ORDINANCE NO. 03. ~ lJ U ~ AN ORDINANCE APPOINTING MEMBERS TO THE AD HOC CODE RECOMMENDATION COMMITTEE OF THE CITY OF LA PORTE; PROVIDING A SEVERABILITY CLAUSE; CONTAINING A REPEALING CLAUSE; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte hereby appoints the following members to the City of La Porte Ad Hoc Code Recommendation Committee, for the term beginning on the effective date hereof, and expiring on completion of the duties of said ad-hoc committee. Tom Campbell - Plumber Carlos Smith - Civil Engineer The members of the Committee serve at the pleasure of the City Council. Section 2. If any section, sentence, phrase, clause or any part of any section, sentence, phrase, or clause, of this ordinance shall, for any reasons, be held invalid, such invalidity shall not affect the remaining portions of this ordinance, and it is hereby declared to be the intention of this City Council to have passed each section, sentence, phrase or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase or clause, or part thereof, may be declared invalid. Section 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict only. l ORDINANCE NO! 03- At! . PAGE 2 Section 4. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 5. With directives received at the August 11, 2003 and September 08, 2003 council meetings, staff prepared an infonnational memo outlining a sample committee composition as well as a possible schedule and process for code selection. The memo was placed in council's boxes on 09-12-03 and is part of this submittal. For council's convenience, staff has also included the backup from the September 08, 2003 agenda request. The previous backup (provided for review purposes only) included an overview of three options as well as a sample code review and appeal body. An ordinance is required for the appointment of members to an Ad Hoc Code Recommendation Committee. That ordinance is attached.
