HomeMy WebLinkAboutR-1991-05 e e RESOLUTION NO. 91-05 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE LAW FIRM OF WINSTEAD, SECHREST & MINICK TO REPRESENT THE CITY OF LA PORTE IN CONNECTION WITH THE PENDING APPEAL OF THE TEXAS WATER COMMISSION DECISION ON THE APPLICATION OF HOUSTON CHEMICAL SERVICES, INC. FOR A HAZARDOUS WASTE FACILITY PERMIT; MAKING APPROPRIATION OF FUNDS FOR SAID AGREEMENT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council of the City of La Porte has heretofore authorized the City Manager of the City of La Porte to enter into, on behalf of the City of La Porte, an agreement with the law firm of Winstead, Sechrest & Minick, dated February 26, 1990, and an addendum to said agreement, dated September 24, 1990. Section 2. The City Manager is hereby authorized and directed to execute, on behalf of the City of La Porte, a further addendum to the February 26, 1990, and September 24, 1990, Fee Agreements between the City of La Porte and the law firm of Winstead, Sechrest & Minick, which addendum shall provide for said law firm to represent the City of La Porte in connection with the pending appeal of the Texas Water Commission decision on the application of Houston Chemical Services, Inc., for a hazardous waste facility permit. Section 3. The City Council of the City of La Porte hereby authorizes the payment of $135,000.00 from the General Fund, Legal Budget, to the law firm of Winstead, Sechrest & Minick. Section 4. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City of La Porte, Texas for the time required by law preceding this meeting, as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. . e RESOLUTION NO. 91-05 Page 2 Section 5.
