The easement is necessary to connect the park with the community across the CenterPoint power line corridor. The easement request was rejected by CenterPoint and the City began the process of obtaining a Takings Resolution in July of 2010. At that time, the Council directed staff to continue negotiations with CenterPoint to try to reach a solution. A new, shorter easement route was established, which met the CenterPoint request for a perpendicular crossing. CenterPoint's major concern is that the City cannot legally indemnify a public utility, so they feel that granting the easement places an undue liability burden on them. CenterPoint requested a License Agreement rather than an easement and the City agreed to entertain the proposal. Several draft versions of the agreement have been proposed by both sides. Staff members from both groups have continued to meet to try to resolve the problems associated with the language of the proposed License Agreement. For example, CenterPoint wanted the right to cancel the license with 90 days notice, without cause. The City was not comfortable with this condition, as well as others in the proposed agreement. On March 10 the City Attorney received notification from CenterPoint that they will not grant an easement or a license agreement for our use of the property and asked us to proceed with the condemnation suit (see attached Exhibit). In consultation with the City Attorney and the City Council, the only recourse the City has at this point, is to exercise our right of condemnation for the .0344 acres of land that we need to be able to build the pathway. The City Attorney will be obtaining an appraisal of the property values for the condemnation procedure. Council has recommended that staff present the attached Takings Resolution that will put CenterPoint on notice that the City intends to use condemnation power to obtain an easement on this property. That the said Knox W. Askins, as City Attorney for the City 2f La Porte, or his designated representative, be and he is hereby authorized to negotiate with the owners of the here' after described land, concerning the acquisition by the City of La Porte, of right -of -way for a ten (10) foot wide pedestrian/ bike easement, located in the City of La Porte, Harris County, Texas, said right -of -way being more particularly described on the metes and bounds description, attached hereto as Exhibit "A ", and plat, attached hereto as Exhibit "B ", incorporated by reference herein, and made a part hereof for all purposes, at the fair market value for same, and should said City Attorney, or his designated representative, as the duly authorized representative of the City of La Porte, be unable to agree with such owners as to the fair market value of such pedestrian /bike right -of -way, then, and in that event, said attorney be, and he is hereby authorized and directed to file against all owners and lienholders, proceedings in eminent domain to acquire the above described property, for pedestrian /bike easement right -of -way purposes, and that the proper employees or duly authorized agents and attorneys of the City of La Porte be and they are hereby authorized and directed to perform any and all necessary acts within their respective spheres of official duties toward the final acquisition of the herein described property. Section 2. The City Council officially finds, determines, recites, and declares that a sufficient written notice of the date, hour, place and subject of this meeting of the City Council was posted at a place convenient to the public at the City Hall of the City for the time required by law preceding this meeting, as required by the Open Meetings Law, Chapter 551, Texas Government Code; and that this meeting has been open to the public as required by law at all times during which this resolution and the subject matter thereof has been discussed, considered and formally acted upon. The City Council further ratifies, approves and confirms such written notice and the contents and posting thereof. Section 3. CenterPoint instructed its attorneys to ask the City of La Porte to proceed with its condemnation suit. Accordingly, I will request that the formal condemnation resolution be placed on City Council's agenda for March 28, 2011. The CenterPoint attorney and I agreed to stay in contact, and try to reach agreement on as many of the matters in controversy as possible. Please call me if you have any questions.
