Fairmont, 3.38-ac., 12-13-21 ORDINANCE NO. 2021-3850 AN ORDINANCE ADOPTING AN UPDATE TO THE FUTURE LAND USE MAP COMPONENT OF THE COMPREHENSIVE PLAN OF THE CITY OF LA PORTE, TEXAS, UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF LA PORTE, TEXAS, BY CHANGING THE DESIGNTION OF A 3.38-ACRE TRACT OF LAND AT 11007 WEST FAIRMONT PARKWAY AND BEING LEGALLY DESCRIBED AS TRACT 1H, ABSTRACT 625, R. PEARSALL SURVEY, HARRIS COUNTY, TEXAS, FROM “MID-HIGH DENSITY RESIDENTIAL” TO “BUSINESS INDUSTRIAL”; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF WHEREAS, Section 211.004 of the Texas Local Government Code provides that zoning regulations must be adopted in accordance with a Comprehensive Plan; and WHEREAS, Section 213.003 of the Texas Local Government Code provides that a municipality may amend a Comprehensive Plan by ordinance, after public hearing and review by the municipality's planning commission or department; and WHEREAS, Section 213.003 of the Texas Local Government Code also provides that a municipality may establish, in its charter or by ordinance, procedures for adopting and amending a Comprehensive Plan; and WHEREAS, Chapter 106, "Zoning" Article I, Section 106-3, and Article II, Section 106-65 of the Code of Ordinances of the City of La Porte, delegates to the Planning and Zoning Commission the duty to review and make recommendations relevant to modifications of the Comprehensive Plan and Zoning Ordinance; and WHEREAS, the City of La Porte has a Comprehensive Plan, which Plan was adopted by the City Council of the City of La Porte, Texas in 1986, and which Plan has been the subject of multiple amendments since its adoption; WHEREAS, pursuant to mandate of Chapter 106, "Zoning" of the Code of Ordinances of the City of La Porte, the Planning and Zoning Commission of the City of La Porte has reviewed all elements of the Comprehensive Plan, and as duly approved by the City Council of the City of La Porte, to consider possible amendments thereto; and WHEREAS, at the La Porte Planning and Zoning Commission meeting which occurred on October 21, 2021, the La Porte Planning and Zoning Commission reviewed the Future Land Use Map component of the Comprehensive Plan for the purpose of considering proposed amendments thereto, to change the designation for that 3.38-acre tract of land located at 11007 W. Fairmont Pkwy., and being legally described as Tract 1H, Abstract 625, R. Pearsall Survey, Harris County, Texas, from its present designation of “Mid-High Density Residential” to Business Industrial”, and at the conclusion of such review the La Porte Planning and Zoning Commission voted to recommend to the La Porte City Council that it approve such amendment to the Future Land Use Plan component of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT: Sectjop 1. All of the fac ts re cited in the preamble to the Ordin ance are here by found by the C ity Council to be true a nd correct and are incorporated herein by thi s refere nce. Section 2. That an amendment to th e Future Land Use Map component of the Co mprehen s ive Pl a n of th e C ity of La Po rte, Texas, whi ch is inco rporated to thi s ordi nance by refe rence here in and attached hereto as Ex hibit A, be and is he reby authorized , approved, and adopted by the C ity Council of the City of La Porte, Texas, after duly no ticed public hea rin g he ld at its Dece mber 13, 202 1, mee tin g, pursuant to the reco mm e nd ations of the Planning and Zonin g Commi ssion of the C ity of La Po rt e, Tex as. Section 3. T he C ity Secretary of the City of La Po rte o r her designated representati ve shall be req uired to make this ame ndm ent to th e Co mpreh ensive Plan avail ab le to the public and duly mark and note the updated reference o n the Fu ture Land Use Plan component of the Com prehensive Pl an of the Ci ty of La Porte, Texas. Section 4. The C ity Counc il officiall y find s, determin es, recites and dec lares that a suffi cient written notice of the date, hour, pl ace a nd subject to this meeting of the City Council was posted at a place conveni ent to th e public at th e C ity Ha ll of the C ity for the time required by law preced ing thi s meet in g, as requ ired by the Open Meetings Law , C hapter 55 l , Texas Government Code; and that th is meeti ng has be en open to the public as required by law at a ll tim es during wh ich thi s o rdinan ce and the subj ect matter thereof ha s been di sc ussed, considered and formally ac ted up on. The City Council furth er ratifies, ap pro ves and confirms s uch written notice and the co ntents and po st in g thereof. Section 5. Fairmont Pkwy.; legally described as Tract 1H, Abstract 625, R. Pearsall Survey, Harris County, Texas. The request was for approval of a change of the future land use designation from “Mid-High Density Residential” to “Business Industrial” use. The Commission voted 5-0 to recommend approval of the proposed amendments to the City’s Future Land Use Map.
