<br />. <br /> <br />. <br /> <br />. <br /> <br />e <br /> <br />RESOLUTION <br />82-15 <br />WHEREAS, Jesse Lovelace Construction Co. has filed a protest with the City <br /> <br />alleging that 40 CFR 35.939 applies to the rebidding and contract award process attendant <br /> <br />upon completion of the City's sanitary sewer rehabilitation project (EPA Project No. <br /> <br />C-481176-03); and, <br /> <br />WHEREAS, any such protest should best be heard by a hearings examiner for the <br />Council; Now, Therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br /> <br />1. The law firm of Sears and Burns, special counsel to the City, and Charles <br />Dippel of that firm, be and they are hereby appointed by the City to conduct a hearing or <br />hearings on behalf of the City on any protests predicated upon 40 CFR 35.939. <br />2. Such law firm and attorney shall schedule and hold hearings at its con- <br /> <br />venience and give notice to interested parties of any such hearings and the procedures <br /> <br />therefor and the resolution of the protest. <br />3.
