The proposed changes are summarized below and were documented and detailed in the information provided to Council during Budget Workshops during the week of August 8-11,2005. The following fees were left off at the time the other fees changes were passed. 1. Planning, Engineering & Fire Prevention a. Zoning Permit - Proposed $50.00 - Estimated additional revenue - $3,925 2. Public Works - Solid Waste- a. Commercial Solid Waste - Proposed $16.00 - Estimated additional revenue - $6,390 Action Required bv Council: Approve Ordinances amending the zoning permit fee and commercial solid waste fee as indicated. Approved for City Council A2enda /d -S--D5- Date .1 ORDINANCE NO. 200S-2837-A AN ORDINANCE AMENDING nAPPENDIX A, FEES I n OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, CONTAINING A REPEALING CLAUSE, CONTAINING A SEVERABILITY CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The following Chapters of II Appendix A - - Fees, n of the Code of Ordinances of the City of La Porte are hereby amended and shall hereafter read as follows. The amendments contained in this ordinance shall be effective December 13, 2005, unless otherwise stated. Section 2. Chapter 58, IISolid Waste,lI Article III. Rates and Charges, subsection (b), is hereby amended and shall hereafter read as follows, to-wit: II (b) Business and commercial establishment collection, twice-weekly, per month (minimum charge) ............ 16.00 58-10711 Section 3. Chapter 106, II Zoning," Article II. Admini- stration, subsection (a) Application fees, is hereby amended by adding a subparagraph (5) and shall hereafter read as follows, to- wit: "(5) Zoning permit......................... 50.00 106-143" Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict only. Section s. If any section, sentence, phrase, clause, or any part of any section, sentence, phrase, or clause, of this Ordinance shall, for any reason, be held invalid, such invalidity shall not affect the remaining portions of this Ordinance, and it is hereby declared to be the intention of this city Council to have passed each section, sentence, phrase, or clause, or part thereof, irrespective of the fact that any other section, sentence, phrase, or clause, or part thereof, may be declared invalid. Section 6. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the pUblic as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 7. This Ordinance shall be in effect from and after its passage and approval. The fees in this ordinance shall be effective December 13, 2005, unless otherwise indicated.
