AN ORDINANCE RENAMING FAIRMONT PARK WEST PARK, A PUBLIC PARK
DESCRIBED AS A 1.162-ACRE TRACT OF LAND LOCATED AT 9801 RUSTIC GATE,
TO MONARCH PARK, AND AMENDING CHAPTER 50 “PARKS AND RECREATION”
OF THE CODE OF ORDINANCES OF THE CITY OF LA PORTE; PROVIDING A
REPEALING CLAUSE; CONTAINING A SEVERABILITY CLAUSE; FINDING
COMPLIANCE WITH THE OPEN MEETINGS ACT; AND PROVIDING AN
EFFECTIVE DATE HEREOF
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS:
Section 1: The public park known as Fairmont Park West Park, located at 9801 Rustic Gate,
La Porte, Texas, and legally described as indicated below, is hereby renamed and shall hereinafter
be known as Monarch Park:
That certain lot, tract, or parcel of land, known as "Reserve 'A'," containing 1.162
acres, more or less, as shown on the Plat of Section Three (3), FAIRMONT PARK
WEST, as recorded in Volume 270, Page 63, of the Map Records of Harris County,
Texas, reference to which is here made for all purposes.
Section 2: That Chapter 50, “Parks and Recreation,” Article I “In General”, Section 50-2
“Parks and park areas defined”, subparagraph (1) “Parks, neighborhood:”, of the Code of
Ordinances, La Porte, Texas, is hereby amended and shall hereinafter read as follows:
“Sec. 50-2. - Parks and park areas defined.
The parks, park areas, park related facilities, and rental facilities which comprise the City of
La Porte Parks System are listed below and their location within the city established.
(1) Parks, neighborhood:

Section 3: That Chapter 50, “Parks and Recreation,” Article I “In General”, Section 50-18
“Establishing public hours of operation for park use generally”, subparagraph (1) “Parks,
neighborhood:”, of the Code of Ordinances, La Porte, Texas, is hereby amended and shall
hereinafter read as follows:
Sec. 50-18. - Establishing public hours of operation for park use generally.
The City Council for the City of La Porte establishes hours of public operation for all city parks
and park related facilities and rental facilities in the City of La Porte park system. Each park, park
related facility or rental facility in the city park system shall be open to, and be closed to the general
public each day according to the schedule described herein.
The parks, park related facilities, and rental facilities of the City of La Porte Parks System are
classified below and their hours of public operation are as follows, unless written authorization is
given for a special event at the park or facility as provided for in this Ordinance.

Sectio n 4: All ordinances or parts of ord inan ces inconsistent w ith th e terms of this ord inance ar e
hereby repea led ; provided, however, that s uch re peaJ sha ll be o n ly t o the ex tent of s uch
inconsistency and in a ll other respects this o rd inance shall be c umulat ive of other o rdinances
regul a tin g and go verning t he su bj ect m atte r covered by thi s ordinance.
Section 5: Should a ny sectio n o r part of t hi s ord inance be he ld unconstitut io na l, illegal , o r invalid ,
or the appli cation to any person o r circumstance fo r any reasons the reof ineffective or inapplicable,
s uch un cons titutio nality, ill egality, invalid ity , or ineffectiveness of s uc h secti o n o r part shall in no
way affect, impa ir o r in validate the rema ining porti ons thereof; but as to s uch re maining portio n
o r portions, the same shall be and remain in fu ll fo rce and effect and to thi s end the provisions of
this ordinance are d eclared to be severable.
Sect io n 6. The C ity Council o ffi cia ll y finds, det ermines, recites and d eclares that a suffi cient
written notice of the da te , ho ur, p lace and subj ect of thi s meeting of the City Counc il is posted at
a place co nvenient to the p ub lic at the City Ha ll of the c ity for the time required by law p receding
this m eetin g , as required by C ha pter 55 1, Tx. Gov't Cod e; and that thi s meet ing has been op en to
the public as required by law at all times during whi c h t hi s ordinance and the s ubj ect m atter thereof
has been discussed , considered and form a lly act ed u po n. T he City Council fu rther ratifies,
approves and confirms such written not ice and the contents a nd pos ting the reof.
Sectio n 7. This o rd inance shall be effective immediate ly upon passage its passage and approval.
