HomeMy WebLinkAboutOrd. 2022-3878 FLUP for 20.8 ac.Broadway & K, 4-25-22ORDINANCE NO. 2022-3878 AN ORDINANCE ADOPTING AN UPDATE TO THE FUTURE LAND USE MAP COMPONENT OF THE COMPREHENSIVE PLAN OF TH E CITY OF LA PORTE, TEXAS UPON RECOMMENDATION OF THE PLANNING AND ZONING COMMISSION OF THE CITY OF LA PORTE, TEXAS; BY C HANGING THE DESI GNATION OF A 20.8-ACRE TRACT OF LAND LOCATED EAST OF S. BROADWAY ST. AND SOUTH OF K ST. AND BEING LEGALLY DESCRIBED AS LOTS 7-12, BLOCK 14; LOTS 1-12, BLOCK 15; LOTS 1-16, BLOCK 18 ; & LOTS 1-14, BLOCK 19, SYLVAN BEACH; LOTS 1-6, BLOCK 1, SYLVAN BEACH REPLAT; LOTS 25-35, BLOCK 1114 ; LOTS 1-31 & 45-48, BLOCK 1118; & LOTS 1-43, BLOCK 1161 TOWN OF LA PORTE, HARRIS COUNTY, TEXAS, FROM "MID-HI GH DENSITY RESIDENTIAL" TO "LOW DENSITY RESIDENTIAL"; MAKING CERTAIN FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF WHEREAS, Section 2 11.004 of the T exas Local Government Code provides th at zoni ng regulations must be adopted in accordance with a Compre he nsive Plan; and WHEREAS, Section 2 I 3.003 of the Texas Local Government Code provides that a muni c ipa l ity may amend a Comprehensive Plan by ordinance, afte r public hearin g and review by the municipality's planning commission o r department; and WHEREAS, Secti on 213.003 of the Texas Local Government Code also provides that a municipality may establis h , in its charter o r by ordinance, procedures fo r adopting and amending a Comprehensive Plan; and WHEREAS, C hapte r l 06, "Zoning" Article I, Secti on I 06-3 , and Artic le 11 , Section I 06-65 of the Code o f Ordinances of the City o f La Po1te, delegates to the Planning a nd Zoning Commission the duty to rev iew a nd make recommendatio ns relevant to modifications of the Comprehensive Plan and Zoning Ordinance; and WHEREAS, the City o f La Porte has a Comprehensiv e P lan, which Plan was adopted by the City Council of the City of La Po rte, Texas in I 986, and which Plan has been the s ubj ect of multiple amendments since its adoption; WHEREAS, pursuant to mandate of C hapte r 106, "Zonin g" of the Code of Ordinances of the City of La Porte, the Planning and Zoning Commission of the City of La Porte has rev iewed all e lements of the Comprehensive Plan, and as duly approved by the C ity Council of the C ity of La Porte, to consider possible amendments thereto; and WHEREAS, at the La P orte Planning and Zonin g Commission meeting w hich occurred on March I 7 , 2022, the La Porte Plannin g and Zoning Commission reviewed the Future Land Use Map compo nent of the Comprehensive Plan for the purpose of considering proposed amendments thereto, to change the designatio n for that 20.8-acre tract of land located east of S. Broadway St. and south of K St., and legall y d escribed as fol lows: Lots 7-12, B lock 14; Lots 1-1 2, Block 15; Lots 1-16, Block 18; & Lots 1-14, Block 19, Sylvan Beach; Lots 1-6, Block I , Sylvan Beach R eplat; Lots 25-35, Block 11 14 ; Lo ts 1-31 & 45-48, Block I I 18 ; & Lots 1-43, Block 1 16 1 Town o f La Porte, Harris County, Texas, from its present designation of "Mid-Hi gh Density Residential" to "Low Density Reside ntial ", and at the conclusion of such review the La Porte Planning and Zoning Commission voted to recomm end to the La Po1te C ity Council that it approve s uch amendment to the Future Land Use Plan component of the Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA PORTE, TEXAS, THAT: Section 1. All of the facts recited in the preamble to this Ordinance are h ereby found by the Counc il to be true and correct and are incorporated herein by this reference Section 2. That an amendment to the Future Land U se Map component of the Comprehensive Plan of the City of La Porte, Texas, which is in co rpo rated to this o rdinance by reference herein and attached hereto as Exhibit A, be and is hereby authorized, approved, a nd adopted by the City Council of the City of La Porte, Texas, after duly noticed public hearing held at its April 25 , 2022, meeting, pursuant to the recommendations o f the Planning a nd Zoning Commissio n of the C ity of La Porte, Texas. Section 3. The City Secretary of the City of La Porte or her des ig nated representative shall be required to make this amendment to the Comprehensive Pla n available to the public and duly mark and note the updated reference on the Future Land Use Plan component of the Compre hens ive Plan of the City o f La Porte, Texas. Section 4. The C ity Council officially finds, determines, recites and d eclares that a sufficient written notice of the date, hour, place and subj ect to this meeting of the C ity Council was posted at a place convenie nt to th e public at the City Hall of the C ity for the time required by law preceding thi s meeting, as required by the Open Meetings Law, Chapter 551 , T exas Government Code; and that th is meeting has been open to the public as required by law a t a ll times during which this ordinance and the s ubj ect matter thereof has been discussed, considered and fo rmally acted upon. The C ity Council further ratifies, approves and confirm s such written notice and the contents and posting thereof. Section 5. Th is o rdinance s hal l be in effect from and after its passage and approval. PASSED AND APPROVED this, the 25th day of APRIL, 2022.
