Home My WebLink AboutO-2003-2656-A .' ,- ORDINANCE NO. 03- a 1d5(P -- f) AN ORDINANCE AMENDING APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING FEES FOR CONSTRUCTION PLAN REVIEW, ZONING PERMITS, AND AN APPLICATION FEE FOR THE APPEAL OF THE ENFORCEMENT OFFICER'S DECISION; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Appendix A of the Code of Ordinances of the City of La Porte, providing fees for construction plan review; zoning permits; and an application fee for the Appeal of the Enforcement Officer's Decision; is hereby amended, as shown on Exhibit "A" through Exhibit "C", both inclusive, attached hereto, incorporated by reference herein, and made a part hereof for all purposes. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof Section 3. The survey results have been compiled and are attached for City Council's review. Please note that while some cities may identify the ''permit'' by a different name, they serve the same purpose as our "zoning permit". In addition, Council may wish to establish an application fee for the Appeal of the Enforcement Officer's Decision. Recently Council approved Ordinance #2003-2655 which authorized an increase in the application fees for four (4) zoning related requests (i.e. variance, zone change, special conditional use and special exception). Since an appeal request is addressed by the Zoning Board of Adjustment (as are variance and special exception requests), Stafffeels the same $150.00 application fee recently authorized for the variance and special exception requests would provide consistency and be appropriate. Should Council desire something different, Staff would appreciate some direction on the matter.
