We have audited the financial statements of the governmental activities, each major fund, and the
aggregate remaining fund information of the City of La Porte, Texas (the "City") as of and for the year
ended September 30, 2011, which collectively comprise the City's basic financial statements and have
issued our report thereon dated March 26, 2012. We conducted our.audit in accordance with auditing
standards generally accepted in the United States of America and the standards applicable to financial
audits contained in Government Auditing Standards, issued by the Comptroller General of the United
States.
Internal Control over Financial Reporting
Management of the City is responsible for establishing and maintaining effective internal control over
financial reporting. In planning and performing our audit, we considered the City's internal control over
financial reporting as a basis for designing our auditing procedures for the purpose of expressing our
opinion on the financial statements, but not for the purpose of expressing an opinion on the effectiveness
of the City's internal control over financial reporting. Accordingly, we do not express an opinion on the
effectiveness of the City's internal control over financial reporting.
A deficiency iir internal control exists when the design or operation of a control does not allow
management or employees, in the normal course of performing their assigned functions, to prevent, or
detect and correct misstatements on a timely basis. A material weakness is a deficiency, or a combination
of deficiencies, in internal control such that there is a reasonable possibility that a material misstatement
of the entity's financial statements will not be prevented, or detected and corrected on a timely basis.
Our consideration of internal control over financial reporting was for the limited purpose described in the
first paragraph of this section and was not designed to identify all deficiencies in internal control over
financial reporting that might be deficiencies, significant deficiencies, or material weaknesses. We did not
identify any deficiencies in internal control over financial reporting that we consider to be material
weaknesses, as defined above.

Compliance and Other Matters
As part of obtaining reasonable assurance about whether the City's financial statements are free of
material misstatement, we performed tests of its compliance with certain provisions of laws, regulations,
contracts, and grant agreements, noncompliance with which could have direct and material effect on the
determination of financial statement amounts. However, providing an opinion on compliance with those
provisions was not an objective of our audit and, accordingly, we do not express such an opinion. The
results of our tests disclosed no instances of noncompliance or other matters that are required to be
reported under Government Auditing Standards.
This report is intended solely for the information and use of the City Council, management, others within
the entity, and other applicable federal awarding agencies and pass -through entities and is not intended to

We have audited City of La Porte's (the "City") compliance with the types of requirements described in
the U.S. Office of Management and Budget (OMB) Circular A-133 Compliance Supplement that could
have a direct and material effect on each of the City's major federal programs for the year ended
September 30, 2011. The City's major federal programs are identified in the summary of auditors' results
section of the accompanying schedule of findings and questioned costs. Compliance with the
requirements of laws, regulations, contracts and grants applicable to each of its major federal programs is
the responsibility of the City's management: Our responsibility is to express an opinion on the City's
compliance based on our audit.
We conducted our audit of compliance in accordance with auditing standards generally accepted in the
United States of America; the standards applicable to financial audits contained in Government Auditing
Standards, issued by the Comptroller General of the United States; and OMB Circular A-133, Audits of
Stater, Local Governments, and Non -Profit Organizations. Those standards and OMB Circular A-133
require that we plan and perform the audit to obtain reasonable assurance about whether noncompliance
with the types of compliance requirements referred to above that could have a direct and materialeffect
on a major federal program occurred. An audit includes examining, on a test basis, evidence about the
City's compliance with those requirements and performing such other procedures as we considered
necessary in the circumstances. We believe that our audit provides a reasonable basis for our opinion. Our
audit does not provide a legal determination of the City's compliance with those requirements.
In our opinion, the City complied, in all material respects, with the compliance requirements referred to
above that could have -a direct and material effect on each of its major federal programs for the year ended

awards is presented for purposes of additional analysis as required by U.S. Office of Management and
Budget Circular A-133, Audits of States, Local Governments, and Non -Profit Organizations, and is not a
required part of the basic financial statements. Such information is the responsibility of management and
was derived from and relates directly to the underlying accounting and other records used to prepare the
financial statements. The information has been subjected to the auditing procedures applied in the audit of
the basic financial statements and certain additional procedures, including comparing and reconciling
such information directly to the underlying accounting and other records used to prepare the financial
statements or to the financial statements themselves, and other additional procedures in accordance with

NOTES TO SCHEDULE OFEXPENDITURES OF FEDERAL AWARDS
Note 1 -Basis of Accounting
The City of La Porte, Texas accounts for federal funding using the modified accrual method of
accounting. This basis of accounting recognizes revenues in the accounting period in which they
become susceptible to accrual, i.e. both measurable and available, and expenditures in the accounting
period in which the liability is incurred, if measurable, except for certain .compensated absences,
claims and judgments, which are recognized when the obligations are expected to be liquidated with
expendable available financial resources. Equipment purchases for grant purposes are treated as
expenses in the schedule of expenditures of federal awards and typically capitalized for financial
statement purposes.
Federal grant funds are considered to be earned to the extent of expenditures made under the provisions of
the grant, and, accordingly, when such funds are received, they are recorded as deferred revenues until
earned. Generally, unused balances are returned to the grantor at the close of specified project periods

activity of the City under programs of the federal government for the year ended September 30, 2011.

