The purpose of the inspection was to identify and collect samples of suspect asbestos containing material(s) from accessible areas within the fixed structures on the site that may be disturbed as a result of renovation activities. The results of this investigation are contained in the attached report. This Asbestos Inspection was limited to two suspect materials (three samples each) from areas which are expected to be disturbed as a result of renovation activities on the premises. A limited number of random samples of the materials were collected and analyzed by an accredited I laboratory. None of the sample groups tested positive for the presence of asbestos. The laboratory results are consistent with the likelihood of the presence of asbestos for buildings of this age and type of construction MAY 0 8 ?iw, k1specUons Division ltY Of la Porte 07-II93 Asbestos Inspection Reim Cammereial property 115 West Main St a .LaPwc. Unless specifically set forth in this Report, Live Oak Environmental Consultants has made no in dependent investigation as to the accuracy or completeness of the information obtained from secondary sources, the laboratory, or personal interviews, and has assumed such information to be accurate and complete. Asbestos containing building materials were (and to some extent still are) used in over 3000 pri ducts. Attempts to locate and identify "all" asbestos in a building is both impractical and cost prohibitive. The most cost effective strategy is to initially collect a limited number of the most li Iely sources of asbestos based on homogeneous areas, (similar colors, types of materials, textures, etc.) and investigate further only if the presence of asbestos is confirmed. The asbestos inspection described herein is limited to the areas and topics cited and is not intended to address all concerns and problems not specifically within the scope of this inspection. The findings, conclusions, and recommendations set forth in this Report are based onlavailable data, findings and circumstances as they existed when this Report was prepared This inspection represents all significant sources of asbestos containing material on the property that could be directly observed, taking into account the condition and accessibility of the subject I building. Therefore, changes in any material.fact or undiscovered circumstances may similarly affect the findings, conclusions, and recommendations outlined in this Report. Texas Department of to Health Services (DSHS) regulations require an asbestos inspection prior to the issuance of a Iding permit and commencement of any renovation/demolition activities within a public Iding. Further, the DSHS regulations also require the filing of a 10 working day notice prior commencement of asbestos abatement or demolition activities. The subject property sisted of a one story structure which was in the process of being converted to an icehouse. suspect materials in the areas expected to be disturbed as a result of renovation activities of two types of texture and wall joint compound. Sample locations were chosen at the convenience of the inspector, where I ad cessible and from damaged areas (if present) based on the condition at the time of the Inspection. The samples were analyzed for asbestos using Polarized Light Microscopy by an EPA approved NVLAP laboratory utilizing EPA Method 600/R-93/116, or 40 CFR, Part 763, Subpart F, as appropriate. A limited number of random samples of the materials were collected and analyzed by an accredited laboratory. None of the sample groups tested positive for the presence of asbestos. The laboratory results are consistent with the likelihood of the presence of asbestos for buildings of this age and type of construction. a MAY 3 (n8ectt ?14 ity of as of vision 07-1193 Asbestos Inspection RPM Cnmmaaal popaq I13 Wan Mao Shea, LaPorte• Texan MAY 0 8 2014 Imeections Division City of la Porte Limitations of Assessment: The findings and scope of this Limited Phase II Asbestos Inspection are limited to the items and i areas expressly covered. This Report is prepared for the sole benefit of the involved principals and may not be relied upon by any other person(s) or entity without prior written authorization of all principals. Live Oak Environmental Consultants has used information obtained from secondary sources; personal interviews; laboratory analysis; and a physical inspection by Live Oak personnel. Unless specifically set forth in this Report, Live Oak Environmental Consultants has made no independent investigation as to the accuracy or completeness of the information obtained from secondary sources, the laboratory, or personal interviews, and has assumed such information to be accurate and complete. Asbestos containing building materials were (and to some extent still are) used in over 3000 products. Attempts to locate and identify "all" asbestos in a building is both impractical and cost prohibitive. The most cost effective strategy is to initially collect a limited number of the most likely sources of asbestos based on homogeneous areas, (similar colors, types of materials, textures, etc.) and investigate further only if the presence of asbestos is confirmed. The asbestos inspection described herein is limited to the areas and topics cited and is not intended to address all concerns and problems not specifically within the scope of this inspection. The findings, conclusions, and recommendations set forth in this Report are based on available data, findings and circumstances as they existed when this Report was prepared This inspection represents all significant sources of asbestos containing material on the property that could be directly observed, taking into account the condition and accessibility of the subject building. Therefore, changes in any material fact or undiscovered circumstances may similarly affect the findings, conclusions, and recommendations outlined in this Report. Texas Department of State Health Services (DSHS) regulations require an asbestos inspection prior to the issuance of a ?uilding permit and commencement of any