<br />AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA
<br />PORTE, CHAPTER 106, MORE COMMONLY REFERRED TO AS THE ZONING
<br />ORDINANCE OF THE CITY OF LA PORTE, BY GRANTING SPECIAL CONDITIONAL
<br />USE PERMIT NO. 22-910000029 TO ALLOW FOR MERCHANT WHOLESALER USES
<br />IN THE BUSINESS INDUSTRIAL (BI) ZONING DISTRICT, ON AN 8.4-ACRE TRACT
<br />OF LAND LOCATED AT THE 2200 BLOCK OF W. FAIRMONT PARKWAY, AND
<br />BEING LEGALLY DESCRIBED AS 8.4 ACRES OUT OF TRACTS 2A, 3, 4, 4A, & TRACT
<br />23D BAYPORT, SECTION 1, ABSTRACT 625, R PEARSALL SURVEY, HARRIS
<br />COUNTY, TEXAS; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE
<br />SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW;
<br />PROVIDING THAT ANY PERSON VIOLATING THE TERMS OF THIS
<br />ORDINANCE SHALL BE DEEMED GUILTY OF A MISDEMEANOR AND
<br />UPON CONVICTION SHALL BE FINED IN A SUM NOT TO EXCEED TWO
<br />THOUSAND DOLLARS; PROVIDING FOR THE PUBLICATION OF THE
<br />CAPTION HEREOF; AND PROVIDING AN EFFECTIVE DATE HEREOF
<br />WHEREAS, the City is authorized by Chapter 211 of the Texas Local Government Code to
<br />promulgate rules and regulations governing regulation of land use, structures, businesses, and
<br />related activities, and that such rules and regulations as adopted by the City promote the safe,
<br />orderly, and healthful development of the City; and
<br />WHEREAS, on February 17, 2022, the La Porte Planning and Zoning Commission conducted
<br />a public hearing regarding a request to grant Special Conditional Use Permit No. 22-91000002
<br />to allow for merchant wholesaler uses in the Business Industrial (BI) zoning district on an 8.4-
<br />acre tract of land located at the 2200 Block of W. Fairmont Pkwy, and being legally described
<br />as 8.4 acres out of Tracts 2A, 3, 4, 4A, & Tract 23D Bayport, Section 1, Abstract 625, R Pearsall
<br />Survey, Harris County, Texas, following lawful publication of the notice of said public hearing;
<br />and
<br />WHEREAS, on February 17, 2022, after considering the public testimony received at such
<br />hearing, if any, the Planning and Zoning Commission recommended that the request to grant
<br />Special Conditional Use Permit No. 22-91000002 to allow for merchant wholesaler uses in the
<br />Business Industrial (BI) zoning district on an 8.4-acre tract of land located at the 2200 Block of
<br />W. Fairmont Pkwy, and being legally described as 8.4 acres out of Tracts 2A, 3, 4, 4A, & Tract
<br />23D Bayport, Section 1, Abstract 625, R PearsalI Survey, Harris County, Texas, be approved;
<br />and
<br />WHEREAS, on March 28, 2022, the City Council of the City of La Porte conducted a public
<br />hearing regarding a request to grant Special Conditional Use Permit No. 22-91000002 to allow
<br />for merchant wholesaler uses in the Business Industrial (BI) zoning district on an 8.4-acre tract
<br />of land located at the 2200 Block of W. Fairmont Pkwy, and being legally described as 8.4 acres
<br />out of Tracts 2A, 3, 4, 4A, & Tract 23D Bayport, Section 1, Abstract 625, R Pearsall Survey,
<br />Harris County; and
<br />WHEREAS, each and every applicable requirement set forth in Chapter 211, Subchapter A,
<br />Texas Local Government Code and the Code of Ordinance of the City of LaPorte, Texas,
<br />concerning public notices, hearings and other procedural matters have been fully met; and
