This Asbestos Survey included a review ofa previous Asbestos Survey, completed by Golder Associates; Inc. (Golder) in June 2004, and a site walk performed on May 11, 2010 by Christopher Songster, a Texas Department of State Health Services (DSHSylicensed inspector. The scope of services for this survey was to identify the presence, condition, and quantity of any asbestos -containing materials (ACM) located at the subject property that could be disturbed by renovation or demolition activities:. REGULATORY -OVERVIEW Asbestosis federally regulated by the'ClearrAir Act (CAA), the Toxic Substances Control Act - (TSCA), the AsbestosHazard Emergency Response Act (AHERA), and the Asbestos School Hazard Abatement Reauthorization Act (ASHARA). The State of Texas DSHS regulates asbestos by enforcing requirements and procedures established by the Texas Administrative Code,(TAC) and presented in the Texas Asbestos Health.Protection Rules (TAHPR). The U.& Environmental Protection Agency (EPA) enforces these laws through the Code of Federal: Regulations (CFR) at 40 CFR 61 Subpart M, which is.the National Emission Standard for a Hazardous. Air Pollutant (NESHAP) — asbestos regulations, and at 40 CFR 763. Asbestos in the workplace is regulated by the Occupational Safety and Health.Act, which is enforced by the US. The U.S. EPA created the Worker Protection Rule,(.40 CFR 763 Subpart G) to extend these OSHA. standards to public sector employees not already covered by he OSHA standards. The Texas DSHS enforces TAHPR (TAC Title 25 Part I.Chapter295.31 _'Chapter 295.73), which establishes work practices, licensure requirements; and abatement notifications and associated,fees. The. U.S. EPA NESHAP regulations establish, among other requirements, the following: • Defines ACM as friable ACM and:as'Category I or Category II non -friable ACM that is either In poor condition and has become friable or will be subjected to drilling, sanding, grinding, cutting or abrading and could become friable during anticipated renovation or demolition activities: • Material classification:protocol; o. Friable ACM — materials that,contain-more than 10k asbestos as determined by polarized light microscopy (PLM) analysis and,, when dry, may be crumbled; pulverised orreduced,to.powder by hand pressure; o Category I non -friable ACM - includes pacldngs, gaskets, resilient floor coverings, and asphalt roofing products, that contain more than 1 % asbestos as determined by PLM analysis; and o Category II non -friable ACM - any materials,; other than Category I non -friable materials, that, contain more than 1% asbestos as determined by PLM analysis: • Potential ACM must be identified, classified; :and quantilled', priorto planned disturbances or demolition activitles: Requires ACM to be removed prior, to oondticting renovation ordemolition:activities that may dislurb:ACM: r• Prohibits,the•release of asbestos fibers`to the atmosphere during:renovafion or demolition activities (Le., visible emissions). • Regulates asbestos waste disposal practices. The OSHA Standards regulate, among other practices, workplace exposure to asbestos ,including the following: •- Employee exposure to airbome asbestos fibers must be maintained below 6:1 asbestos fibers per cubic centimeter of air (0:1 f/cc). • basslfies construction and maintenance activities which could disturbACM and specifies work• practices and precautions that employers;;must follow when engaging in removal of .ACM. • Allows states that administertheir own federally -approved OSHA programs to require additional precautions. Third party air monitoring must be conducted during the abatement activitiesby a Texas DSHS-licensed asbestos consultant agency. Management Plans developed for the management of ACM must be developed by a,Texas DSHS-licensed management planner. Property owner or, operator must provide the Texas DSHS'with written notification of planned removal activities at least 10working :days;pdor to thecommencement of asbestos abatement activities. The.nature and extent'of variations between the sampling locations may not become evident until planned renovation and/or demolition procedures commence. If potential variations are Identified during renovation or demolition activities, it may be necessary to conduct additional bulk sampling,(and possibly revise any future;asbestos abatement plans). SUMMARY'OF FINDINGS -:PREVIOUS ASBESTOS SURVEY REPORT Golder performed an Asbestos Survey for the subject property in June 2004 (Golder Project No. 033=187&000) which included collection and laboratory analysis of two hundred twenty-eight samples of suspect ACM. Analytical results Indicated that thirty-one'samples from thirteen different homogenous building materials wereindentified as ACM and are summarized below: An,Operations:and Maintenance (O&M) Program was recommended to manage the ACM in- place. Information presented In the Golder Asbestos:Surveywas verified by SKA and evidence of asbestos abatement or discrepancies between information presented in the Golder Asbestos Survey and the current buildingmaterialslconditions were documented during the site walk conducted on May 11, 2010. SKA collected samples of resilient floortile�and tile mastic, as warranted, to confirm the presence of asbestos In specific.areas of the Showroom/Service