J.- /7 WHEREAS, the 1979 Legislature of the State of Texas passed and Governor Clements signed into Law Senate Bill 621 (The Property Tax Code) which relates to Ad Valorem taxation; and WHEREAS, said Property Tax Code provides for the creation of a Central Appraisal District within each County in the State; and WHEREAS, said Code further provides that the Central Ap- praisal Districts created shall assume responsibility for and be required to appraise all property within the boundaries of the District and to assume all other ad valorem taxation functions previously provided by local jurisdictions except for the set- ting of tax rates, the mailing of tax statements and the collec- tion of taxes levied. WHEREAS, the implementation of the Code is proving to be extremely cumbersome and controversial in urban metropolitan Counties as evidenced by the current level of dissatisfaction among and between taxing jurisdictions which has led to litiga- tion; and, WHEREAS, the Harris County Central Appraisal Board has indi- cated that the implementation of the Code in Harris County is going to be an almost insurmountable task; and WHEREAS, the 1981 Legislature in special session is consider- ing alternatives that would allow "phase in" flexibility to the taxing jurisdictions in Harris County under SB62l; and WHEREAS, additional time to work out reasonable solutions to the problems created by SB62l is needed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE THAT the Texas Legislature by this Resolution be urged to pass legislation to repeal SB62l or in the alternative pass legis- lation delaying implementation of the Code until solutions can be developed to the problems created thereby.
