Ordinances, La Porte, Texas, is hereby amended to read as follows:
FUEL GAS CODE PERMIT FEES
(Gas permits shall be applied for and issued under the plumbing permit.)
Fees shall be in accordance with the Plumbing Permit Fee Schedule.
PENALTIES
When is work is started without the required permit, the fee herein specified shall be
doubled. The payment of such double fee shall not relieve any persons from fully
complying with the requirements in the execution of the work nor from any other
applicable penalties.

Section 6: That Appendix A, Chapter 82, "Buildings and Building
Regulations," Article XI, "Swimming Pools License Fee Schedule," of the Code of
Ordinances, La Porte, Texas, is hereby amended to read as follows:
SWIMMING POOL LICENSE FEE
a) Fee for public pools' operating license (annual and renewal)
$ 25.00
PENALTIES
Any use of the pool, without first obtaining the required license, shall result in the
doubling of the fee herein specified. The payment of such double fee shall not relieve
any persons from fully complying with any applicable requirements nor from any other
applicable penalties.
Section 7: All ordinances or parts of ordinances inconsistent with the terms of
this ordinance are hereby repealed; provided, however, that such repeal shall be only to
the extent of such inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject matter covered by
this ordinance.
Section 8. Any person, as defined in Section 1.07 (27), Texas Penal Code, who
shall violate any provision of the ordinance, shall be deemed guilty ofa misdemeanor and
upon conviction shall be punished by a fine n~t to exceed TWO THOUSAND
($2,000.00).
Section 9 This Ordinance shall be effective ninety (90) days after its passage and
approval. The City Secretary shall give notice of the passage of this ordinance by causing
the caption hereof to be published in the official newspaper of the City of La Porte at
least twice within ten (10) days after the passage of this ordinance.

Section 10. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council is posted at a place convenient to the public at the City Hall of the city for
the time required by law preceding this meeting, as required by the Chapter 551, Tx.
Gov't Code; and that this meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.

SUMMARY & RECOMMENDATION
In the past, many municipalities (including the City of La Porte) utilized the pennit and/or inspection fee schedules
included in the various codebooks. However, in some cases, fee schedules are no longer included which means each
city needs to adopt appropriate fees for their jurisdiction. At this time, by separate ordinance, City Council is
considering the adoption of new building codes for the city. As part of the code adoption process, staff felt Council
would be interested in reviewing pennit fees as well.
Staft'reviewed the fee schedules of area cities and noted our fees were typically lower. In addition, although we do
not, many cities charge plan review fees and/or re-inspection fees.
Our electrical code permit/inspection fees were established in 1989 and have not been updated since that time. For
other constJUcti.on permits. we are utilizing the fee schedules from the 1995 codebooks.
Methods for calculating permit fees vary from city to city. Some utilize flat fees while others utilize the square
footage of the structure to help determine the appropriate fees. The fee schedules noted in the C3 code family varies
from current schedules and have been incorporated into the attached ordinance. Where a schedule is not included,
staff has taken our current fee schedule and increased it by 50% in some cases.
Despite this increase, the fee schedules proposed by staff remain comparable to fee schedules of area cities and stiD
do not recover the cost of seIVice.

PENALTIES
When is work is started without the required permit, the fee herein specified shall be
doubled. The payment of such double fee shall not relieve any persons from fully
complying with the requirements in the execution of the work nor from any other
applicable penalties.
Section 6: That Appendix A, Chapter 82, "Buildings and Building
Regulations," Article XI, "Swimming Pools License Fee Schedule," of the Code of
Ordinances, La Porte, Texas, is hereby amended to read as follows:
SWIMMING POOL LICENSE FEE
a) Fee for public pools' operating license (annual and renewal)
$ 25.00

Section 7: All ordinances or parts of ordinances inconsistent with the terms of
this ordinance are hereby repealed; provided, however, that such repeal shall be only to
the extent of such inconsistency and in all other respects this ordinance shall be
cumulative of other ordinances regulating and governing the subject matter covered by
this ordinance.
Section 8. Any person, as defined in Section 1.07 (27), Texas Penal Code, who
shall violate any provision of the ordinance, shall be deemed guilty ofa misdemeanor and
upon conviction shall be punished by a fine not to exceed FIVE HUNDRED DOLLARS
($500.00).
Section 9 This Ordinance shall be effective fourteen (14) days after its passage
and approval. The City Secretary shall give notice of the passage of this ordinance by
causing the caption hereof to be published in the official newspaper of the City of L!l
Porte at least twice within ten (10) days after the passage of this ordinance.
Section 10. The City Council officially finds, determines, recites and declares
that a sufficient written notice of the date, hour, place and subject of this meeting of the
City Council is posted at a place convenient to the public at the City Hall of the city for
the time required by law preceding this meeting, as required by the Chapter 551, Tx.
Gov't Code; and that this meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof has been discussed,
considered and formally acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting thereof.

SUMMARY & RECOMMENDATION
In the past, many municipalities (including the City of La Porte) utilized the pennit and/or inspection fee schedules
included in their respective code books. However, fee schedules are no longer included in the various code books
which means each city needs to adopt appropriate fees for their jurisdiction. At this time, by separate ordinance,
City Council is considering the adoption of new building codes for the city. Adoption of new pennit fee schedules
also needs to occur.
Staff reviewed the fee schedules of area cities and noted our fees were typically lower. In addition, although we do
not, many cities charge plan review fees and/or re-inspection fees.
Our electrical code pennit/inspection fees were established in 1989 and have not been updated since that time. For
other construction pennits, we are utilizing the fee schedules from the code books adopted in 1995.
Methods for calculating pennit fees vary from city to city. Some utilize flat fees while others utilize the square
footage of the structure to help detennine the appropriate fees. Staff has taken our current fee schedules and
increased them by 50%. Despite this increase, the fee schedules proposed by staff remain comparable to fee
schedules of area cities.
