Area Map Budgeted Item: _YES ---X-NO SUMMARY & RECOMMENDATION The City has received application from Mr. Lin Pfeiffer to vacate, abandon and close the North 14th Street Right-Of-Way between West Polk and West Adams Street rights-of-way. The applicant's reason for this request is to facilitate future expansion of Pfeiffer & Son, Ltd. at 116 N. 16th St. Upon review of the proposed closing, the Public Works Department has stated no objection to the closing. Additionally, each of the City's franchised utility companies (i.e. Centerpoint Energy, SBC & Comcast) have reviewed the closing and each company has submitted letters of no objection. In accordance with Section 62.35 of the Code of Ordinances, an independent appraisal has been conducted of the North 14th Street Right-of-Way which contains a total of 24,000 square feet. The resulting fair market value ofthe right-of-way has been assessed at $0.75 per square foot. The City has subsequently received payment from the applicant in the amount of $13,500 (75% of fair market value per the ordinance) from the applicant for the closing. Recommendation: It is Staff's recommendation that Council authorize vacating, abandoning, and closing the North 14th Street Right-Of-Ways between West Polk Street and West Adams Street as petitioned by the applicant. Action Required of Council: Authorize an ordinance vacating, abandoning, and closing the North 14th Street Right-Of-Way between the West Polk and West Adams Street. cil Agenda 01.0') ate Exhibit "A" to Agenda Packet Ordinance ORDINANCE NO. 2007-~D~ 1 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF NORTH 14TH STREET, IN THE CITY OF LA PORTE, HARRIS COUNTY, TEXAS, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of La Porte has been requested by record owners of all of the property abutting the hereinafter described portion of North 14th Street, City of La Porte, Harris County, Texas, to vacate, abandon, and permanently close that portion of North 14th Street, City of La Porte, Harris County, Texas; and WHEREAS, the City Council of the City of La Porte has determined and does hereby find, determine and declare that the hereinafter described portion of North 14th Street, City of La Porte, Harris County, Texas, is not sui table, needed, or beneficial to the public as a public road, street or alley, and the closing of the hereinafter described portion of North 14 th Street, City of La Porte, Harris County, Texas, is for the protection of the public and for the public interest and benefit, and that the hereinafter described portion of North 14th Street and North 15th Street, City of La Porte, Harris County, Texas, should be vacated, abandoned, and permanently closed. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. Under and by virtue of the power granted to the City of La Porte under its Home Rule Charter and Chapter 253, Section 253.001, Texas Local Government Code, the hereinafter described portion of North 14th Street, City of La Porte, Harris County, Texas, is hereby permanently vacated, abandoned and closed by the City of La Porte, to wit: All of that portion of the right-of-way of North 14~ Street, in the City of La Porte, Harris County, Texas, lying and being si tuated between Blocks 868 and 687, Town of La Porte, Harris County, Texas, and between the north right-of-way line of West Polk Street, and the south right-of-way line of Adams Street, as more particularly described on Exhibit "AfT attached hereto. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the Ci ty Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this ordinance and the subj ect matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3 .
