<br />. <br /> <br />. <br /> <br />RESOLUTION NO. 89-18 " <br />A RESOLUTION REGARDING LITTLE CEDAR BAYOU PARK. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section I. The City Council of the City of La Porte has <br />heretofore let a contract to Crystal Pools, Inc. for the <br />construction of a wave pool and associated facilities at Little <br />Cedar Bayou Park. Crystal Pools, Inc. has heretofore defaulted in <br />the performance of such contract, and declared bankruptcy. <br />Thereafter, Texas Insurance Company, the bonding company for Crystal <br />Pools, Inc., assumed performance of the obligations of Crystal <br />Pools, Inc., and completed construction of the wave pool. <br />Thereafter, the City of La Porte made demand upon Texas Insurance <br />Company to complete and perform certain items within the scope of <br />the one year contractorls warranty, as provided for in the original <br />agreement between the City of La Porte and Crystal Pools, Inc. <br />Texas Insurance Company was declared insolvent by the Texas <br />Insurance Commissioner, and placed in receivership, prior to its <br />performing the warranty work. <br />Section 2. It is therefore necessary for the City of La Porte <br />to have the warranty work engineered and constructed by other <br />parties. Attached to this resolution as Exhibit nAn, and <br />incorporated by reference herein, is a proposed plan for the <br />completion of the Little Cedar Bayou Park wave pool contract and <br />warranty items. The City Council of the City of La Porte hereby <br />approves the plan attached hereto as Exhibit nAn, and authorizes <br />the staff to move forward with the implementation of such plan. <br />Section 3. The City Council officially finds, determines, <br />recites and declares that a sufficient written notice of the date, <br />hour, place and subject of this meeting of the City Council was <br />posted at a place convenient to the public at the City Hall of the <br />City of La Porte, Texas for the time required by law preceding this <br />meeting, as required by the Open Meetings Law, Article 6252-l7, <br />Texas Revised Civil Statutes Annotated, and that this meeting has <br />been open to the public as required by law at all times during which <br />this resolution and the subject matter thereof has been discussed, <br />
