HomeMy WebLinkAboutO-2008-3111 amended curfew Hurricane Ike Proclamation Second Amended Curfew City Ordinance # 3lll September 17, 2008 Due to Hurricane Ike, the City of La Porte has issued a mandatory evacuation of the City. WHEREAS, by proclamation issued September 11, 2008 and amended September 13, 2008, the Mayor declared a curfew for the City of La Porte. Whereas, by this proclamation issued September 17, 2008, the Mayor has amended that curfew as follows: WHEREAS, said state of disaster requires that certain emergency measures be taken pursuant to the Executive Order of the Governor Relating to Emergency Management. Now, therefore, the following amended regulations shall take effect immediately upon issuance, and shall remain in effect as noted: 1. CURFEW (a) A person shall not remain or travel upon any public or private property within the city of La Porte City limits as follows; From 12:00 am, midnight, on Thursday, September 18, 2008 until 5:00 am on Thursday, September 18, 2008; thereafter nightly, from 12:00 am until 5:00 am until further notice. (b) Subsection (a) shall not apply to: (1) a person authorized by the Emergency Management Director to assist in the production of the health, safety, or welfare of the public; or (2) a person who remains or travels upon private property which is owned by him or upon which the person has been invited. 2. PENALTY (a) This regulation shall have the effect of an ordinance when signed by the Mayor. (b) A person who violates any provision of this regulation, upon conviction, is punishable by a fine of not more than five hundred dollars ($500.00). 3. EMERGENCY This ordinance shall take effect immediately from and after its passage and publication, and it is accordingly so ordered. f\O~TED AND APPROVED this 17th_day of September, 2008. ~~p~ Mayor, City of La Porte Harris County, Texas EMERGENCY DECLARATION 2008- CITY OF LAPORTE, TEXAS A DECLARATION OF EMERGENCY WHICH AUTHORIZES THE MA YOR TO EXECUTE AND IMPLEMENT AN EMERGENCY POLICY REGARDING ITINERANT VENDORS SUPPLYING SERVICES AND SUPPLIES IN THE CITY OF LAPORTE TO THOSE WHO SUSTAINED PROPERTY DAMAGE RESULTING FROM HURRICANE IKE. WHEREAS; On or about September12 and 13,2008 the City of LaPorte was impacted by a category two hurricane, "IKE" and sustained widespread damage as a result of wind and flooding, some of which was classified as major, and WHEREAS; it is a concern that some unscrupulous contractors, during the recovery phase of such a disaster, may prey upon those in need of reconstruction services, supplies and general assistance, and WHEREAS; The City of LaPorte is intent upon protecting its citizens and eliminating any price gouging and improper or illegal work practices, while encouraging an orderly and effective recovery for property owners who hire contractors registered with the city. NOW THEREFORE; In recognition of the above findings, the City of LaPorte hereby adopts the Interim Policy Regarding Itinerant Vendors attached hereto and made a part hereof for all purposes as Exhibit "A". Attest: Mayor Alton Porter YA1J:U nl0Vo..M~, Lff1 City Secretary, Martha Gillett INTERIM POLICY REGARDING INTINERANT VENDOR In recognition of the possibility that some contractors, during the recovery phase of an emergency, may prey upon those in need of reconstruction services, supplies and general assistance, the City of LaPorte, is hereby adopting the following policy effective 9-16-08 and continuing until 3-16-09, unless sooner terminated: Any contractor performing construction/reconstruction services, or providing supplies for any property in the city damaged by Hurricane IKE shall be required to register with the City of LaPorte, Permit Division. Registration shall be required regardless of whether or not the contractor is based out of a building, a vehicle, or an open-air site, and whether or not temporary or permanent. Registration process shall include the collection of identification for all employees and all employee vehicles used in the course of such work or selling such supplies. Such registration shall not be withheld, but will be kept on file should it become necessary for investigation of improper work practices or price gouging, and to reassure property owners that contractors are properly identified.
