AN ORDINANCE AKENDING nAPPENDIX A, FEES, n OF THE CODE OF ORDINANCES
OF THE CITY OF LA PORTE, CONTAINING A REPEALING CLAUSE, CONTAINING
A SEVERABILITY CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS
LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. The following Chapters of "Appendix A -- Fees," of
the Code of Ordinances of the City of La Porte are hereby and shall
hereafter read as follows.
The amendments contained in this
ordinance shall be effective October 1, 2003, unless otherwise
stated.
Section 2.
Chapter 6, "Alcoholic Beverages," is hereby
amended and shall hereafter read as follows, to-wit:

Section 5. Chapter 62, "Streets, Sidewalks and Other Public
Places," Article II. Vacating, Abandoning and Closing Streets and
Alleys, subsection (a) Application fee to vacate, abandon or close
(minimum), is hereby amended and shall hereafter read as follows,
to-wit:

Section 6. Chapter 82, "Buildings and Building Regulations,"
Article IV. Electrical Code, Division 5, Inspections, subsection
(a) Inspection fees, section (20) Reinspection fee, is hereby
amended and shall hereafter read as follows, to-wit:

Section 7. Chapter 82, "Buildings and Building Regulations,"
Article XI, swimming Pools, subsection (a) Fee for public pools'
operation license (annual and renewal), is hereby amended and shall
hereafter read as follows, to-wit:
"(a) Fee for public pools' operating license

Section 8. Chapter 106, "Zoning," Article II, Administration,
subsection (a) Application fees, is hereby amended and shall
hereafter read as follows, to-wit:

Section 9. All ordinances or parts of ordinances in conflict
herewith are hereby repealed to the extent of such conflict only.
Section 10. If any section, sentence, phrase, clause, or any
part of any section, sentence, phrase, or clause, of this Ordinance
shall, for any reason, be held invalid, such invalidity shall not
affect the remaining portions of this Ordinance, and it is hereby
declared to be the intention of this City Council to have passed
each section, sentence, phrase, or clause, or part thereof,
irrespective of the fact that any other section, sentence, phrase,
or clause, or part thereof, may be declared invalid.
Section 11. The City Council officially finds, determines,
recites, and declares that a sufficient written notice of the date,
hour, place and subject of this meeting of the City Council was
posted at a place convenient to the public at the City Hall of the
City for the time required by law preceding this meeting, as
required by the Open Meetings Law, Chapter 551, Texas Government
Code; and that this meeting has been open to the public as required
by law at all times during which this ordinance and the subject
matter thereof has been discussed, considered and formally acted
upon. The City Council further ratifies, approves and confirms
such written notice and the contents and posting thereof.
Section 12. This Ordinance shall be in effect from and after
its passage and approval. The fees in this ordinance shall be
effective October 1, 2003, unless otherwise indicated.

SUMMARY & RECOMMENDATION
The Fiscal Year 2003-04 Budget was built around increasing various fees to enhance the City's Revenue Stream.
The proposed changes are summarized below a nd were documented and detailed in the information provided to
Council on Friday, August 29, 2003.
1. Solid Waste Fees: Estimated additional revenue - $300,000 (Ordinance #2003-2656)
a. Proposed increase from $7.50 to $10.00 effective October 1,2003.
b. Proposed increase from $10.00 to $12.50 effective October 1,2004.
c. Proposed increase from $12.50 to $15.00 effective October 1, 2005.
2. Parks & Recreation Fees: Estimated additional revenue - $144,479 *
a. PoolslWave Pool Fees - increase pool and wave pool passes various nominal amounts & higher
increases to non-residents (Ordinance #95-1 644-E)
b. Recreation & Fitness Center Memberships - proposed increase of20% (Ordinance #1 829-C)
c. Sylvan Beach - increase pier tickets and increase alcohol permit (Ordinance #2003-2655)
3. Planning & Engineering: Estimated additional revenue - $354,109 * (Ordinance #2003-2656)
a. Various increases to inspection fees and permits
4. Golf Course: Estimated additional revenue - $128,178 * (Ordinance #2003-2655)
a. Green Fees - increase fees (larger increase for non-residents)
b. Cart Fees - proposing $2 increase in cart fees
c. Membership Fees - increase resident and senior resident memberships by $100 each and increase
non-resident memberships by $150.
Adjustments to other fees will be presented at the next Council meeting (September 22nd).
