Action Required bv Council: Consider approval of a Resolution declaring opposition to the development of a low and very low income 128-uni I housing complex near the comer of South Broadway and McCabe Road. 3;) ;; Date RESOLUTION NO. dO J 0 ',- 02 RESOLUTION DECLARING CITY COUNCIL OPPOSITION TO THE CONSTRUCTION OF A LOW AND VERY-LOW INCOME RENTAL HOUSING COMPLEX NEAR THE CORNER OF SOUTH BROADWAY AND Mc CABE ROAD IN LA PORTE, TEXAS. WHEREAS, during a 2-22-10 workshop, the City Council for the City of La Porte was presented with a notice regarding a 128 unit rental housing complex being proposed for funding under the Low Income Housing Tax Credit Program (LIHTC) through the Texas Department of Housing and Community Affairs (TDHCA); and WHEREAS, the proposed project is intended to consist of units restricted to only clients of 60%, 50% and 30% of the area median family income thereby requiring 100% of the units to be income restricted; WHEREAS, a thorough analysis of city regulations indicates that a project of this size would require regulatory relief in order to be built at the subject site; and WHEREAS, the area of La Porte in which the project is proposed has existing multi- family rental housing complexes that serve low and moderate families and at least one that is currently closed and vacant; and WHEREAS, the project developer has made no attempt to contact the city to discuss plans for this proposed development or their development history; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS THAT: SECTION 1. The City Council of the City of La Porte objects to said construction of the 128 unit multi-family rental project proposed on 9.571 acres located near the comer of South Broadway and McCabe Road in La Porte. SECTION 2. The Planning Department is hereby directed to notify the Texas Department of Housing and Community Affairs (TDHCA) of the position of the City by serving them with a certified copy of this resolution and to attend appropriate public hearings of the TDHCA regarding this project.
