The award went to Omni Pinnacle, LLC, of Slidell, Louisiana, as the primary contractor and DRC Emergency Services, LLC, of Mobile, Alabama, as the secondary contractor. The annual term contract began on June 1,2006 with four (4) renewable options for one (1) year periods. Harris County attorneys reviewed the interlocal and made a few changes. Clark Askins reviewed and recommended we bring back to Council with the corrected version. Staff Recommendation: Approve revised Interlocal Agreement with Harris County and Omni Pinnacle, LLC and DRC Emergency Services, LLC. Approved for City Council A!!enda / i -{; -ok; Date ORDINANCE NO. 2006-2898-A AN ORDINANCE APPROVING AND AUTHORIZING AN INTERLOCAL AGREEMENT FOR DEBRIS REMOVAL AND DISPOSAL SERVICES BETWEEN THE CITY OF LA PORTE AND HARRIS COUNTY, TEXAS, MAKING VARIOUS FINDINGS AND PROVISIONS RELATING TO THE SUBJECT, FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW, AND PROVIDING AN EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: Section 1. The City Council hereby approves and authorizes the contract, agreement, or other undertaking described in the title of this ordinance, a copy of which is on file in the office of the city Secretary. The city Manager is hereby authorized to execute such document and all related documents on behalf of the City of La Porte. The City Secretary is hereby authorized to attest to all such signatures and to affix the seal of the City to all such documents. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Codej and that this meeting has been open to the public as required by law at all times during which this ordinance and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. WITNES SETH Whereas, Harris County and the La Porte are authorized to enter into an agreement to contract with eligible .entities to perform governmental functions and services, including the .. purchase of goods and services pursuant to and illlder th~ provisions 'of Tex. Goy't Code Ann. ~791.001 et seq (Vernon 1994 & Supp. 2003), also known as "The Intcrlocal Cooperation Act"; and, Whereas, in reliance on such Act, Harris County and the La Porte desire to permit the debris removal and disposal services. Now therefore, the parties hereto, mutually agree to the following:!. The City of La Porte ("La Portell) hereby designates it's Emergency Management Coordinator and Assistant Director of Public Works to act illlder the direction and on behalf of La Porte for debris removal and disposal services pursuant to Harris ComIty's Agreement with Omni Pinnacle, LLC (Omni), as primary contractor and DRC Emergency Services, LLC (DRC), as secondary contractor, which was let in accordance with Chapter 252 of the Texas Local Government Code and all other applicable laws and which agreement is attached hereto as Exhibit "A" and incorporated. herein for ~l intents and purposes II. La Porte, by execution of this Agreement; agrees to directly pay Omni and/or DRC upon 1'eceipt of goods and/or completion of work specified for La Porte's debris removal and disposal ~ervices, according to the description contained herein. and after receipt of a proper invoice, therefore an amoWlt based upon the unit pricing detailed in Exhibit "A". Neither Harris COilllty nor La Porte shall assume any responsibility or liability to pay for materials plU'chased or services performed for the benefit of the other entity. La Porte's payment required by tlus contract shall be made from current, available revenues, as approved by La Porte City Council. I believe this went to Council twice, but only required one agreement and set of signatures. We are still working on the signed agreements for AT&T.
