<br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA
<br />PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING
<br />ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING SPECIAL CONDITIONAL
<br />USE PERMIT NO. 22-91000001, TO ALLOW FOR A SECONDARY DWELLING UNIT
<br />IN THE LOW DENSITY RESIDENTIAL (R-1) ZONING DISTRICT, ON A 0.53-ACRE
<br />TRACT OF LAND LOCATED AT 9305 CARLOW LANE, AND BEING LEGALLY
<br />DESCRIBED AS LOTS 67 & 68, BLOCK 4, SPENWICK PLACE SECTION 1, HARRIS
<br />COUNTY, TEXAS; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE
<br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
<br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
<br />ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND
<br />UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO
<br />THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF THE
<br />CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF;
<br />WHEREAS, the City is authorized by Chapter 211 of the Texas Local Government Code to
<br />promulgate rules and regulations governing regulation of land use, structures, businesses, and
<br />related activities, and that such rules and regulations as adopted by the City promote the safe,
<br />orderly, and healthful development of the City; and
<br />WHEREAS, on January 20, 2022, the La Porte Planning and Zoning Commission conducted a
<br />public hearing regarding a request to grant Special Conditional Use Permit No. 22-91000001 to
<br />allow for a secondary dwelling unit in the Low Density Residential (R-1) zoning district, on a
<br />0.53-acre tract of land located at 9305 Carlow Lane, and being legally described as Lots 67 &
<br />68, Block 4, Spenwick Place Section 1, Harris County, Texas, following lawful publication of
<br />the notice of said public hearing; and
<br />WHEREAS, on January 20, 2022, after considering the public testimony received at such
<br />hearing, if any, the Planning and Zoning Commission recommended that the request to grant
<br />Special Conditional Use Permit No. 22-91000001 to allow for a secondary dwelling unit in the
<br />Low Density Residential (R-1) zoning district, on a 0.53-acre tract of land located at 9305 Carlow
<br />Lane, and being legally described as Lots 67 & 68, Block 4, Spenwick Place Section 1, Harris
<br />County, Texas, be approved; and
<br />WHEREAS, on February 28, 2022, the City Council of the City of La Porte conducted a public
<br />hearing regarding a request to grant Special Conditional Use Permit No. 22-91000001 to allow
<br />for a secondary dwelling unit in the Low Density Residential (R-1) zoning district, on a 0.53-
<br />acre tract of land located at 9305 Carlow Lane, and being legally described as Lots 67 & 68,
<br />Block 4, Spenwick Place Section 1, Harris County; and
<br />WHEREAS, each and every applicable requirement set forth in Chapter 211, Subchapter A,
<br />Texas Local Government Code and the Code of Ordinance of the City of La Porte, Texas,
<br />concerning public notices, hearings and other procedural matters have been fully met; and
<br />WHEREAS, the City Council desires that the request to Special Conditional Use Permit No. 22-
<br />91000001 to allow for a secondary dwelling unit in the Low Density Residential (R-1) zoning
<br />district, on a 0.53-acre tract of land located at 9305 Carlow Lane, and being legally described as
<br />Lots 67 & 68, Block 4, Spenwick Place Section 1, Harris County, Texas be approved;
