Definitions. ¢ 106-1 The following words, terms and phrases, when used in this chapter shall have the meanings ascribed to them in this section, except where the context indicates a,different meaning: Abutting means having property or district lines in common, or two objects in immediate contact. (a) Domestic livestock (cattle, horses, hogs, sheep, goats, chickens, and geese) are a permitted accessory use on lots in excess of 43,560 square feet, provided that all domestic livestock as defined above be restrained no closer than 25 feet from property that is not devoted to the keeping of domestic livestock, and provided further that said domestic livestock be kept in a concentration that is less than or equal to: (1) Two cows per acre. (c) The keeping of livestock or fowl for the purpose of breeding for sale, whether engaged in as a primary or accessory activity, shall be considered a conditional use as specified by section i 106-331, Table A Sec. 106-743. Breeding kennels (dogs and cats only). Breeding kennels for dogs and cats only, are a permitted accessory use on lots in excess of 43,560 square feet, provided that all of such kennels are licensed according to section 14-81 et seq., and any amendments or additions thereto. Provided further that all animals must be boarded in enclosures located no closer than 100 feet from any property line. The requirements of section 34126 et seq., and any amendments or additions thereto shall apply in any event. Sec. 106.744. Bed and breakfast. (a) Abed and breakfast shall be operated by resident homeowners. (b) A bed and breakfast shall conform to the requirements of section 106-334. (c) Parking shall be provided in accordance with the requirements of section 106-839. Off-street loading requirements. (a) Purpose. The regulation of loading spaces in these zoning regulations is to alleviate or prevent congestion of the public right-of-way and so to promote the safety and general welfare of the public. By establishing minimum requirements for off-street loading and unloading from motor vehicles in accordance with the utilization of various parcels of land or structures. (b) Location. (1) All required loading berths shall be off-street and located on the game lots as the building or use to be served. (2) All loading berth curb cuts shall be located at minimum 60 feet from the intersection of two or more street rights -of -way. This distance shall be measured from the property lines common with the right-of-way lines. (3) No loading berth area shall be closer than 30 feet from a residential district unless within a structure. (4) Loading berths shall not occupy the front yard setback or side yard setback if adjacent to a street right-of-way. (5) Each loading berth shall be located with appropriate means of vehicular access to a street or public alley in a manner which will cause the least interference with traffic. CD106:100 84 � BAeak�gsy- 101-172 UFE SAFM(x)DF. --X9 P O CHAPTER 20 LODGING OR ROOMING HOUSES SECTION 20-1 GENERAL REQUIREMENTS 2D-1.1 Application. - 20-1.1.1 This chapter applies to buildings that provide sleep- ing accommodations for a total of 16 or fewer persons on ei- ther a transient or permanent basis, with or without meals, but without separate cooking facilities for individual occu- pants except as provided in Chapter 21. 20-1.1.2 The requirements of this chapter are applicable to new buildings and to existing or modified buildings accord- ing to the provisions of Section 1-3 of this Cade. 20-1.2 Mixed Occupancies. 20-1.2.1 Where another type of occupancy occurs in the same building as a residential occupancy, the requirements of 4-1.12 of this Code shall apply. 20-1.2.2 For requirements on mixed assembly and residen- tial occupancies, see 8-1.2 or 9-1.2; for mixed mercantile and residential occupancies, see 24-1.2 or 25.1.2; and for mixed business and residential occupancies, see 26-1.2. 20.1.3 Definitions. Terms applicable to this chapter are de- fined in Chapter 3 of this Code; where necessary, other terms will be defined in the text as they occur. 20-1.4 Classification of Occupancy. (See 20-1.1.1.) 20-1.5 Classification of Harard of Contents. The contents of residential occupancies shall be classified m ordinary haz- ard in accordance with Section 4-2.. 20-1.6 Minimum Construction Requiremenm (No special requirements.) 20-1.7 Occupant Load. SECTION 20.2 MEANS OF ESCAPE REQUIREMENTS 20.2.1 Number and Types of Means of Escape. 2D.2.1.1 Every sleeping room and living area shall have ac- cess to a primary means of escape, complying with Chapter 21, located to provide a safe path of travel to the outside. Where the sleeping room is above or below the level of exit discharge, the primary means of escape shall be an interior stair in accordance with 20.2.2, an exterior stair, or a horizon- tal exit in accordance with 5-2.4, or an existing fire escape stair in accordance with 5-2.8. 20-2.1.2 In addition to the primary route, each sleeping room and living area shall have a second means of escape in accordance with 21-2.2.3. Exception: If the sleeping room or living area has a door leading di- rectly outside the building with access to grade or to a stairway that meets the requiremenu for exterior stairs in 20-2. 1. 1, that escape shall be considered as mating all of the escape requirements for that sleep- ing room or living area. 20-2.1.3 Every story more than 2000 sq ft (185 sq m) in area or with travel distance to the primary means of escape more than 75 ft (23 m) shall be provided with two primary means of escape remotely located from each other. 1997 Edition Exception No. 1: Existing buildings. Exception No. 2: Buildings protected throughout by an approved, supervised automatic sprinkler system installed in accordance with 20-3.5. 