HomeMy WebLinkAboutR-1989-13 . e RESOLUTION NO. 89-13 WHEREAS, the City of La Porte, Texas, previously retained Sears and Burns as special counsel to represent its interests in litigation against the City filed by Southern Ionics, Inc., and Houston Chemical Services, Inc.; and, WHEREAS, the initial authority given by the City to Sears and Burns, to present defenses and pursue counterclaims arising from the facts, has been questioned by Southern Ionics, Inc., and Houston Chemical Services, Inc.; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: The authority of the City for Sears and Burns to present those defenses and counterclaims now stated, or others which may arise from the facts discovered, is reaffirmed. The authority given expressly includes all matters for termination of the Industrial District Agreement between the City and Southern Ionics, Inc., and notice thereof. Sears and Burns is authorized to do all acts necessary to effect the City's intention as stated herein and to defend it or seek relief as may, in that firm's opinion, be necessary.