building. Each of the'four'suspect ACM samples collected by SKA from the subject property was placed into a dedicated, disposable plasticbag;.properly sealed,-and,submitted to a laboratory licensed by the Texas DSHS and accredited by the -National Voluntary Laboratory Accreditation Program (NVLAP) fof,sample enalysls. Each sample container was.also labeled with a unique identifying number using an Indelible; marker. Laboratory Aniftis• Bulk samples collected from the subject property were submitted to Loftin Environmental Services, Inc. (Loflin) of Houston, Texas, which is accredited under the NVLAP Accreditation (No. 162044) and licensed by the Texas DSHS (No. 30-0031). The bulk samples were analyzed by with dispersion staining in accordance with EPA's'Method for the Determinati6n of Asbestos in Bulk Samples" (EPA 600/R-93/116, July 1993). (Golder) was requested to perform an asbestos -containing materials (ACM) survey at Champion Chevrolet -Mazda located at 112 South I0th Street in LaPorte, Texas (Site). The purpose of the survey was to assess whether ACM was present at the Site. Based on Golder's understanding of the client's needs, the following limited ACM survey scope of services was conducted: L Performed ACM surveys of the buildings located at 112, South 10th Street in accordance with the listed criteria in OSHA standard 29 CFR 1926.1 101 and EPA standard 40 CFR Part 61.145 (a), including the analysis 'of bulk samples (roofing samples excluded from scope-o£ work) via polarized light microscopy (PLM) methodology. 2. Provided a written report detailing survey information including: analytical results in tabular form, a site sketch depicting sample and ACM locations, interpretation of results, and recommendations for additional related actions. 2.0 LIMITING,CONDITIONS The ACM survey conducted by Loflin Environmental Services, Inc. ((Texas Department of 'Health Licensed Asbestos Consultant Agency No. 72994) on behalf of Golder on 12 January 2004 was.performed in general accordance with industry standards for bulk asbestos sampling procedures in existence at the time of the project. The conclusions and recommendations presented in this report are based on the applicable standards of our profession at the time this report was prepared. Copies of this report are furnished to provide the factual data that were gathered and'sumrrrarized in the report. The analysis and recommendations submitted in this report are based in part on the data obtained From specific and discrete sampling locations including representative interior wall cavities and above representative ceilings. However, the nature and extent of variations between the sampling locations may not become evident until planned renovation and/or demolition procedures commence. 117potential variations are identified during renovation or demolition activities, it may be necessary to- conduct additional bulk sompling (and possibly revise any future asbestos abatement plans). At the request of the client, roofing materials were excluded from the scope - of -'work. According to data provided by the client, the showroom buildings were constructed'circa 1967. The showroom building is a two-story building that encompasses approximately 39,060 square feet (ft'). The building houses a Chevrolet showroom and associated sales areas, a Mazda showroom and associated sales offices, the parts department offices and storage areas, and an automobile service bay and associated employee break room and locker room. The second floor is occupied by the business and executive offices. A pre -owned car sales measures approximately 1,220 ft' and consists of sales offices. A body shop measures approximately 3,510 ft'. The building is occupied by an office area and a collision repair area. The Vic. Lot building measures approximately 375 ft' and is occupied by offices. Lot #2 building measures approximately 140 ft' and is designated as a car shack. A preliminary walk-through of the buildings was performed to familiarize the inspector with the structures and to identify suspect ACM. During the walk-through, visible heating, ventilation and air conditioning (HVAC) ducting; hot and cold water supply piping; other mechanical systems requiring thermal system insulation (TSI); and other suspect applications were inspected for suspect asbestos -containing TSI. The interiors and exteriors of the buildings were assessed for suspect asbestos -containing surfacing materials, suspect asbestos -containing miscellaneous friable materials, suspect asbestos -containing Category I non -friable materials, and suspect asbestos -containing Category 11 non -friable materials. Friable materials are defined as materials, that when dry, can be crumbled or reduced to a powder by hand pressure. Category I non friable materials are defined as packing, gaskets, asphaltic roofing materials, and resilient flooring materials and associated mastics in which the asbestos fibers are bound within a resinous matrix. Category 11' non -friable materials are defined as other non -friable materials such as transite in which the asbestos fibers are bound within a cement -like matrix. Sampling of suspect ACM was conducted on identified suspect materials regardless of their condition (friability) at the time of the survey. The assessment and sampling of