Call out building setback lines, Front 50', Rear 40', Sides 30'. 5. Delete filing date of February 2011. 6. Show flood hazard area (if any) and add special plat statement (language attached). 7. Indicate name of owner(s) and other officials in the acknowledgement certificates. 8. Add Owner's acknowledgement Execution on the plat. 9. Add Final Survey Certificate on the plat (language attached). 10. Add lienholder's subordination statement w/notary acknowledgement on the plat. 11. Delete return map agreement certificate from the plat. 12. Indicate the location and size of existing public utilities and all easements either existing or proposed within the plat boundaries or adjacent to the property. 13. Show all public and private easements with widths or recording info. on the plat. 14. Show a survey control monument along street centerline or subdivision comer accurately tied by angle and distance. r 15. FYI Councilman Black brought by a conceptual layout of the Lawler acreage (plus a hand drawn idea to get more building space) and a survey. I am sending these to Tm and Masood. -would like our opinion of the layout re: the PUD zoning effort that was done, building placement etc. -Tim I am sending a full size copy of the survey along with the smaller maps sent to us —Brian S. has an electronic copy of the survey in case you need more large copies. Brian has a good file on this tract also. -It still appears that the city and others have a different opinion as to which part of 8th st. was closed in 1938. It has been repeated as closed on several documents. Doesn't really matter from a practical standpoint except for existing utilities in the supposed row and tract condemned/bought by HCFCD. The potential buyers desire to use this area for building. The issue then becomes policy regarding the conflicting opinions on what was closed and how to appraise it etc. and the underlying utilities. -also, the survey dropped off does not show all the La Porte utility easement that goes thru Lawler tract and North past the RR and eventually to and across SH 146. The conceptual layout would cover this easement and utility lines. -Need to review the conceptual layout and put our thought together on the issues and communicate to them as they are interested in buying the tract. Additional fire hydrants and on -site detention would be required for the property. Based on the above analysis, staff finds the requested change is compatible with the zoning and uses of nearby properties. The tract in question is suitable for the requested change to PUD. Development within the subject tract should not negatively impact the surrounding properties and should not harm the value of nearby properties. It would not have a significant impact on traffic conditions in the area and utilities would not be affected. In reviewing this request the Commission should consider the following points: There was, no apparent error in assigning the present zoning designation to the tract in question.
