Uba of Environmental Analytical Services conducted an asbestos survey of Whataburger Restaurant located at 117 Hwy 146 @ Spencer, LaPorte, TX 77571 as was verbally authorized by Ms. Lenora Hunt with Hams Construction. The essence of the survey was to determine the presence of Asbestos Containing Material (ACM) in the dining and kitchen area ceiling tiles prior to planned renovation. A total of 6 suspect material es WeKcollected. laboratory � NQV 12 Zooa Table Laboratory Analysis Bulk samples were analyzed using Polarized Light Microscopy (PLM) in general accordance with the procedures outlined in the US EPA Interim Method for the Determination of Asbestos in Bulk Building materials, EPA/600/R-931/116 or the U.S Environmental Protection Agency method under AHERA. The technique characterizes the material's refractive indices, fiber morphology, birefringence, extinction angles, sign of elongation and dispersion staining colors to detect asbestos. Percentage compositions are based on approximate area compositions under stereoscope. The results of the bulk sample analyses are given in table 1. The US EPA N �StIP Federal Register 40 CFR Part 61 Vol. 55 No. 224, November 20, 1990 and the US EPA May 8, 1991, Clarification Memorandum (entitled Clarification of NESHAP Requirement to Perform Point Counting to Quantify Asbestos Below 10%) indicates "... if the analyst detects asbestos in the sample and estimates the amount by visual estimation to be less than 10%, the owner or operator of the building, may (1) elect containing material or (2) require verification of the amount by point counting .... If the result obtained by point counting is different from the result obtained by visual estimation, the point count result will be used." After review of the asbestos results from an independent laboratory report, we determined it imprudent to point count any of the samples since no asbestos was detected. The "composite sample" method of sampling wall texture and joint compound which is allowed by the EPA was not utilized due to OSHA's policy (OSHA January 19, 1993 Clarification Letter and August 7, 1997 verbal confirmation by the OSHA Region 6 E OVER 4 NOY 12 2003 BY: Asbestos Coordinator) of not accepting the method and DSHS's December, 1998 revised Rule which does not accept "composite sample" analysis. INNACCESSIBLE AREAS Materials located behind permanent walls, fixtures or pipe chases were not surveyed or sampled. Construction materials such as heat duct wrap and/or tapes, pipe insulation and heat duct (if present) are assumed to be the same construction inside walls, chases and ceilings as viewed where opened. Hidden ceilings and previous renovations can hide construction materials during visual inspections. New single ply composite, metallic and/or fiberglass roofs may cover asphalt/felt roofing, which could contain asbestos. Cutting the composite roof may cause leaks and warranty problems.
