eliminate the "pricing is good for 30 days" statement in their proposal. Please sec the attached document.. This

Good morning Ms. Cox:
The evaluation committee met yesterday to review your application for the Enhancement Grant Program. The team
rated your project very high and feels that this is a positive project for Main Street. There are a few clarification items
that we would like to review to fully evaluate the project.
1. Estimate Expired: The estimate provided by Follis Construction indicates that pricing is good for 30 days. At
this juncture and by the time the Economic Development Board will meet to consider awarding a grant, that
pricing will no longer be valid. Assuming we can get everything outlined here addressed in a timely manner, I
see no reason why the Item could not be placed on the January 21 EDC agenda. Can you provide documentation
from Mark regarding the pricing to confirm that the costs outlined here will be good through that time?

2. Interloplmprovement Inelielble: On Drawing A-3, the items listed as "Interior Window Seats" in No. 1 and
Interior Paint in No. 2 are ineligible expenses since it is for the interior. Please provide a revised estimate to
back out the costs associated with the window seats and interior paint.
3. Entry Elevation Clarification: Clarification on Drawing A-3, we want to make sure that we understand the
configuration of the entryway doors. Based on this drawing, it appears that the current configuration will be
maintained, with upgraded doors still recessed back from the windows. On Drawing A-1, it appears that the
front fagade will be flat front. Can you confirm which is correct? I'm guessing the "X" drawn through the doors
on Drawing A-1 means that the door is recessed but please confirm.
Finally, please be advised that, as part of the permitting process for your building permit, you will be required to sign a
right of way encroachment agreement for the canopy. This agreement sets standards for minimum height,
maintenance, and contains language basically stating that you are aware that the canopy is encroaching into the right of
way. There is no action required for this Item for completion of the application. I just wanted to make you aware that
this will be a component of your building permit.
The next meeting of the EDC Board is scheduled for January 21. If you can provide your follow up information for Items
1-3 listed above by January 14, the evaluation team can re-evaluate your application and, if approved, submit it to the
Board for consideration. if information is received after this date, our next meeting is scheduled for February. Based on
my previous conversation with you, we have agreed to allow you to move forward with some work now, with the
understanding that approval of the grant is not guaranteed by the EDC Board.
Please be aware that while we do require a grant application prior to the completion of enhancement projects and we
approve them ahead of time, the actual grants are awarded on a reimbursement basis once completed work has been
verified by the Committee to be compliant with the plans proposed in the approved application. If you have any

through this process.

SUMMARY & RECOMMENDATION
In the 2008-09 budget year, the La Porte Development Corporation Board agreed to fund an
enhancement grant program for the Main Street Overlay District. The program offered matching
grants of up to $25,000 for businesses in the Main Street District to improve building facades.
The project was allotted $200,000 and has $168,000 remaining. The goals of the project were to
beautify Main Street, to enhance Main Street's appeal to new businesses and visitors, and to add
value to the City of LaPorte.
Ms. Claudia Cox has submitted a grant application for Entrust Professional Insurance, located at
210 West Main Street. The Enhancement Grant Application Committee met to discuss the
application, and agreed that it should be approved for an amount not to exceed $17,611. The
actual award will be one-half of the amount Ms. Cox spends on approved expenses for the
project up to $17,611, and will be contingent upon the project being completed as indicated in
this grant application. Attached is the application that Ms. Cox submitted, as well as additional
clarification information on the cost breakdown, as requested by the evaluation committee.
The committee recommends that the Board conditionally award a grant in an amount not to
exceed $17,611, based on receipts and completion of work as indicated.

Consider approval or other action of a grant amount not to exceed $17,611 for Ms. Claudia Cox

President Warren called the meeting to order at 5:00 p.m. The following members of the La Porte
Development Corporation Board were present: Board members Engelken, Clausen, Woodard,
Ojeda, and Cooksley. Members of the La Porte Development Corporation Board absent: Board
member Zemanek.
Staff Present: Corby Alexander, Traci Leach, Patrice Fogarty, Michael Dolby and Assistant City
Attorney Clark Askins.
Consider approval of Minutes of the La Porte Development Corporation Board held on
November 12, 2012 — P. Fogarty
Board member Clausen moved to approve the minutes as presented. Board member Cooksley
seconded. MOTION PASSED.

provides summaries and recommendations.

Assistant City Manager Traci Leach presented a summary regarding additional funding for the
construction of Lomax Park and Arena Improvements.
Board member Woodard commented that as a member of the La Porte Development Corporation
Board, he is interested in providing additional funding but wished more time was available for
making a decision due to the amount requested.
Assistant City Attorney Clark Askins informed Board members if there is an interest in moving
forward or an amount decided to provide additional funding, another public hearing would have to
be held authorizing additional funding for the project.
Board member Woodard moved to bring back a notice of a public hearing to increase project
funding not to exceed $570,000.00 for the construction of Lomax Park and Arena Improvements
Board member Cooksley seconded. MOTION PASSED.

and Strategy to Catalyst. Board member Ojeda seconded. MOTION PASSED.