Early Notice and Public Review of a Proposed Activity in a 100-Year Floodplain and Wetlands
To: All interested Agencies, Groups and Individuals
This is to give notice that the City of La Porte has conducted an evaluation as required by Executive Order
11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making
Determinations on Floodplain Management, to determine the potential effect that its activity in the floodplain
and wetlands will have on the human environment for the Little Cedar Bayou Drainage project under the
Disaster Recovery Program — DRS210231. The proposed project is to significantly increase the capacity of
the drainage system and reduce flooding for the citizens of La Porte. HUD Community Development Block
Grant (CDGB) Disaster Recovery funds will be used to widen the existing bayou and perform excavation of
the existing drainage channel. Work will include relocating plpelines,�applying concrete paving on side
slopes, constructing concrete low -flow section, installing culverts, constructing an all-weather access road
adjacent to the Bayou, and performing site work associated with the construction. The City will also acquire
rights -of -way and property as needed to accommodate the flood and drainage improvements. The 100-
year floodplain area was based on the Federal Emergency Management Agency (FEMA) Floodplain
Insurance Rate Map (FIRM) Panel number 48201C0945L, revised June 18, 2007. The entire project is
located within a 100-year floodplain zone and floodway. Impacts will include approximately 8.48 acres in
the Little Cedar Bayou floodplainlfloodway. The channel alignment will be adjusted to minimize
curves, which will lower flow velocities in order to reduce erosion and long-term maintenance. Little Cedar
Bayou, a jurisdictional water, contains a National Wetland Inventory (NWI) mapped area listed as palustrine
forested, broad-leaved deciduous and seasonally flooded (PFO1C). The NWI wetland occupies
approximately 0.58 acre within the proposed project area, and approximately 0.46 acre of the NWI area will
be impacted. Of the approximately 0.46 acre of NWI area, a total of approximately 0.02 acre of jurisdictional
wetlands would be impacted by the proposed drainage improvements. The proposed project is located on
the northern portion of Little Cedar Bayou, from West Madison Street to approximately 450 feet south of
West Main (Spencer Highway), for a total of 2,500 feet, in La Porte, Galveston County, Texas.
There are three primary purposes for this notice. First, people who may be affected by activities in
floodplains and those who have an interest in the protection of the natural environment should be given an
opportunity to express their concerns and provide information about these areas. Second, an adequate
public notice program can be an important public educational tool. The dissemination of information about
floodplains can facilitate and enhance Federal efforts to reduce the risks associated with the occupancy
and modification of these special areas. Third, as a matter of fairness, when the Federal government
determines it will participate in actions taking place in floodplains, it must inform those who may be put at
greater or continued risk.
Written comments must be received by the City of La Porte at the following address on or before August 2,
2013 or a minimum of 15 calendar days after the publication, whichever is later: La Porte City Hall, 604 W.

Awesome. This will help greatly.
Regarding questions 1 and 4, these have usually been answered by the engineer in other GLO
projects. We do not have the design files to measure the floodplain impacts, so we can't
answer this one ourselves. As far as the project alternatives, were there any other design
considerations taken before reaching this final design? Examples could be opting for a
closed conduit system versus an open channel system, opting for partial open channel, partial
closed conduit system, using certain channel dimensions vs others because of ROW constraints,
using riprap vs no riprap, considering longer/shorter length of project improvements, etc.
At minimum, we need 3 alternatives to mention: (1) the no -build, (2) the preferred build, and
(3) another (eliminated) build alternative with reasons for elimination. We can provide the
reasoning for not choosing the no -build alternative.

