AN ORDINANCE APPROVING AND AUTHORIZING AN AGREEMENT BETWEEN THE
CITY OF LA PORTE AND PPG INDUSTRIES, .INC., FOR THE ACQUISITION FROM
PPG INDUSTRIES, INC. OF RIGHT-OF-WAY FOR BAY AREA BOULEVARD,
INCLlJDING A SANITARY SEWER AND WATERLINE EASEMENT, AND A DRAINAGE
EASEMENT, IN CONNECTION WITH THE CITY OF LA PORTE AND BARRIS COUNTY
PROJECT FOR THE WIDENING AND IMPROVEMENT OF BAY AREA BOULEVARD, IN
EXCHANGE FOR THE VACATING, ABANDONING, AND CLOSING OF CERTAIN
STREET AND ALLEYS IN THE CITY OF LA PORTE, MAlCING VARIOUS FINDINGS
AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE
OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The City Council hereby approves and authorizes
the contract, agreement, or other undertaking described in the
title of this ordinance, a copy of which is on file in the office
of the City Secretary. The City Manager is hereby authorized to
execute such document and all related documents on behalf of the
City of La Porte.
The City Secretary is hereby authorized to
attest to all such signatures and to affix the seal of the City to
all such documents.
Section 2. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.

Section 3. This Ordinance shall be effective from and after
its passage and approval, and it is so ordered.

SUMMARY & RECOMMENDATION
The City has negotiated an agreement with PPG Industries, Inc. for the additional Right of Way,
Sanitary Sewer Easement and Drainage Easement for the construction of Bay Area Blvd. from
Fairmont Parkway to Spencer Highway. In consideration, the City agreed to close a various
street and alleys adjacent to PPG property, the last portion of which was approved by City
Council at its last meeting.
Street and alley closings for PPG Industries total 112,730 sq. ft., or 2.588 acres. Total ROW
donated by PPG Industries for Bay Area Blvd. is 267,987 sq. ft., or 6.152 acres. Total utility and
drainage easement donated by PPG Industries is 410,478 sq. ft., or 9.423 acres.
The Agreement also includes the provision that the City will erect a four-strand barbed-wire
fence on the east and west sides of the proposed Bay Area Blvd, as well as north and south sides
of the proposed drainage easement.
Upon acquisition of all ROWand easements, the city will transfer ownership to Harris County,
which will then begin construction of improvements, the first of which is pipeline adjustments.
Concurrent with this effort, the city will advertise and award bids for construction of the trunk
sewer to be installed adjacent to Bay Area Blvd.
Action Reauired bv Council: Approve an ordinance authorizing the City Manager to execute the
Agreement, Special Warranty Deed, Sanitary Sewer and Water Line Easement and Drainage Easement
between the City of La Porte and PPG Industries, Inc. for the construction of Bay Area Blvd. and Trunk
Sewer.