suspect non - friable materials were included in the scope of work because their condition could change during ECEOVE Colder Associates NOV Z 12012 13Y:�_ 1_ tote 7064 a 0 1878 000 renovation and/or demolition activities. Their change in condition could result in their reclassification from non -friable ACM to regulated ACM (RACbI) that are subject to the Environmental Protection Agency's (EPA) National Emission Standards for hazardous Air Pollutants (NESHAP);asbestos standard (40 CFR Pan 61 Subpart M). During the walk-through, homogeneous areasfhomogeoeous sample groups (HGs) were identified in each of the buildings. ,Based on the idedtified HGs, a bulk sampling plan for suspect ACM was developed. Bulk sampling was conducted in accordance with procedures outlined in the Asbestos Hazard Emergency Response Act (40 CFR 763.86, Sampling). The procedure requires the inspector to select random sampling locations from homogeneous materials suspected to contain asbestos. Survey activities, including materials sampling to document existing conditions and suspect building materials, were carried out by Mr. Matthew Songster, State of Texas licensed Asbestos Inspector (60-2110) as required by Texas Asbestos Health Protection 'Rulcs §295.50. Two hundred twenty-eight suspect ACM bulk samples were collected and shipped under chain - of -custody procedures to the laboratory maintained by Loflin Environmental Services, Inc. (National Institute of Standards and Technology's National Voluntary Laboratory Accreditation Program (NVLAP), Lab Code 2044) located at 2020 Montrose Boulevard in Houston, Texas. The ACM, bulk samples were analyzed using polarized light microscopy (PLM) in accordance with the EPA Interim Method of Asbestos in Bulk Insulation Samples as defined in 40 CFR 763, Appendix E to Subpart E (EPA :Method 600/R93/1 16). 4.0' ACM SURVEY RESULTS Five buildings located at 112'Souih 10th Street were surveyed. Less than one percent asbestos was detected in the tan 12"xl2" RFf (HG16) and white exterior window caulking (HG18). Under Texas law, materials containing less than one percent asbestos are not considered to be ACM. An overview of the observed HG is as follows: • 2'x2' ceiling panels (groove pattem-HG46) observed throughout the building; • White with gray speck 12"xl2" RFT and mastic (HG47) located throughout the building; • Black cove base and mastic (HG48) located throughout the building; • Gypsum wallboard with flat texture (HG49) observed throughout the building; • Joint compound (HG50) observed throughout the building; • Brown interior window caulking (HG51) located throughout the building; • Brown exterior window and door caulking (HG52) located throughout the building; and • White HVAC duct seam tape (HG53) located throughout the building. The mastic associated with the white with gray speck 12"x 12" RFT (HG47) was found to contain asbestos. The remaining HGs identified inside the pre -owned sales building were not found to contain asbestos. The body shop is occupied by'the. automobile collision repair areas and offices areas. The mastic associated with tan 12"xl2" RFT (HG63) was found to contain asbestos. This tan RFT was also found to contain less than one percent asbestos. Under Texas law, materials containing less than one percent asbestos are not considered to be ACM. The remaining samples identified inside the body shop were not found to contain asbestos. The Old Vic. Lot Building is occupied by offices. An overview of the observed HG is as follows: • Tan 9"x9" RFT and mastic (HG64) located underneath the carpet along the front entrance and adjoining offices;. . • Black cove base and mastic (HG65) located throughout the building; • Yellow carpet mastic (HG66) located throughout the building; • Gypsum ceiling board with rough texture (fIG67) located throughout the building; • Gypsum wallboard (HG68) observed throughout the building; • Joint compound (HG69) located throughout the building; • White vinyl wall covering and yellow mastic (14G70) located throughout the building; • Tan interior structural caulking (HG71) located around an electrical box enclosure; and • Tan interior window caulking (HG72) located throughout the building. An overview of the observed HG is as follows: • Ceiling wallboard (HG73) observed throughout the building; • Spray -applied acoustic ceiling texture (HG74) observed throughout the building; • Gypsum wallboard system with rough texture coat (HG75) observed throughout the building; and • Joint compound (HG76) located throughout the building. The HGs identified inside the lot #2 building were not found to contain asbestos. Table I, attached hereto, provides a complete breakdown of homogeneous sample groups, analytical results, EPA Category, and condition and quantity of ACM. Loflin's survev and laboratory analytical results are attached in Appendix B. 5.0 CONCLUSIONS AND RECOMMENDATIONS In accordance with 40 CFR Pan 61.145 (a) and 29 CFR 1910-10016)(2), the buildings located at 112 South 10th Street, as identified in the attached figures, have been surveyed for ACM and categorizedbased on the listed criteria. PLM analysis of 76 suspect HG ACM applications indicated the presence of asbestos in the following materials inside the Chevrolet Showroom: the mastics associated with the white with gray 12"x12" RFT (HG3), blue 12"x12" RFT (HG4 and HG36), and tan 12"x 12" RFT (HG 16); brown with beige speck 12"x 12" RFT and mastic (HG5); and tan 9"x9" RFT and mastic (HG6). Less than one percent asbestos was detected in the tan 12"x 12" RFT (HG 16) and white exterior window caulking (HG 18); these materials are not considered by the State of Texas to be ACM. The various patterns of RFT and mastics arc considered Category I non -friable ACMs and were observed to be in good condition. Inside the parts building the tan 12':x 12" RFT and associated mastic (HG35) and the black mastic associated with the blue 12"x12" RFT (HG36) were found to contain asbestos. These materials are considered Category I non -friable ACMs and were observed to be in good condition. These materials are considered Category I non -friable AGM and were observed to be in good condition. The following materials identified inside the Old Vic. building were found to contain asbestos: tan 9" 0" RFT and mastic (HG64), joint compound (HG69), tan interior structural caulking (HG71), and tan interior window caulking (HG72). The tan RFT and associated mastic, interior were observed to be in good condition. The joint compound structural caulking; and interior window caulking are considered Category 1 non -friable ACM and friable ACM and was observed to be in good condition. is considered a Category Il non - As described, in the Environmental Protection Agency document EPA-340/1.92-013 "A guide to Normal Demolition Practices Under the Asbestos NESHAP", the friable ACM are considered regulated ACM (RACM). Similarly, the identified Category 1 non -friable y� materials that may be subject to cutting, nding, abrading, and/or sanding or Category ❑ non -friable ACM that is anticipated to be reduced to a powder during renovation/demolition activities are considered RACM. Under NESHAP, PAGy must be removed prior to renovation and or demolition activities and ten-day notification is required prior to the removal of more than 160 square feet RACM. RACM removal must be conducted by qualified personnel in accordance with work practices established by NESHAP. Estimated costs for removing the identified ACM are included in Appendix A. Golder recommends the implementation of an Operations and Maintenance (0&M) Program to maintain the identified ACM throughout the dealership. Chevrolet / Mazda located at 112 South 1& Street in La Porte, Texas. This work was performed an January 12, 2004, by Matthew Songster, Project Manager, an EPA accredited inspector and State of Texas licensed Asbestos Inspector (60-2110). The purpose of this survey was to identify and evaluate the current condition of accessible ACM present at the facility. Sampling Procedures The following procedures were observed at the time of this survey. An initial walk-through was conducted to famitiarae the assessor with the property layout. Facility personnel also helped with the Identification of areas and provided access to secured locations. After an Initial review of the property layout, the building was surveyed visually to identify materials suspected to be asbestos containing. Samples of these materials were then collected for laboratory analysis. Bulk samples of suspected ACM were collected in accordance with US EPA guidelines for the type Of suspect material sampled. Within each area samples were collected in such a manner as to minimize damage to facility structures and finishes. Samples were placed in sealed,plastic bags and assigned a unique sample number for identification. A chainofcustody, form was Prepared and the samples were then forwarded to the laboratory for analysis. As a general rule 3- 7 samples of each suspect material was collected. Additional samples were collected If warranted. Random representative samples of the homogeneous materials were taken from different building areas. Homogeneous materials are building materials of the same type, style and composition and used In the same manner. A total of two hundred twenty-eight bulk samples of suspect homogeneous materials were collected from the facility. The following material types were evaluated. o Acoustical ceiling tiles o Joint compound o Wall and ceiling texture. o Cue base 0 1' x l' Floor the o Sheet rock o Associated mastics o Sink undercoating The survey was not intrusive and did not include access or sampling of areas Which would have required demolition of, or damage to building components or finishes. All areas with access were examined for the presence of suspect ACM and samples were collected as appropriate. Attached are the tables identifying sampling locations and laboratory results. Method of Analysis Ali samples'were analyzed using Polarized Ught Microscopy (PLM) coupled With dispersion staining In accordance With the U.S. Environmental Protection Agency "Method for the Detemdnation of Asbestos in Bulk Samples''(EPA 600/R-93/116. July 1993). The analyses were performed by the. Loftin Environmental Services, Inc. (LOFUN) laboratory, which holds NVLAP accreditation for analysis of materials for the determination of asbestos content from the National Institute of Standards and Technology (NVLAP #2044). :ICCIVE9 NOY 2 12012 Summary of Findings Thirty-one samples out of the two hundred twenty-eight analyzed were identified as asbestos containing materials.