20-2.2 interior stairways shall be enclosed by I/t-hr fire barri- ers with all openings protected with smoke -actuated auto- matic -closing or self -closing doom having a fire resistance comparable to that required for the enclosure. The stairway shall comply with 5-2.2.5.3. Exception No. 1: Where an interior stair connects the shref floor with the story next above or below only, but not both, the interior stair shall be required to be enclosed only on the street floor. Exception No. 2: Stairways shall be permitted to be unprotected in accordance with the Exception to 20.3. 1. 1. 20-2.3 No door or path of travel in a means of escape shall be less than 28 in. (71 cm) wide. Exception: Bathroom doors shall be not less than 24 in. (61 cm) wide. 20-2.4 Every closet door latch shall be such that it can be readily opened from the inside in case of emergency. 20-2.5 Every bathroom door shall be designed to allow opening from the outside during an emergency when locked. 20-2.6 Winders in accordance with 5-2.2.2.5 shall be permitted. 20.2.7• No door in any means of escape shall be locked against egress when the building is occupied. Exception: Delayed egress locks complying with 5-2.1.6.1 shall be permitted, provided not more than one such device is located in any one escape path. 20.2.8 Doom serving a single dwelling unit shall be permit- ted to be provided with a lock in accordance with Exception No. 3 to 5-2.1.5.1. SECTION 20-3 PROTECTION 20-3.1 Protection of Vertical Openings. 20.3.1.1 Vertical openings shall be protected so that no pri- mary escape route is exposed to an unprotected vertical open- ing. The vertical opening shall be considered protected if the opening is cut off and enclosed in a manner that provides a smoke- and fire -resisting capability of not less than t'A hr. Any doors or openings shall have fire and smoke resisting capabil- ity equivalent to that of the enclosure and shall be automatic - closing on detection of smoke or shall be self -closing. Interior wall and ceiling finish materials complying with 6-5.4 shall be Class A, Class B, or Class C in occupied spaces. 20-3.2.3 Interior Floor Fuhbh. No requirement. 20.3.3 Detection, Alarm, and Communication Systems. 20.3.3.1 General. Lodging and rooming houses shall be pro- vided with a fire alarm system in accordance with Section 7.6. Exception: Buildings that have a smoke detection system mating or exceeding the requirements of 20-3.3.4 and where that detection sys-' tern includes at least ores manual fire alarm station per floor arranged to initiate the smoke detection alarm. 20-3.3.2 Initiation. Initiation of the required fire alarm sys- tem shall be by manual means in accordance with 7-6.2. Exception: Buildings protected throughout by an approved, auto- matic sprinkler system installed in accordance with 20.3.5, unth alarm initiation in accordance with 7-6.2.1(c). 20-3.3.3 Notification. Occupant notification shall be pro- vided automatically in accordance with 7-6.3. Presignal sys-, reins shall be prohibited. All sleeping rooms . shall be separated from escape route corridors by walls and doors that are smoke resistant. There shall be no louvers or operable transoms or other air passages penetrating the wall except properly installed heating and utility installations other than transfer grilles. Transfer grilles shall be prohibited. Doors shall be provided with latches or other mechanisms suitable for keeping the doors closed. No doors shall be ar- ranged to prevent the occupant from closing the door. Doors shall be self -closing or automatic -closing upon detection of smoke. Exception: Door-clonng devices shall not be required in buildings protected throughout by an approved, automatic sprinkler system in- stalled in accordance with 20-3.5. 20-3.5 Extinguishment Requirements. 20-3.5.10 Where an automatic sprinkler system is required or is used as an alternative method of protection, either for total or partial building coverage, the system shall be installed in accordance with Section 7-7 and shall actuate the fire alarm system in accordance with Section 7-6. In buildings up to and including four stories in height, systems installed in accor- dance with NFPA 13R, Standard foram Installation of Sprinkler System in Residential Occupancies up to and Including Four Stories in Height, shall be permitted. Exception No. 1: In individual living units, sprinkler installation shall not be required in clarets not over 12 sq jl (1.1 sq m). Closets that contain equipment such as washers, dryers, furnaces, or water heaters shall be sprinklered regardless of sire. . Exception No. 2: In casting lodging and rooming houses, sprinkler installations shall not be required in closets not over 24 sq jl (2.2.sq m) and bathrooms not vier 55 sq ft (5.1 sq m). 20.3.5.2 All new lodging or rooming houses shall be pro- tected throughout by an approved, automatic sprinkler sys- tem installed in accordance with 20-3.5.L. The primary means of escape shall be a door, stairway, or ramp providing a means of unobstructed travel to the outside of the dwelling unit at street or ground level. 21.2.2.3* Secondary Meats of Escape. The secondary means of escape shall be one of the following: (a) A door, stairway, passage, or hall providing a way of un- obstructed travel to the outside of the dwelling at street or ground level that is independent of and remote from the pri- mary means of escape; ' (b) A passage through an adjacent nonlockable space, in- dependent of and remote from the primary means of escape, to any approved means of escape; (c)* An outside window or door operable from the inside without the use of tools, keys, or special effort and providing a clear opening of not less than 5.7 sq ft (0.53 sq m) with the width not less than 20 in. (51 cm) and the height not less than 24 in. (61 cm). The bottom of the opening shall be not more than 44 in. (112 cm) above the Floor. Such means of escape shall be acceptable if 1. The window is within 20 ft (6.1 m) of grade, or 2. The window is directly accessible to fire department rescue apparatus as approved by the authority having jurisdic- tion, or 3. The window or door opens onto an exterior balcony.
