Madison, 12-13-21 ORDINANCE NO. 2021-3852 AN ORDINANCE ADOPTING AN UPDATE TO THE FUTURE LAND USE MAP COMPONENT OF THE COMPREHENSIVE PLAN OF THE CITY OF LA PORTE, TEXAS UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF LA PORTE, TEXAS; BY CHANGING THE DESIGNTION OF A 0.27-ACRE TRACT OF LAND AT THE NORTHEAST CORNER OF NORTH 1ST STREET AND WEST MADISON STREET AND BEING LEGALLY DESCRIBED AS LOTS 13-16, BLOCK 108, TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, FROM “COMMERCIAL” TO “MID- HIGH DENSITY RESIDENTIAL”; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF WHEREAS, Section 211.004 of the Texas Local Government Code provides that zoning regulations must be adopted in accordance with a Comprehensive Plan; and WHEREAS, Section 213.003 of the Texas Local Government Code provides that a municipality may amend a Comprehensive Plan by ordinance, after public hearing and review by the municipality's planning commission or department; and WHEREAS, Section 213.003 of the Texas Local Government Code also provides that a municipality may establish, in its charter or by ordinance, procedures for adopting and amending a Comprehensive Plan; and WHEREAS, Chapter 106, "Zoning" Article I, Section 106-3, and Article II, Section 106-65 of the Code of Ordinances of the City of La Porte, delegates to the Planning and Zoning Commission the duty to review and make recommendations relevant to modifications of the Comprehensive Plan and Zoning Ordinance; and WHEREAS, the City of La Porte has a Comprehensive Plan, which Plan was adopted by the City Council of the City of La Porte, Texas in 1986, and which Plan has been the subject of multiple amendments since its adoption; WHEREAS, pursuant to mandate of Chapter 106, "Zoning" of the Code of Ordinances of the City of La Porte, the Planning and Zoning Commission of the City of La Porte has reviewed all elements of the Comprehensive Plan, and as duly approved by the City Council of the City of La Porte, to consider possible amendments thereto; and WHEREAS, at the La Porte Planning and Zoning Commission meeting which occurred on October 21, 2021, the La Porte Planning and Zoning Commission reviewed the Future Land Use Map component of the Comprehensive Plan for the purpose of considering proposed amendments thereto, to change the designation for that 0.27-acre tract of land located at the northeast corner of N. 1st St. and W. Madison St., and legally described as follows: Lots 13-16, Block 108, Town of La Porte, Harris County, Texas, from its present designation of “Commercial”, to “Mid-High Density” Residential and at the conclusion of such review the La Porte Planning and Zoning Commission voted to recommend to the La Porte City Council that it approve such amendment to the Future Land Use Plan component of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. A ll o f the facts recited in the prea mble to th is Ordina nce are h e reby found by the Council to be true a nd correct a nd are in corporated h e rei n by this reference. Section 2. T hat an amendment to the Future Land Use Map compo nent o f the Com pre hens ive Plan of the City of La P orte, Texas, w hich is in corpo rate d to th is o rdinance by reference herein and attached hereto a s Exh ibit A, be a n d is hereby a u th o rized, approved , and adopted by the C ity Coun c i I of the C ity of La Po rte , Texas, after duly notic ed pub I ic hearin g he ld at its December 13 , 202 1, meeting, purs ua nt to the recomme ndati ons of the Pl anning and Zon ing Comm issio n o f the City of La Porte, Texas. Section 3. The City Secretary of the Cit y of La Porte o r her des ignated re presentati ve shall be required to make thi s amendment to the Compre hens ive Pl an available to the public and duly mark and note th e updated referen ce on the Future Land Use Plan component of th e Comprehensive Plan o f the C ity of La Po rte , Texas. Section 4. The C ity Co uncil o ffi c ially find s, d ete rmines, recites a nd d ecla res tha t a s ufficie nt w ritte n notice of th e date, hour, place and s ubj ect to thi s meetin g o f the C ity Council was posted at a p lace conveni e nt to the pu bli c at the C ity Hall of the C ity fo r the time req uired by law precedi ng thi s meeting , as req uired by the Open Meetin gs Law, C hapter 551, Texas Governme nt Code; and that this m eetin g has been o pe n to the public as required b y law at all t imes during w h ic h this ordinance a nd the s ubjec t matte r th ereof has been di scussed, considered a nd forma ll y acted upon. The C ity Counc i l furth e r ratifies, a pproves a nd confi rm s such written no ti ce and the contents a nd posting thereof. Section 5. Madison St., and legally described as Lots 13-16, Block 108, Town of La Porte, Harris County, Texas. The request was for approval of a change of the future land use designation from “Commercial” use to “Mid-High Density Residential” use The Commission voted 5-0 to recommend approval of the proposed amendments to the City’s Future Land Use Map.
