AN ORDINANCE VACATING, ABANDONING AND CLOSING THE STREETS AND
ALLEYS LYING WITHIN A 96.242 ACRE TRACT OF LAND OUT OF THE T. W.
LEE SUBDIVISION OF A PORTION OF THE RICHARD PEARSALL 1/3 LEAGUE,
A-625, HARRIS COUNTY, TEXAS; FINDING COMPLIANCE WITH THE OPEN
MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of La Porte has been
requested by the record owner of all of the property described
by metes and bounds on Exhibit "A" attached hereto, incorporated
by reference herein, and made a part hereof for all purposes,
to vacate, abandon, and permanently close the streets and alleys
lying within said 96.242 acre tract of land, with the exceptions
noted on Exhibit "A" attached hereto; and

WHEREAS, the City Council of the City of La Porte has deter-
mined, and does hereby find i. determine and declare that the -:.
streets and alleys situated within said 96.242 acre.tract, except
as noted on Exhibit "An attached hereto, are not suitable, needed,
or beneficial to the public as:public a~leys, roads, or streets,
and that the closing of said streets and alleys wil~ be for the
protection of t~e.public and for the public interest and benefit,
and that the said streets and alleys should therefore be vacated,
abandoned, and permanently closed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LA PORTE:
Section 1. Under and by virtue of the power granted to
the City of La Porte under its Home Rule Charter and Chap. 13,
Title 28, Art. 1175, of the Revised Civil Statues of the State
of Texas,' 1925, all of the streets and alleys situated within

a 96.242 acre tract of land of the T. W. Lee Subdivision of w, ..;t
a portion of the Richard Pearsall 1/3 League, A-625, Harris
Coun ty, Texas, accord ing to the plat of record in Volume 67,
Page 1, of the Hal:ris County Deed Records, and being more par-
ticularly described by metes and bounds on Exhibit "A" attached
hereto, incorporated by I:eference hel:ein, and made a part hereof

for all purposes, SAVE AND EXCEPT those portions of "C" Street
and "F" Street as'shown on said Exhibit "A", are hereby perma-
nently vacated, abandoned, and closed by the City'of La Porte.
Section 2. The City Council officially finds, deter-
mines, recites and declares that a sufficient written notice
of the date, hour, place. and subject of this meeting of the
Ci ty Council was posted at a place convenient to the public.
at the City Hall of the City for the time required by law

and

that this meeting has been open. to the public as required by
law at all times du~ing which this ordinance and the sUbje<?t
matter thereof has been discussed, considered and formally
acted upon. The City Council further ratifies, approves and
confirms such written notice and the contents and posting
thereof.
Section' 3. This Ordinance shall take effect and be in
force from and after its passage and approval.

METES AND BOUNDS DESCRIPTION
e
Being a 96.242 acre tract of land out of the T. W. Lee Sub-
division of a portion of the Richard Pearsall 1/3 League, A-625,
Harris County, Texas, according to the plat of record in Volume
67, Page 1, of the Harris County Deed Records; said tract of
land consisting of Blocks 620, 621, 622, 623, 624, 625, 626,
635,636, 637, 638, 639, 640,641,656,657,658,659,660,
661, 662, 671, 672, 673, 696, 697, 698 and the residue of Block
707; also including the street and alleys contained therein.
The 96.242 acre tract of land is more particularly described
by metes and bounds as follows:

BEGINNING at a 5/8 inch iron rod set for the Southeast
corner of Block 698; said point being coincident with the point
of intersection of the West right-of-way line of Twenty-Fifth
Street (based on a width of 60 feet) and the North right-of-way
line of "A" Street (based on a width of 60 feet).
THENCE, South; coincident with the West right-of-way line
of Twenty-Fifth Street; a distance of 452.50 feet to a 5/8 inch
iron rod set for corner coincident with the present North right-
of-way line of West Main Street (Spencer Highway).
THENCE, West; coincident with the present North right-of-
way line of North Main Street; a distance of 266.00 feet to a
5/8 inch iron rod set for the Southwest corner of this tract;
said point being coincident with the East right-of-way line of
Twenty-Sixth Street.

