Attached is an electrical permit application for a T-pole for the location of 1 8 S.
Broadway, Laporte 77571. The company that we are working for is ISI, w ich does
road construction. The City of Laporte has let ISI use this property to set up there job
offices. I wrote the address of the jobsite and our information on the permit application,
but I do not know what to fill out in the other area's with the property situation the way
it is. Can you please help fill in the blanks so this permit will go through with no
problems and so Centerpoint has no problems connecting power. Please call with any
questions.

(the "Tenant")
OF THE SECOND PART
IN CONSIDERATION OF the Landlord leasing certain premises to the Tenant, the
Tenant leasing those premises from the Landlord and the mutual benefits and obligations
set forth in this Lease, the receipt and sufficiency of which consideration is hereby
acknowledged, the parties to this Lease agree as follows:
Leased Premises
The Landlord agrees to rent to the Tenant the commercial premises municipally
described as 1702 S. Broadway, LaPorte, TX, (see Attachment "A") (the
"Premises"). The Premises will be used for only the following permitted use (the
"Permitted Use"): One on -site job trailer, as well as storage of construction
equipment and materials as required for the completion of the SH 146D Bridge,
and any reasonable business activity related to tenant's performance of the SH
146D Bridge contract. Neither the Premises nor any part of the Premises will be
used at any time during the term of this Lease by Tenant for any purpose other
than the Permitted Use.
2. The Landlord agrees to supply and the Tenant agrees to use and maintain in
reasonable condition, normal wear and tear for its intended use excepted, the
following fixtures and leasehold improvements: Aforementioned tenant will
install a chain link fence along the perimeter of the said property. Chain link fence
will be removed by tenant after tenant has vacated the said property. There are no
other leasehold improvements on the property of value to be maintained.
Term
3. The term of the Lease is a periodic tenancy commencing at 7:00 a.m. on
December 20, 2008 through June 30, 2009 at 5:00 p.m., then continuing on a
month to month basis for up to 12 additional months if or as needed until the
Tenant terminates the tenancy.
4. Upon 15 days notice, the Tenant may terminate the tenancy under this Lease
without cause, reason or penalty.
Rent
5. Subject to the provisions of this Lease, the Tenant will pay a base rent (the 'Base
Rent") of $300.00 every month for the Premises. Thereafter, should the tenant
continue to lease the premises monthly, tenant will pay $300.00 per month (the
"Monthly Extension Rent").
6. The Tenant will pay the Base Rent to the Landlord on or before December 31,
2008, for the first month of the Initial Term of this Lease to the Landlord at 604
West Fairmont Parkway, Attn. Finance, LaPorte, Texas 77571, or at such other
place as the Landlord may later designate. Tenant will pay Base Rent during the
remainder of the Initial Term on or before the first business day of each month,
beginning in February of 2009.For any monthly extensions tenant will pay the
Monthly Extension Rent on or before the first business day of each month.
Use and Occupation
7. The Tenant covenants that the Tenant will cant' on and conduct its business from
time to time carried on upon the Premises in such manner as to comply with all
statutes, bylaws, rules and regulations of any federal, provincial, municipal or
other competent authority and will not do anything on or in the Premises in
contravention of any of them.
Quiet Enjoyment
8. The Landlord covenants that on paying the Rent and performing the covenants
contained in this Lease, the Tenant will peacefully and quietly have, hold, and
enjoy the Premises for the agreed term, and any extensions thereof.
Inspections
9. At all reasonable times during the term of this Lease and any renewal of this
Lease, the Landlord and its agents may enter the Premises to make inspections or
repairs, or to show the Premises to prospective tenants or purchasers, provided
that they give 24 hour written notice or are accompanied by an authorized
representative of Tenant.
10. For so long as the Tenant, or an assignee or subtenant approved by the Landlord,
is using and occupying the Premises for the Permitted Use and is not in default
under the Lease, the Landlord agrees not to Lease space on the property to any
other entity or persons.
Tenant Improvements
11. The Tenant will obtain written permission from the Landlord before doing any of
the following:
a. affixing to or erecting upon or near the Premises any radio or TV antenna
or tower.
