ORDINANCE 2021-3849 <br />AN ORDINANCE AMENDING CHAPTER 94 "FLOODS" OF THE CODE OF <br />ORDINANCES BY ADDING NEW DEFINITIONS AND INCORPORATING UPDATED <br />REGULATIONS RELATED TO FLOOD HAZARDS; PROVIDING A REPEALING <br />CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING COMPLIANCE <br />WITH THE OPEN MEETINGS LAW; PROVIDING THAT ANY PERSON VIOLATING <br />THE TERMS OF THIS ORDINANCE SHALL BE DEEMED GUILTY OF A <br />MISDEMEANOR AND UPON CONVICTION SHALL BE FINED IN A SUM NOT TO <br />EXCEED TWO THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF <br />THE CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF. , <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS: <br />Section 1: That Chapter 94, "Floods", of the La Porte, Texas, Code of Ordinances is hereby <br />amended in its entirety and shall hereinafter read as follows: <br />"Chapter 94- FLOODS <br />ARTICLE I. - IN GENERAL <br />Secs. 94-1-94-30. - Reserved. <br />ARTICLE II. - FLOOD HAZARD REDUCTION <br />DIVISION 1. - GENERALLY <br />Sec. 94-31. - Definitions. <br />Unless specifically defined below, words or phrases used in this chapter shall be interpreted to give <br />them the meaning they have in common usage and to give this ordinance its most reasonable <br />application. <br />Alluvial fan flooding means flooding occurring on the surface of an alluvial fan or similar landform <br />which originates at the apex and is characterized by high -velocity flows; active processes of erosion, <br />sediment transport, and deposition; and unpredictable flow paths. <br />Apex means a point on an alluvial fan or similar landform below which the flow path of the major <br />stream that formed the fan becomes unpredictable and alluvial fan flooding can occur. <br />Appurtenant structure means a structure which is on the same parcel of property as the principal <br />structure to be insured and the use of which is incidental to the use of the principal structure. <br />Area of moderate flood hazard is the land between the limits of the base flood and the 0.2-percent <br />annual -chance (or 500-year) flood. They are shown on flood maps as zones labeled with the letters B <br />or X (shaded). <br />
