EMERGENCY ACCESS EASEMENT
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS
That HAWTHORNE AT LA PORTE, LLC, a Delaware limited liability company
("Grantor"), for and in consideration of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable consideration paid by the CITY OF LA PORTE, TEXAS, a Municipal Corporation uk
("Grantee"), the receipt and sufficiency of which are hereby acknowledged and confessed, has this
day GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents does GRANT,
BARGAIN, SELL AND CONVEY unto said Grantee, its successors and assigns, the perpetual
right, privilege, easement and right -of way over and across the following described real property
and premises, situated in Harris County, Texas, to wit:
SEE ATTACHED EXHIBIT "A"
for the purpose of maintaining and using an emergency access gate. Additionally, this easement
is intended as an easement to the City of La Porte, Texas in its governmental capacity, for purposes
of ingress and egress to provide, without limitation, fire and police protection, ambulances and
rescue services and other lawful governmental or private emergency services to the premises,
owners, occupants and invitees thereof across or on the drive isles throughout the property. The
foregoing easement shall in no way be construed as a dedication of any roadways to the public.
Said ingress and egress access point may be through an Emergency Services Access Gate that shall
be locked at all times and shall be accessed by emergency vehicles only, as more specifically
labeled and shown on the attached Exhibit `B".
TO HAVE AND TO HOLD the above described easement, together with all and singular
the rights and appurtances thereto in anywise belonging unto said Grantee, and its successors or
assigns, in accordance with the terms and conditions hereinabove set forth. The Grantor does
hereby bind itself, its successors or assigns to WARRANT AND FOREVER DEFEND, all and
singular the said easement upon the Grantee, and its successors or assigns, against every person
whomsoever lawfully claiming or to claim the same or any part thereof.

Being 20.0001 acres or 871,206 square feet of land situated in the Johnson Hunter Survey, Abstract No.
35, City of La Porte, Harris County, Texas, being all of that certain called 20.0001 acre tract of land,
conveyed to Hawthorne at LaPorte, LLC., by deed recorded under Harris County Clerk's File No. RP-
2018-572510 on December 26, 2018. Said 20.0001 acres or 871,206 square feet of land being more fully
described by metes and bounds as follows:
➢ All bearings referenced herein were obtained from GPS observations and are referenced to
NAD83 horizontal projection zone Texas South Central Zone 4204.
COMMENCING at a 5/8-inch iron rod with plastic cap found for corner, said comer being the southwest
boundary coiner of Garden Walk Townhomes Section One, a subdivision according to the map or plat
thereof recorded under Volume 195, Page 18 of the Map Records of Harris County, Texas, same being
the northwest boundary corner of a called 19.169 acre tract of land, conveyed to Jabez Development, LP,
by deed recorded under Harris County Clerk's File No. RP-2018-572514 on December 26, 2018 and
being a point in the east right-of-way line of State Highway 146, a variable width public right-of-way;
THENCE South 020 32' 46" East, along the west boundary line of said 19.169 acre tract, same being the
east right-of-way line of said State Highway 146, for a distance of 538.53 feet, to a 1/2-inch iron rod
found for corner;
THENCE South 880 57' 25" West, continuing along the west boundary line of said 19.169 acre tract,
same being a right-of-way line of said State Highway 146, for a distance of 16.60 feet, to a 5/8-inch iron
rod found for corner;
THENCE South 03102' 04" East, continuing along the west boundary line of said 19.169 acre tract,
same being the east right-of-way line of said State Highway 146, for a distance of 391.78 feet, to a 5/8-
inch iron rod set for corner, said corner being the southwest boundary corner of said 19.169 acre tract,
same being the northwest boundary comer of said 20.0001 acre tract and being the POINT OF
BEGINNING of the herein described tract of land;
THENCE North 860 55' 55" East, along the south boundary line of said 19.169 acre tract, same being
the north boundary line of said 20.0001 acre tract, for a distance of 859.72 feet, to a 5/8-inch iron rod with
plastic cap set for corner, said corner being located at the southeast boundary corner of said 19.169 acre
tract, same being the northeast boundary corner of said 20.0001 acre tract, and being a point in the west
boundary line of a called 3.399 acre tract of land (Tract IV), conveyed to the City of La Porte, by deed
recorded under Harris County Clerk's File No. K784741 on October 14, 1986;
THENCE South 03' 04' 05" East, along the west boundary line of said 3.399 acre tract, same being the
east boundary line of said 20.0001 acre tract, for a distance of 1,013.01 feet, to a 5/8-inch iron rod found
for corner, said corner being located at the south east boundary comer of said 20.0001 acre tract, same
being the southwest boundary corner of said 3.399 acre tract, and being located in the north boundary line
of that certain called 41.922 acre tract of land (Tract 9), conveyed to 92 Fairmont Lakes, Inc., by deed
recorded under Harris County Clerk's File No. 20110078076 on February 25, 2011;
THENCE South 860 55' 55" West, along the south boundary line of said 20.0001 acre tract, same being
the north boundary line of said 41.922 acre tract, for a distance of 860.31 feet, to a 5/8-inch iron rod with
plastic cap found for corner, said corner being located at the southwest boundary corner of said 20.0001
acre tract, same being the northwest boundary corner of said 41.922 acre tract, and being a point in the
east right-of-way line of said State Highway 146;
THENCE North 03' 02' 04" West, along the west boundary line of said 20.0001 acre tract, same being