Insurance
12. The Tenant is hereby advised and understands that the personal property of the
Tenant is not insured by the Landlord for either damage or loss, and the Landlord
assumes no liability for any such loss. The Tenant is advised that, if insurance
coverage is desired by the Tenant, the Tenant should inquire of Tenant's insurance
agent regarding a Tenant's Policy of Insurance.
13. The Tenant is not responsible for insuring the Landlord's contents and furnishings
in or about the Premises for either damage or loss, and the Tenant assumes no
liability for any such loss.
Governing Law
14. It is the intention of the parties to this Lease that the tenancy created by this Lease
and the performance under this Lease, and all suits and special proceedings under
this Lease, be construed in accordance with and governed, to the exclusion of the
law of any other forum, by the laws of the State of Texas, without regard to the
jurisdiction in which any action or special proceeding may be instituted.
Severability
15. If there is a conflict between any provision of this Lease and the applicable
legislation of the State of Texas (the "Act"), the Act will prevail and such
provisions of the Lease will be amended or deleted as necessary in order to
comply with the Act. Further, any provisions that are required by the Act are
incorporated into this Lease.
Additional Provisions
16. Initial agreement is for lease with Initial Term from December 20, 2008 to June
30, 2009, at $300.00/MO, as herein provided. Once the Initial Term has expired,
Tenant will rent on a month to month basis, as needed, at $300.00/MO.
Maintenance
17. The Tenant will, at its sole expense, keep and maintain the Premises and
appurtenances in good and sanitary condition and repair consistent with its
original condition upon Tenants initial occupation of the premises during the term
of this Lease and any renewal of this Lease.
Care and Use of Premises
18. The Tenant will promptly notify the Landlord of any damage, or of any situation
that may significantly interfere with the normal use of the Premises or to any
fiuuishings supplied by the Landlord.
19. The Tenant will not engage in any illegal trade or activity on or about the
Premises.
20. The Landlord and Tenant will comply with standards of health, sanitation, fire,
housing and safety as required by law.
21. At the expiration of the lease term, or subsequent extensions, the Tenant will quit
and surrender the Premises in as good a state and condition as they were at the
commencement of this lease. Additionally, Tenant agrees to return premises to
Landlord rake clean, with no environmental disturbance to the surface or
subsurface. In this regard Tenant agrees to indemnify and hold harmless Landlord
for any claims, damages, or penalties brought or assessed by a governmental
entity, or private party, against the Landlord.
General Provisions
22. Any waiver by the Landlord of any failure by the Tenant to perform or observe
the provisions of this Lease will not operate as a waiver of the Landlord's rights
under this Lease in respect of any subsequent defaults, breaches or
nonperformance and will not defeat or affect in any way the Landlord's rights in
respect of any subsequent default or breach.
23. This Lease will extend to and be binding upon and inure to the benefit of the
respective heirs, executors, administrators, successors and assigns, as the case
may be, of each party to this Lease. All covenants are to be construed as
conditions of this Lease.
24. All sums payable by the Tenant to the Landlord pursuant to any provision of this
Lease will be deemed to be Additional Rent and will be recovered by the
Landlord as rental arrears.
25. Where there is more than one Tenant executing this Lease, all Tenants are jointly
and severally liable for each other's acts, omissions and liabilities pursuant to this
Lease.

a t-pole. Vicki did a good job not issuing the electrical permit because of not enough information being provided.
I got involved and Mr.Steve Martin ( the general contractor ) sent me the email below, so I could try to assist him.
Debbie, how do you wish to proceed on this one ??
Questions that I have thus far are as follows
1. Verify with Mr. Bottoms and / or Tim T. ??
2. Request that they apply for a zoning permit and what SIC # will be used ??
3. Certified Site plan ?????
4. Request a building permit application be submitted, along with a survey of the land with proposed office trailer
placement location shown , parking spaces, etc...???
Bryan, Mr. Scott Martin stated that he met with you and that you informed him verbally to utilize the address of 168
and if so can you please send me a CDR tied to an HCAD #. This address is not in HTE as of this date.
