WHEREAS, the City of La Porte foreclosed on a property ("the property") through a delinquent
tax lawsuit and judgment identified as follows:
LOTS I THROUGH 7, BLOCK 413, LA PORTE, HARRIS COUNTY, TEXAS AS
SHOWN ON THE MAPS OR PLATS RECORDED IN THE REAL PROPERTY
RECORDS OF HARRIS COUNTY, TEXAS AND BEING THAT ACCOUNT
SHOWN IN THE MAPS AND RECORDS OF THE HARRIS COUNTY
APPRAISAL DISTRICT UNDER ACCOUNT NUMBER 024-047-013-0001
WHEREAS, the City of La Porte remains unpaid after exhausting all legal means to satisfy the
collection of the delinquent taxes due and owing to the City of La Porte, including conducting a
public auction of the property by the Harris County Sheriff whereby the property was struck off to
the City of La Porte and;
WHEREAS, being no bids for the property at the tax sale on November 7, 1923, the City of La
Porte now holds the property in trust to secure the payment of taxes, penalties, interest and costs
owed to the City of La Porte;
WHEREAS, the property held in trust by the City of La Porte is exempt from taxation and it is in
the best interest of the City of La Porte to have the property returned to the active tax roll as a
taxable property;
WHEREAS, the City of La Porte has received an offer of $20,000.00 to purchase the property
from Gus Brieden.
NOW, THEREFORE, IT IS ORDERED by the City of La Porte:
I . That all of the above paragraphs are true, correct and in the best interest of the City of La
Porte and as such they are hereby incorporated in full and made a part of this Resolution;
2. That the City of La Porte accepts the tax resale offer by Gus Brieden and authorizes the
City Manager of the City of La Porte to sign and execute the deed on behalf of the City of
La Porte to transfer title to the person submitting the offer to purchase the property.

and through its duly authorized official. ("GRANTOR"} as authorized by Section 34.05, Texas
Property Tax Code, for and. in consideration of the sum of TEN DOLLARS AND 00/100
($10.00) AND, OTHER GOOD AND VALUABLE CONSIDERATION, in hand paid by GUS
BRIEDEN ("GRANTEE") the receipt of which is hereby acknowledged and confessed, has
conveyed and quitclaimed and by these presents do convey and quitclaim unto said grantee all
rights,: title and interest. of the CITY OF LA PORTE, FOR THE USE AND BENEFIT OF
ITSELF AND ALL OTHER TAXING UNITS THAT ESTABLISHED TAX LIENS IN CAUSE
NO.104781, in the property herein conveyed, acquired by tax foreclosure sale heretofore held, in
Cause No. 104.781, CITY OF LA PORTS vs. CS. PENFIELD, ETAL, said property being
described as:
LOTS 1 THROUGH 7, BLOCK'413, LA PORTS, HARRIS COUNTY, TEXAS AS SHOWN ON THE
MAPS OR PLATS RECORDED.IN'THE UAL PROPERTYRECORDS OF HARRIS COUNTY,
TEXAS AND BEING THAT ACCOUNT SHOWN IN THE.MAPS AND RECORDS OF THE HARRIS
COUNTY APPRAISAL DISTRICT UNDER ACCOUNT.NUMBER.424-047-013-0001.
This conveyance is made and accepted subject to the following matters to the. extent that
the same are in effect at this time: any and all rights of redemption, restrictions, covenants,
conditions, easements, encumbrances and outstanding mineral interests, if any, relating to the
hereinabove described property, but only to the extent they are still in effect, shown of record in
the hereinabove mentioned County and State, and to all zoning"laws, regulations and ordinances
of municipal and/or other governmental authorities, if any but only to the extent that they are still
in effect, relating to .the hereinabove described -property.
TO HAVE AND TO. HOLD said premises, together with all. and singular the rights,
privileges and appurtenances thereto in any manner belonging unto the said GUS BRIEDEN ,
his heirs and assigns forever, so that neither the CITY OF LA PORTE, FOR THE USE AND
BENEFIT OF ITS AND ALL OTHER TAXING UNITS THAT ESTABLISHED TAX
LIENS: IN CAUSE NO.104781 and any person claiming under it shall at any time hereafter
have, claim or demand any right or title to the aforesaid premises or appurtenances, or any part
thereof.
Grantee accept the property in "AS IS" condition, subject to any environmental
conditions that.m ght have or still exist on said property and subject to the rights of any parties in
possession of the property.
Post judgment taxes and taxes for the current year are assumed by Grantee.
