aaf r - <br />ORDINANCE NO. -93 9 6 <br />AN ORDINANCE AMENDING ARTICLE IV "HOTEL OCCUPANCY TAX" OF <br />CHAPTER 66 OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE, <br />REGARDING COLLECTION OF HOTEL AND MOTEL OCCUPANCY TAX; <br />CONTAINING A REPEALING CLAUSE, CONTAINING A SEVERABILITY <br />CLAUSE, FINDING COMPLIANCE WITH THE OPEN MEETING LAW; <br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS <br />ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND <br />UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED FIVE <br />HUNDRED DOLLARS; PROVIDING FOR THE PUBLICATION OF THE <br />CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE: <br />Section 1. Chapter 66 "Taxation', Article IV. "Hotel Occupancy Tax" of the Code of Ordinances is <br />hereby repealed in its entirety and shall hereafter read as follows, to wit: <br />"Sec.66-121. - Definitions <br />The following words, terms and phrases shall, for the purposes of this ordinance and except where the <br />context clearly indicates a different meaning, be defined as follows: <br />City. The City of La Porte, wherein the city government is empowered to impose this tax by Chapter 351 <br />of the Texas Tax Code. <br />Finance Director. The duly appointed Finance Director of the city or his designee. <br />Due date. The last day after the close of the monthly period for which the tax is to be computed. <br />Folio. Primary documentation produced by a hotel that demonstrates interaction between the lodging <br />provider and the occupant, and which, at a minimum, reflects the name and address given by the occupant, the <br />date(s) of occupancy, and the amount of rent charged for each date together with the amounts of applicable tax, <br />and the means of payment. <br />Guest. Any person who, for a consideration, uses, possesses, or has the right to use or possess any guest <br />room in a hotel under any lease, concession, permit, right of access, license, contract, or agreement. <br />Guest room. A room in a hotel occupied, or intended, arranged, or designed for sleeping, and rented for <br />more than two dollars ($2.00) per day. <br />Hotel. Any structure or any portion of a structure, including any hotel, motel, inn, tourist house, tourist <br />court, lodging house, rooming house, or bed and breakfast, containing guest rooms and which is occupied, or is <br />