renovation/demolition activities within a public building. Further, the DSHS regulations also require the filing of a 10 working day notice prior to commencement of asbestos abatement or demolition activities. The subject property consisted of a one story structure which was in the process of being converted to an icehouse. The suspect materials in the areas expected to be disturbed as a result of renovation activities consisted of two types of texture and wall joint compound. I. I' The bulk samples were collected at random in quantities sufficient in the opinion of the inspector to determine presence of asbestos, if any, in each suspecf.material from the identified Homogeneous areas. Sample locations were chosen at the convenience of the inspector, where accessible and from damaged areas (if present) based on the condition at the time of the inspection. The samples were analyzed for asbestos using Polarized Light Microscopy by an EPA approved NVLAP laboratory utilizing EPA Method 600/R-93/116, or 40 CFR, Part 763, Subpart F, as appropriate. Three samples of each suspect material were collected. Main Street (Review of Submittal #1) Dear Mr. Manning: The City of La Porte received your application for a minor development site plan and conducted our initial review of the documentation submitted. This letter includes all comments and questions related to your plan submittal by the various city agencies. Planning: (Eric Ensey, City Planner, 281-470-5063, enseve(Wanortety.gov) 1. The proposed site plan indicates that landscaping is not required in the Main Street District per Section 106-443, Table B. This section does not exclude landscaping from projects in the Main Street District, it only states that no overall percentage of landscaping is required in the district. Landscaping is still required in the Main Street District. The site plan will need to be revised to include landscaping. Although staff recognizes that full compliance with the city's landscaping ordinance is impractical, landscaping will still need to be provided. Your proposed landscaping will need to be approved by the Director of Planning and Development. At a minimum, the landscape strip along N. First Avenue should include street trees and shrubs and the two trees along Main Street should be replaced with quality street trees. If there is a species of tree that might fit the theme of the restaurant, such as a queen palm possibly, staff is willing to consider it. 2. The site plan indicates that the property owner is "Jason Leopard". Because the application is for Ms. Kelli Grabbe's proposed restaurant, a letter or email will need to be provided from the property owner authorizing this application. 3. The proposed dumpster enclose is shown as being constructed during Phase 2 even though the dumpster is shown in Phase 1. The dumpster will need to be enclosed when it is installed on the site in Phase I. 4. Describe materials proposed for the dumpster enclosure. 5. Indicate whether the water, sewer and gas lines are existing or proposed. City of La Porte 604 W. The proposed fence adjacent to the parking stalls does not show whether it is planned for Phase 1 or Phase 2. 7. It is unclear to me where the sidewalks are on Main Street and First Avenue. Staff needs to verify that the proposed motorcycle parking does not prevent pedestrians from walking along the sidewalk. The site plan will need to show adjacent improvements, including sidewalks and all access points to the site. 8. The site plan shows an existing concrete slab on the south portion of the lot. Please verify that this is indeed existing as aerial photography does not clearly show the slab. 9. Under "Project Notes:", change to Phase 2 (not Phase II) since the site plan labels everything in that manner. 10. Include a signature for the City Planner as part of the City's signature block. 11. The following are your comments with our response numbered the same as in your letter: The proposed site plan indicates that landscaping is not required in the Main Street District per Section 106-443, Table B. First Avenue should include street trees and shrubs and the two trees along Main Street should be replaced ivith quality street trees. If there is a species of free that might fit the theme of the restaurant, such as a queen palm possibly, staff is willing to consider it. Although we still disagree with your interpretation of the footnote annotation, landscaping is being provided since the hard piped irrigation system requirement has L.afittes Cajun Station - Site Plan Re-Subniittnl for Review Manning Engineering Corp. In addition, a tree specialist has evaluated the existing trees on Main Street and indicated the existing trees can not be helped. As a result, the trees will be replaced. The proposed landscaping has been added to the site plan. 2. The site plan indicates that the property owner is "Jason Leopard". Because the application is for Ms. Kelli Grabbe's proposed restaurant, a letter or email will need to be provided from the property owner authorizing this application. Jason Leopard has provided the required e-mail. The proposed dumpster enclose is shown as being constructed during Phase 2 even though the dumpster is shown in Phase 1. The dumpster willneed to be enclosed when it is installed on the site in Phase 1. The dumpster enclosure is now shown as Phase I, 4. Describe materials proposed for the dumpster enclosure. Shown on the revised site plan. 5. Indicate whether the water, sewer and gas lines are existing or proposed. Additional, labeling has been provided. 6. The proposed fence adjacent to the parking stalls does not show whether it is planned for Phase 1 or Phase 2. Noted on the revised site plan. 7. It is unclear to me where the sidewalks are on Main Sheet and First Avenue. Stajfneeds to verify that the proposed motorcycle parking does not prevent pedestrians from walking along the sidewalk. The site plan will need to show adjacent improvements, including sidewalks and all access points to the site. Lafittes Cajun Station - Site Plan Re -Submittal for Review Manning Engineering Corp.
