HomeMy WebLinkAboutR-1990-08 . e RESOLUTION NO. 90-8 A RESOLUTION AUTHORIZING APPEAL OF THE TEXAS WATER COMMISSION DECISION ON THE PENDING APPLICATION OF HOUSTON CHEMICAL SERVICES, INC., FOR A HAZARDOUS WASTE FACILITY PERMIT; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF WINSTEAD, SECHREST & MINICK TO REPRESENT THE CITY OF LA PORTE IN SUCH MATTERS; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. That the City Council of the City of La Porte hereby authorizes the filing and pursuit, on behalf of the City of La Porte, of any and all motions for rehearing and other pleadings at the Texas Water Commission regarding, complaining of and/or seeking reconsideration by the Commission of any decision or order approving in whole or in part the pending application of Houston Chemical Services, Inc. for a hazardous waste facility permit; and further hereby authorizes the filing and pursuit, on behalf of the City of La Porte, of any and all petitions and other pleadings in state district court regarding, appealing, complaining of and/or challenging any such decision or order of the Texas Water Commission. Section 2. The City Manager is hereby authorized and directed to execute, on behalf of the City of La Porte, an addendum to the February 26, 1990, Fee Agreement between the City of La Porte and the law firm of Winstead, McGuire, Sechrest & Minick, which addendum shall provide for said law firm to represent the City of La Porte in connection with the matters specified herein. Section 3. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City of La Porte, Texas for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. . e RESOLUTION NO. 90- 8 Page 2 Section 4.