In regards to the cemetery: Assuming all project impacts are limited to the area indicated in
the .dwg file provided B&B, SWCA does not foresee any impacts to the cemetery. However, any
USACE permitting will come with a condition that any unanticipated discoveries are
immediately reported to the respective agencies and that work halt until the issue is
resolved.
Additionally, I think the acreages above should be confirmed by B&B using the data we
provided. SWCA can only assume what will -be impacted by construction using the .dwg file
provided. Impacts for permitting purposes should be any portion of the wetland or bayou that
will be filled or graded as part of the construction process (excluding any temporary fills).

floodplain/wetland notice (eventually, we will also need to submit a FINAL notice, which will
require some more detail) and provide us with the missing information:
This is to give notice that the City of La Porte has conducted an evaluation as required by
Executive Order 11988 and 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C
Procedures for Making Determinations on Floodplain Management, to determine the potential
affect that its activity in the floodplain and wetlands will have on the human environment
for the Little Cedar Bayou Drainage project under the Disaster Recovery Program - DRS210231.
The proposed project is to significantly increase the capacity of the drainage system and
reduce flooding for the citizens of La Porte. HUD Community Development Block Grant (CDGB)
Disaster Recovery funds will be used to widen the existing bayou and perform excavation of
the existing drainage channel. Work will include relocating pipelines, applying concrete
paving on side slopes, constructing concrete low -flow section, installing culverts,
constructing an all-weather access road adjacent to the Bayou, and performing site work
associated with the construction. The City will also acquire rights -of -way and property as
needed to accommodate the flood and drainage improvements. The 100-year floodplain area was
based on the Federal Emergency Management Agency (FEMA) Floodplain Insurance Rate Map (FIRM)
Panel number 48201C0945L, revised June 18, 2007. The entire project is located within a 100-
year floodplain zone and floodway. Impacts include _ acres in the Little Cedar Bayou
floodplain/floodway. The cross-section and profile of the bayou will be restored to its
existing elevations and contours after construction. Little Cedar Bayou, a jurisdictional
water, contains a National Wetland Inventory (NWI) mapped area listed as palustrine forested,
broad-leaved deciduous and seasonally flooded (PFO1C). A total of 0.02 acre of wetlands were
delineated within the project area (SAME SPOT?? - Within the project area there is one
delineated wetland subject to the jurisdiction of the USACE.?). There will be _O.02?_
acre of impacts to the wetland from the drainage improvements. The proposed project is
located on the northern portion of Little Cedar Bayou, from West Madison Street to
approximately 450 feet south of West Main (Spencer Highway), for a total of 2,500 feet, in La
Porte, Galveston County, Texas.
Typically, we put something that indicates how we're minimizing impacts within the
floodplain. The sentence "The cross-section and profile of the bayou will be restored to its
existing elevations and contours after construction." was from another project... (sort of a
placeholder). Obviously doesn't apply here, but can you please provide us instead with a
statement of how impacts would be minimized with this project?
Also, please see below for additional information that hasn't been addressed in the EARLY
notice, but we will still need.

Perez Road Area and Merilyn Place Ditch Drainage Improvements

Along Merilyn Place Ditch, the ground will be disturbed the entire length of the project from Allen Genoa
Road outfalling to Berry Bayou to construct the low -flow section. Activities will include removal of the
existing roadway and soil to place the proposed 2" paving along the roadway intersections, excavation
and compacting soil base for construction of the reinforced concrete low -flow section with concrete
erosion control within 20 feet of the roadway concrete headwall. The proposed low -flow section will be
12' wide, 4' high and closely follow the existing profile of Merilyn Place ditch. Ground disturbance will
also be required for sanitary sewer sleeving and domestic waterline adjustment, which will involve
digging a trench from 4'-8' wide and from 2'-4' deep for adjustment. The trench will be then be
backfilled. Lastly, there will be soil disturbance at the Berry Bayou outfall which will be reconstructed
with rip -rap.

We were planning to make the submittal on the 23rd as scheduled. However, if they have to reject it out -of -hand
because of the performance statement, then perhaps we shouldn't. We have some issues of budget to work out with
the City and there won't be time to adequately address that before the submittal. We have dropped the H Street
portion from the project, but the remainder along 3rd Street is going to be more than the budget and I don't think the
City has any local funds to add to the project.

Hello Deborah,
I spoke with the engineer yesterday about this as well. Additionally, the performance statement lists a
range in the removal and replacement of storm sewer ranging in size from 24 inches - 114 inches.
The 30% design cost estimate includes removing 15 inch or less of storm sewer pipe and the
construction includes an 8 inch PVC storm sewer. We will have to submit a revision to the
performance statement to revise the range as well?
We thought it may be better to wait to submit a revision until further along in design. Is it okay to wait
or is a revision needed now?
The engineer also said the 30% design was accepted. Please forward the correspondence to me as
well.

After reviewing the Performance Statement, it has been recommended that an amendment be
submitted to change the language in the Performance Statement to read: "Construction shall take
place on H Street from State Highway 146 to 6th 3" Street."

I believe the language should be Construction shall take place on H Street from State Highway 146
to &h 3" Street.
The extra "street' was incorrectly added into the site locations list and was not a part of the original
performance statement.
