AN ORDINANCE AMENDING CHAPTER 106 "ZONING" OF THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE, BY CHANGING THE ZONING
CLASSIFICATION OF A 20.8-ACRE TRACT OF LAND LOCATED EAST OF SOUTH
BROADWAY STREET AND SOUTH OF K STREET; AND LEGALLY DESCRIBED AS
LOTS 7-12, BLOCK 14; LOTS 1-12, BLOCK 15; LOTS 1-16, BLOCK 18; & LOTS 1-14,
BLOCK 19, SYLVAN BEACH; LOTS 1-6, BLOCK 1, SYLVAN BEACH REPLAT; LOTS
25-35, BLOCK 1114; LOTS 1-31 & 45-48, BLOCK 1118; & LOTS 1-43, BLOCK 1161
TOWN OF LA PORTE , HARRIS COUNTY, TEXAS, FROM HIGH DENSITY
RESIDENTIAL (R-3) TO LOW DENSITY RESIDENTIAL (R-1); MAKING CERTAIN
FINDINGS OF FACT RELATED TO THE SUBJECT; FINDING COMPLIANCE WITH
THE OPEN MEETINGS LAW; AND PROVIDING AN EFFECTIVE DATE HEREOF
WHEREAS, the City is authorized by C hapter 211 of th e Texas Local Government Code to
promulgate rules and regulations governin g regulation of land use, structures, bus inesses, and
related activities, and that s uch rules and regulatio ns as adopted by the City promote the safe,
orderly, and healthful development of the C ity; and
WHEREAS, on March 17, 2022, the La Porte Planning and Zoning Commission conducted a
public hearing regarding a request to rezone a 20.8-acre tract of land located east of S.
Broadway St. and south ofK St. and legall y descri bed as Lots 7-12, B lock 14; Lots 1-12, Block
15; Lots 1-16, Block 18; & Lots 1-14, Block 19, Sylvan Beach; Lots 1-6, Block 1, Sylvan
Beach Replat; Lots 25-35, Block 1114; Lots 1-31 & 45-48, Block 1118; & Lots 1-43, Block
1161 Town of La Porte, Harris County, T exas, from High Density Residential (R-3) to Low
Density R esidential (R-1 ), following lawful publication of the n otice of said public hearing;
and
WHEREAS, on March 17, 2022, after cons ideri ng the public testimony received at such
hearing, if any, the Planning and Zoning Commission recommended that the request to rezone
a 20.8-acre tract of land located east of S . Broadway St. and south of K St. and legall y
descri bed as Lots 7-12, Block 14; Lots 1-12, Block 15 ; Lots 1-16, Block 18 ; & Lots 1-14,
Block 19, Sylvan Beach; Lots 1-6, Block 1, Sylvan Beach Replat; Lots 25-35, Block 1114;
Lots 1-31 & 45-48, Block 1118; & Lots 1-43 , Block 1161 Town of La Porte, Harris County,
Texas, from High Density Residential (R-3) to Low Density Residential (R-1) be approved;
and
WHEREAS, on April 25, 2022, t he C ity Council of the City of La Porte conducted a public
hearing regarding a request to rezone a 20.8-acre tract of land located east of S. Broadway St.
and south ofK St. and le gally d escri bed as Lots 7-12, Block 14 ; Lots 1-12, Block 15 ; Lots 1-
16, Block 18 ; & Lots 1-14, Block 19, Sylvan Beach; Lots 1-6, Block 1, Sylvan Beach Replat;
Lots 25-35, Block 1114; Lots 1-31 & 45-48, Block 1118; & Lots 1-43, Block 1161 Town of
La Porte, Harris County, Texas, from High Dens ity Res idential (R-3) to Low D en sity
Res idential (R-1); and
WHEREAS , each and every applicable requirement set forth in Chapter 211 , Subchapter A,
Texas Local Government Code and the Code of Ordinance of the City of La Porte, Texas,
concerning public notices, hearings and other procedural matters have been fully met; and
WHEREAS, the City Council desires that the request to rezone a 20.8-acre tract of land
located east of S. Broadway St. and south ofK St. and legally described as Lots 7-12 , Block
14; Lots 1-1 2, Block 15; L ots 1-16, Bl ock 18; & Lots 1-14 , Block 19, Sylvan Beach; Lots 1-
6 , Block I, Sylvan Beach Replat; Lots 25 -35, Block 1114; Lots 1-3 1 & 45-48 , Block 11 I 8; &
Lots 1-43, Block 1161 Town of La Porte, Harri s County, Texas, from High Density Residential
(R-3) to Low Density Residential (R-1) be approved;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
LA PORTE, TEXAS:
Section 1. All of the fac ts recited in the preamble to thi s Ordinance are hereby fo und by the City
Council to be true and correct and a re incorporated herein by this reference.
Section 2. Chapter 106 "Zoning" of the Code of Ordinances is hereby amended by changing the
zoning classification of the following described property, to wit: a 20.8-acre tract of
land located east of S. Broadway St. and south of K St. and legally described as Lot s
7-12, Block 14; Lots 1-12, Block 15; Lots 1-16, Block 18 ; & Lots 1-14, Block 19,
Sylvan Beach; Lots 1-6, Block 1, Sylvan Beach Replat; Lots 25-35, Block 1114; Lots
1-31 &45-48,Block l I 18 ;&Lots 1-43,Block 1161 TownofLaPorte,HarrisCounty,
Texas, from High De nsity Residential (R-3) to Low Den sity Residential (R-1).
Section 3. A ll ordinances or parts of ordinances i nconsistent with the terms of this ordinance are
hereby repealed; provided, however, that such repeal shall be o nl y to the extent of such
inconsistency and in all other respects this ordinance shall be cumulati ve of other
ordinances regulating and governin g the subject matter covered by this ordinance.
Section 4. Should any section or part of this ordinance be held unconstitutional, illegal, or inval id,
o r the application to any person or c ircu mstance for any reasons thereof in effective or
inappli cable, such unco nstitutionali ty , illega lit y, in validity, or ineffectiveness of such
secti o n or part shall in no way affect, impa ir or invalidate the remaining portions
thereof; but as to such remaining portion or portions, the same shall be and re main in
full force and effect and to this end the provisions of this ordinance are declared to be
severable.
Section S. The City Coun cil officially finds, determines, recites and declares that a sufficient
writte n notice of the date, hour, place and subj ect of this meeting of the City Coun cil
is posted at a place convenient to the public at the City Hall of the c ity for the time
required by law preceding thi s meeting, as required by Chapter 551 , TX. Gov't Code;
and that this meeting has been open to the public as required by law a t a ll times during
which this ordinance and the subj ect matter thereof has been discussed, considered and
forma ll y acted upon. The City Council fi.uther ratifies, approves and confirms such
writte n notice and the contents and posting thereof.
Section 6. T he Ci ty Council of the City of La Porte hereby finds t hat publi c notice was properly
mailed to a ll owners of all properties located within two hundred feet (200 ') of th e
properties under co nsideratio n in compl iance with code provisions.
Section 7. It is directed that the Official Zonj ng Map of the City of La Porte, Texas be changed
to reflect the zoning classification established by this o rdinance
S ection 8 . T he C ity Council of the City of La Porte hereby finds, determines, and declares t hat all
prerequisites of law have been satisfied and hereby determines and declares that the
amend ments to the City of La Porte Zoning Map and Classificat ion contained in this
ordinance as amendments thereto are desirable a nd in furtherance of the goals and
objectives sta ted in the City of La Porte 's Comprehensive P lan.
S ection 9. This ordinance s ha ll be effective after its passage a nd approval.
