ORDINANCE NO. 2003- ~ (p ~ I-
AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF
SOUTH 17th STREET, WEST "K" STREET AND THE ALLEYS IN BLOCKS 1092, 1093,
1139 & 1140, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS; FINDING
COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN
EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been requested by the record
owner of all of the property abutting the hereinafter described portion of South 17th Street, West
"K" Street and the alleys in Blocks 1092, 1093, 1139 & 1140, Town of La Porte, Harris County,
Texas to vacate, abandon, and permanently close the hereinafter described portion of South 17th
Street, West "K" Street and the alleys in Blocks 1092, 1093, 1139 & 1140, Town of La Porte,
Harris County, Texas, Town of La Porte, Harris County, Texas; and
WHEREAS, the City Council of the City of La Porte has determined and does hereby
find, determine, and declare that the hereinafter described portion of South 17th Street, West "K"
Street and the alleys in Blocks 1092, 1093, 1139 & 1140, Town of La Porte, Harris County,
Texas, is not suitable, needed, or beneficial to the public as a public road, street, or alley, and the
closing of hereinafter described portion of South 17th Street, West "K" Street and the alleys in
Blocks 1092, 1093, 1139 & 1140, Town of La Porte, Harris County, Texas, is for the protection
of the public and for the public interest and benefit, and that the hereinafter described portion of
South 17th Street, West "K" Street and the alleys in Blocks 1092, 1093, 1139 & 1140, Town of
La Porte, Harris County, Texas, should be vacated, abandoned, and permanently closed.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to the City of La Porte under its home
rule charter and Chapter 253, Section 253.001, Texas Local Government Code, the hereinafter
described portion of South 17th Street, West "K" Street and the alleys in Blocks 1 092, 1093,

1139 & 1140, Town of La Porte, Harris County, Texas, is hereby permanently vacated,
abandoned, and closed by the City of La Porte, to wit:
. That portion of the right-of-way of South 17th Street from the south right-of-way
line of Fairmont Parkway to the north right-of-way line of West "L" Street;
. That portion of the right-of-way of West "K" Street from the west right-of-way line
of South 16th Street to a line projected from the southwest corner of Block 1092 to
the northwest corner of Block 1140, Town of La Porte, Harris County, Texas;
. The entire alleys of Blocks 1092, 1093, 1139 and 1140, Town of La Porte, Harris
County, Texas;
Said rights-of-way containing a total of 93,480 square feet and as generally illustrated
on Exhibit "A" attached hereto and made part of herein.
Section 2. The City Council officially finds, determines, recites, and declares that a
sufficient written notice of the date, hour, place, and subject of this meeting of the City Council
was posted at a place convenient to the public at the City Hall of the City for the time required by
law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas
Government Code; and that this meeting has been open to the public as required by law at all
times during which this ordinance and the subject matter thereof has been discussed, considered,
and formally acted upon. The City Council further ratifies, approves, and confirms such written
notice and the contents and posting thereof
Section 3. This ordinance shall be effective from and after its passage and approval, and it is
so ordered. Subject to passage and approval of this ordinance, the City of La Porte hereby
retains two (2) utility easements described as follows and generally illustrated on Exhibit "N',
attached hereto and made part of herein.

EASEMENT NO. I:
A ten (10) foot wide utility easement retained by the City of La Porte on behalf of Centerpoint
Energy for an existing 8" Natural Gas Line. Said easement is based on a survey prepared by
Reliant Energy, dated 1/07/00 (Re: Job #D100ED99-068, Sketch No. 00-024). Centerline of said
easement is further described as follows:
COMMENCING at the southeast corner of Block 1139, Town of La Porte, Harris County,
Texas;
THENCE North, a distance of 448.06' to a point located on the west right-of-way line of
South 16th Street, said point being the POINT OF BEGINNING of the herein described
centerline of said Easement No.1;
THENCE South 89degrees, 59 minutes, 43 seconds West, a distance of 277.88' to a point
for corner;
THENCE North 0 degrees, 0 minutes, 19 seconds West, a distance of 248.89' to a point
located on the south right-of-way line of Fairmont Parkway.
EASEMENT NO.2:
A ten (10) foot wide public utility easement being further described as follows:
BEGINNING at the southeast corner of said Block 1093, Town of La Porte, Harris County,
Texas;
THENCE south, along the projected west line of South 16th Street, a distance of 10' feet;
THENCE west, parallel to and 10' south of the north right-of-way line of West "K" Street,
a distance of 592' to a point in the projected west line of said Block 1092, Town of La Porte,
Harris County, Texas;
THENCE north, a distance of 10' to the southwest corner of Block 1092, Town of La Porte,
Harris County, Texas;
THENCE east, along the north right-of-way line of West "K" Street, a distance of 592' to
the POINT OF BEGINNING.