THENCE, North; coincident with the East right-of-way line
of Twenty-Sixth Street (Sens Road) based on a width of 60 feet;
passing at 2,732.50 feet, a 5/8 inch rod set for the Northwest
corner of Block 626; for a total distance of 2,790.81 feet to
a point for corner in the center of an existing drainage ditch.
THENCE, East; with the center of the existing drainage
ditch, a distance of 2,240.53 feet to a point for the Northeast
corner of this tract.
THENCE, South; coincident with the West right-of-way line
of Nineteenth Street; passing at 58.31 feet a 5/8 inch iron
rod set for the Northeast corner of Block 620; for a total
distance of 1,428.31 feet to a 5/8 inch iron rod set for corner.
THENCE, West; coincident with the centerline of "C" Street
(based on a width of 60 feet); a distance of 1,282.53 feet to
a 5/8 inch iron rod set for corner.
THENCE, South; coincident with the centerline of Twenty-
Third Street; a distance of 910.00 feet to a point for corner.
THENCE, West; coincident with the North right-of-way line
of II A" Street; passing at 40.00 feet the Southeast corner of
Block 696; for a total distance of 692.00 feet to the Point
of Beginning.
SAVE AND EXCEPT the following described parcels:
(1) That portion of "e" Street lying between the East
right-of-way 1 ine of Twenty-Sixth Street (Sens Road) and the
West right-of-way line of Twenty-Third Street.
(2) That portion of II F" Street lying between the East
right-of-way line of Twenty-Sixth Street (Sens Road) and the
West right-of-way line of Nineteenth Street.

(3) A 10.00 feet wide utility easement crossing the right-
of-ways for "B" Street, "D" Street and "E" Street; the utility
easements being parallel wi th the East right-of-way line of
Twenty-Sixth Street (Sens Road), with the centerline of the
easement being located 15.00 feet East of the East right-of-way
line of Twenty-Sixth Street.
(4) A 10.00 feet wide utility easement crossing the right-
of-way of "An Street; the centerline of the utility easement
being described as follows; Commencing at the Southwest corner
of Block 698, coincident wi th the East right-of-way line of
Twenty-Sixth Street.
THENCE, East; coincident with the North right-of-way
line of II A" Street; a distance of 23.57 feet to the POINT OF
BEGINNING for the centerline of this 10. 00 feet wide utili ty
easement.

THENCE, S 40 17' 21" E, a distance of 60.17 feet to
a point for corner coincident with the South right-of-way line
of II A" Street and being the point termination for this ease-
ment.
(5) Being a tract located in the T. W. Lee Subdivision,
Richard Pearsall 1/3 League, A-625, Harris County, La Porte,
Texas, according to the plat recorded in Volume 67, Page 1,
of the Harris County Deed Records, said tract being the West
1/2 of former 23rd Street, lying between the North right-of-
way line of II A" Street and the North right-of-way line of "C"
Street; being part of the streets and alleys, vacated, aban-
doned and closed by order of Harris County Commissioners Court
dated April 8, 1935. The tract is more particularly described
as follows:

BEGINNING at the Southeast corner of Block 696, T. W. Lee
Subdivision, which is the point of intersection of the North
right-of-way line of II A" Street with the West right-of-way
line of former 23rd Street;
THENCE, North, coincident with the West right-of-way line
of former 23rd Street, a distance of 940.00 feet to the South-
east corner of Block 660, Town of La Porte;
THENCE, East, coincident with the North right-of-way line
of former "C" Street, a distance of 80.00 feet to the South-
west corner of Block 659, Town of La Porte;
THENCE, South, coincident with the East right-of-way line
of former 23rd Street, a distance of 30 feet to a point for

THENCE, West, 40 feet along the centerline of former "C"
Street right-of-way to a point for corner;
THENCE, South, along the centerline of former 23rd Street,
