WHEREAS, by resolution the City Council (the M:ity.Council")
0: :.::e City of La Porte, Texas (the "City"), authorized and
a;;~:ved the creation of the City of La Porte Indus~rial Develop-
:::e::-: Corporation (the "Corporation") as a nonpro:it industrial
=e"...:::'op::;ent corporation under the provisions of t::e Development
Cor;.:ration Act of 1979, Article 5190.6, Vernon's Annotated
~exa5 Civil Statutes, as amended (the "Act"); and
~'iHEREAS, the City
o::"=r-=.ting and existing
t::-e .= ta te 0 f Te xa s (the
C~ar:er of the City; and
is a duly
under the

and the duly adc~':ed Home Rule
~'lHE~EAS, the Corporation is authorized by t::e Act to issue
:,o:::::s on behalf of the Ci ty for the purpose of pe.::-ing all or a
~a::t ~f the costs of a "project" as defined in t::e Act, and to
leas: or- sell the project o~ to loan the procee:::s of the bonds
to ::~ance all or part of the costs of a project; a::j
~'iHEREAS, the definition of "project" in the j..c:. includes the
la:-:c, buildings, equipment, facilities and impro'l.::::-.ents (one or
:::o::e found by the Borad of Directors of the Cor;:Jration to be
::e~~:::ed or suitable for the promotion of commer~:al development
an= ~xpansion and in furtherance of the public purposes of the Act,
or :::: use by commercial enterprises, all as define~ in the rules

;,jOii, THEREFORE:, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF LA PORTE, T~XAS THAT;
Section 1. The Ci ty Council hereby finds, dete~mines and
decla~es chat the areas outlined in a heavy black line on the
map attached as Exhibit "An to this Resolution shall be declared
to be eligible. blighted areas (nEBA") because such areas (i)
have a substantial number of substandard, slum, deter.iorated, or
deteriorating structures and (ii) suffer from a high relative
rate of une~ployment. The City Council further finds, determines
and decla~es that such conditions in such areas substantially
impair or arrest the sound growth of the City, constitute an
economic or social liability and are a menace to the ~ublic health,
safety or welfare.
Section 2. The overall objectives of the City for redevelop-
ment and recovery of the EBA are as follows:
A. To promote the present and prospective health, safety,
rights to gainful employment and general welfare of the people of
the City and the State.
B. To promote the continued existence, development and
expansion of commerce and industry essential to the economic
grO\"t~l of the City and the full employment, \velfare and prosperity
of its citizens.
C. To encourage the economic g~O\'lth and stabil i ty of the
City by increasing and stabilizing employment opportunities,
s ig n i f ican tly increas ing and stabil iz ing the property tax base
and pr.ollloting commerce r"dthin the City and the State. .
D. To er.courage employment of the inhabi tan ts
by encourag i ng e:nploYers to loca te proj ec ts \o/h ich
such persons in o~ adjacent to the CHA.

Section 3. The City Council hereby finds, determines, de-

any projects for commercial uses in or adjacent to the EBA unless
the applicant desiring approval of such project demonstrates to the
satisfaction of the City Council that:

Section 5. Based upon the City's best estimates as of the
date ot this Resolution, a description of the proposed public
improvements to be made in the EBA, including the estimated
comnencement date, approximate schedule and sources of funds to
be used by the City for such public improvements, are as set forth
in Exhibit "B" to this Resolution.
Section 6. The City Council hereby covenants and represents
that it \Vill revie\v all project descriptions for approval of
sp~cific projects for commercial uses in order to determine \vhether
such projects are consistent with the City's objectives for re-
development of the EBA.
Section 7. The City Secretary of the City is hereby directed
to provide a certified copy of this Resolution, including all
exhibits, to the Executive Dir~cto~ of the Commission as required
by the Rules. Unless the City shall be notified by the Commission
to the contrary in writing \vithin thit.ty (30) days from the date
of receipt of such certified copy ot this Resolution, the E01\ shall
be deemed accepted by the Commission, and the City and the Corpot'a-
tion may thereafter app~ove projf~cts fo~ commercial uses in and
adjdccnt to the EO^ in compliance with the Act, the Rules and this
Resolution.

Description of Proposed Public Improvements to be
Made in the EBA
1.
Description of public improvements:
Street paving; storm drainage; extension of water and sanitary
sewer mains to areas not presently served .by water and sanitary
sewer; rehabilitation of existing sanitary sewer system.
2. Estimated commencement date for such public improvements:
Portions of the public improvements described above are now in
progress; the remainder will commence in 1982 and 1983.
3.
Approximate schedule for such public improvement:
The storm drainage is a five-year program; most of the other
public improvements will be completed in 1983 and 1984.
4.
Source of funds as the Unit will use for such improvements:
Portions of the improvements are being funded by previous bond
issues; the rehabilitation of the sanitary sewer system is
being funded, twenty-five per cent (25%) by local bond funds,
and seventy-f iVI~ per cen t (75%) by the Environmental Protection
Agency through a grant to the City of La Porte; the remainder
of the work is being funded by current tax revenues of the
City of La Porte. ~

A RESOLUTION AUTHORIZING THE MAYOR TO MAKE APPLICATION FOR A
TITLE III GRANT UNDER THE OLDER AMERICANS ACT; TO SIGN THE
ACCEPTANCE OF TH:E: GRANT; AND TO SIGN ANY OTHER NECESSARY
DOCUMENTS REQUIRED TO COMPLETE THE PROJECT ON BEHALF OF THE
CITY OF LA PORTE
WHEREAS, the City of La Porte, Texas, a Municipal
Corporation deems it necessary and proper to apply for a
Title III Grant under the Older Americans Act, and to adhere
to the rules and regularions pursuant thereto;

NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of La Porte that the Mayor, Virginia Cline, or
her successor, is hereby authorized and directed to make
application for a grant under Title III of the Older Americans
Act pursuant to the rules and regulations thereto, and to sign
the acceptance of the grant, when made, and other necessary
documents required to complete the project on behalf of the
above named applicant.
