RESOLUTION NO. 87-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA PORTE COMMIT- TING TO THE AUTHORITY THE DEMAND ALLOCATION FACTOR AND PUMPING ALLOCATION FACTOR NEEDS OF THE CITY OF LA PORTE AS DEFINED IN THE OFFER SUBMITTED TO THE CITY OF HOUSTON; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN AFFECTIVE DATE HEREOF 1 WHEREAS, the Harris-Galveston County Coastal Subsidence Dis- trict has mandated that the City of La Porte drastically reduce its consumption of ground water and convert to the consumption of treated surface water, in recognition of the urgent public necessity to alleviate further subsidence of the land area of the City of La Porte, and the consequent danger of loss of life and property from flooding; and WHEREAS, the La Porte Area Water Authority was created by the Texas Legislature to provide a vehicle for the planning, financing, construction, and operation of facilities to provide potable surface water to a geographic area specifically including the coroporate limits and the jurisdiction of the City of La Porte, Harris County, Texas; and WHEREAS, the La Porte Area Water Authority has, since its creation in 1982, in conjunction with the City of La Porte, spent time and funds in exploring the feasibility of obtaining potable surface water for a geographic area specifically including the corporate limits and the jurisdiction of the City of La Porte: and WHEREAS, the La Porte Area Water Authority has concluded as a result of its studies that the most expeditious, efficient, and viable alternative to obtain provision of potable surface water to a geographic area specifically including the corporate limits and the jurisdiction of the City of La Porte is to enter into, participate with, and share in the cost of construction of the City of Houston's Southeast Water Purification Plant; and . e Resolution No. 87-2 , Page 2. WHEREAS, it is necessary, in order for the Authority to par- ticipate in the construction of the Southeast Water Purification Plant for the Authority to enter into a contract with the City of Houston, including among other things, a breakdown of cost to the Authority for its participation in the project, and a commit- ment to the City of Houston of the quantity of water needed by the La Porte Area Water Authority, and the peak time demands for water of the La Porte Area Water Authority: and WHEREAS, in order for the Authority to commit to the City of Houston its demand for potable surface water, together with its de- mand for peak cycle quantities of water to be pumped to the Author- rity from the southeast treatment plant, -it is necessary for the Authority to ascertain from its customers their respective water needs, specifically including those of the City of La Porte: and WHEREAS, the City of La Porte is desirous in committing to the La Porte Area Water Authority its quantity and peak demand needs for potable surface water; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, HARRIS COUNTY, TEXAS: section 1. That the City of La Porte publicly and formally make commitment to the La Porte Area Water Authority, to become a customer of the La Porte Area Water Authority, requiring 3.5 MGD demand allocation factor, and 4.375 MGD pumping allocation factor, with all terms being defined for purposes of this resolution as they are defined in the contract sent to the City of Houston. Section 2. The City Council officially finds, determines, recites and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, . . Resolution No. 87~2 , Page 3. as required by the Open Meetings Law, Article 6252-17, Texas Revised Civil Statutes Annotated: and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. ThiE? Resolution shall take effect and be in force from and after its passage and approval. PASSED AND APPROVED this the 9th day of February , 1987.
