 6:00 P.M. in City Hall. They anticipate meeting two to three hours at a time for about six weeks. Four additional names have been suggested for consideration by Council Members or the Mayor. There will be an item on the next agenda to consider these four individuals, and any others submitted. As you may notice, Mr. White, who is an engineer and was appointed as an engineer representative, would like to represent the general contractors stating he has the background also. Mr. Yung says he is an engineer by trade, with knowledge of architecture. He was appointed as an architect representative. The four names suggested would place more representatives than suggested in certain areas and not enough in others. However, it was only a staff suggestion as to the make-up of the Board. The main concern is to have people who can contribute and assist the City in making a recommendation on the codes. If you have any questions or concerns, please feel free to call me. To assist Council with information on the "pros and cons" of the various codes, an Ad Hoc Code Recommendation Committee ordinance was approved at the September 22, 2003 meeting. As part of that ordinance approval, Council provided staff with nine (9) appointments for the committee. In addition, staff was asked to return to the next meeting for the possible appointment of up to four (4) additional members. For your convenience, we have attached Ordinance #2003-2664 and staff's 10/01103 appointment memo that provides name and information on the original appointments as well as the four additional names suggested by the Mayor and Councilmen Mosteit and Griffith and provided for your consideration. In addition, you may wish to consider other names submitted at the meeting.
