RESOLUTION NO. 91-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF lA PORTE, TEXAS, APPROVING CONTINUED PARTICIPATION IN THE TELEPHONE FRANCHISE STEERING COMMITTEE AND APPROVING A ONE TIME PAYMENT OF ONE CENT PER CAPITA (.01) OR TWO HUNDRED SEVENTY-NINE DOLLARS AND TEN CENTS ($279.10); FINDING COMPLIANCE WITH THE OPEN MEETINGS lAW; AND PROVIDING AN EFFECTIVE DATE HEREOF. WHEREAS, The City has a public responsibility to protect the public rights-of-way and easements and to require the telephone company to assume certain duties and responsibilities regarding such easements and rights-of-way by means of responsible terms and conditions in a franchise ordinance; and WHEREAS, a steering committee of Cities could share information, develop a model ordinance, obtain special legal and auditing counsel and provide further assistance to the member cities in the adoption of franchise ordinances with the telephone utility company; Whereas, the City has shown it's support of such a committee with a prior resolution; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF lA PORTE: Section 1. That the continued participation by the City in the Telephone Franchise Steering Committee is hereby approved. Section 2. The City agrees to pay a one time assessment of one cent (.01) per capita or two hundred seventy-nine dollars and ten cents ($279.10) for use by the Telephone Franchise Steering Committee. Such funds shall be used for the sole purposes stated above. Section 3. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City of La Porte, Texas for the time required by law preceding this meeting, as required by the Open Meeting Law, Article 6252-17, Texas Revised Civil Statutes Annotated; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 4. This resolution shall be in effect from and after its passage and approval. PASSED AND APPROVED this the 24th day of June, 1991.
