SUBJECT TO: Conditional to final execution and. delivery
of a deed to the above described right-of-way, Grantor
hereby requires that any and all improvements constructed'
within this abandoned South llth Street Right -of -Way
fully accommodate, in perpetuity, that portion of the
overall volume of the F216-00-00 detention basin
originally designed within this abandoned porion of the
South llth Street Right -of -Way as illustrated on approved
construction plans for F216-00-00 Linear Detention by
Binkley & Barfield Consulting Engineers (Job No. 108700,
dated 10/13/2068). No mitigation will be allowed in
other areas. of the detention basin without prior approval
of Grantor.
Reservations from and Exception to -Conveyance and Warranty:- This
conveyance is made subject to all and singular the restrictions,
conditions; oil, gas, and other mineral reservations, easements,
and covenants, if any, applicable to and enforceable against the
above described property as reflected by the records.of the county
clerk of the aforesaid county.
Grantor for the consideration and subject to the reservations from
and exceptions to conveyance;conveys to Grantee the property
without express or implied, warranty, and all warranties that might
arise by common law and the warranties in 95.023 of the Texas
Property Code (or its successor) are excluded.