SUMMARY & RECOMMENDATION
In the 2008-09 budget year, the La Porte Development Corporation Board agreed to fund an
enhancement grant program for the Main Street Overlay District. The program offered matching
grants of up to $25,000 for businesses in the Main Street District to improve building facades.
The project was allotted $200,000 and has $168,000 remaining. The goals of the project were to
beautify Main Street, to enhance Main Street's appeal to new businesses and visitors, and to add
value to the City of La Porte.
Ms. Claudia Cox has submitted a grant application for Entrust Professional Insurance, located at
210 West Main Street. The Enhancement Grant Application Committee met to discuss the
application, and agreed that it should be approved for an amount not to exceed $17,611. The
actual award will be one-half of the amount Ms. Cox spends on approved expenses for the
project up to $17,611, and will be contingent upon the project being completed as indicated in
this grant application. Attached is the application that Ms. Cox submitted, as well as additional
clarification information on the cost breakdown, as requested by the evaluation committee.
The committee recommends that the Board conditionally award a grant in an amount not to
exceed $17,611, based on receipts and completion of work as indicated.

Consider approval or other action of a grant amount not to exceed $17,611 for Ms. Claudia Cox

Good morning Ms. Cox:
The evaluation committee met yesterday to review your application for the Enhancement Grant Program. The team
rated your project very high and feels that this is a positive project for Main Street. There are a few clarification items
that we would like to review to fully evaluate the project.
1. Estimate Expired: The estimate provided by Follis Construction indicates that pricing is good for 30 days. At this
juncture and by the time the Economic Development Board will meet to consider awarding a grant, that pricing
will no longer be valid. Assuming we can get everything outlined here addressed in a timely manner, I see no
reason why the item could not be placed on the January 21 EDC agenda. Can you provide documentation from
Mark regarding the pricing to confirm that the costs outlined here will be good through that time?
2. Interior Improvement Ineli&�'.. On Drawing A-3, tqe items.listed as "Ir 1r Window Seats" in No. 1 and
Interior Paint in No. 2 are ineligible expenses since it is for the interior. Please provide a revised estimate to
back out the costs associated with tre window seats and interior paint.
3. Entry Elevation Clarification: Clarification on Drawing A-3, we want to make sure that we understand the
configuration of the entryway doors. Based on this drawing, it appears that the current configuration will be
maintained, with upgraded doors still recessed back from the windows. On Drawing A-1, it appears that the
front facade will be flat front. Can you confirm which is correct? I'm guessing the "X" drawn through the doors
on Drawing A-1 means that the door is recessed but please confirm.
Finally, please be advised that, as part of the permitting process for your building permit, you will be required to sign a
right of way encroachment agreement for the canopy. This agreement sets standards for minimum height,
maintenance, and contains language basically stating that you are aware that the canopy is encroaching into the right of
way. -There is no action required for this item for completion of the application. I just wanted to make you aware that
this will be a component of your building permit.
The next meeting of the EDC Board is scheduled for January 21. If you can provide your follow up information for Items
1-3 listed above by January 14, the evaluation team can re-evaluate your application and, if approved, submit it to the
Board for consideration. If information is received after this date, our next meeting is scheduled for February. Based on
my previous conversation with you, we have agreed to allow you to move forward with some work now, with the
understanding that approval of the grant is not guaranteed by the EDC Board.
Please be aware that while we do require a grant application prior to the completion of enhancement projects and we
approve them ahead of time, the actual grants are awarded on a reimbursement basis once completed work has been
verified by the Committee to be compliant with the plans proposed in the approved application. If you have any

Loftin Environmental Services, Inc.: Project No. 200-13-123
Dear Mr. Follis,
Attached are the results for an asbestos survey, performed on April 9, 2013 at the above
referenced facility. The purpose of this work was to identify the presence and quantity of
asbestos containing materials associated with the front fagade of the space, and assess those
materials that may be disturbed by building renovation of the storefront.
Visual observation of the areas revealed exterior wall paneling and exterior window caulking.
Representative samples of these suspect materials were collected in general accordance with
Texas DSHS regulations and submitted to LOFLIN's Houston laboratory for asbestos analysis.
All were analyzed using Polarized Light Microscopy (PLM) coupled with dispersion staining in
accordance with EPA's "Method For The Determination Of Asbestos In Bulk Samples" EPA
600/R/R-93/116, July 1993.
Based on laboratory analysis, the exterior wall paneling located above the windows was found to
contain 18-22% Chrysotile asbestos, totaling approximately 75 square feet. No other suspect
materials were identified.

Section 502.1.1 Insulation and fenestration criteria. The building thermal envelope shall meet the
requirements of Tables 502.2(1) and 502.3 based on Climate Zone 2.
Section 502.2.3 Above -grade walls. The minimum thermal resistance (R-value) of the insulating
materials installed in the wall cavity between the framing members and continuously on
the walls shall be as specified in Table 502.2(1) based on framing type and construction
materials used in the wall.
Section 502.3 Fenestration (Prescriptive). Fenestration shall comply with Table 502.3
Section 502.3.2 Maximum U-factor and SHGC. For vertical fenestration, the maximum U-factor and
solar heat gain coefficient (SHGC) shall be as specified in Table 502.3, based on the
window projection factor of 0.75.
Section 502.2.7 Opaque doors. Opaque doors (doors having less than 50% glass area) shall meet the
applicable requirements as specified in Table 502.2(1) above and be considered as part
of the gross area of above -grade walls that are part of the building envelope.
Section 502.4.3 Sealing of the building envelope. Penetrations of the building envelope at the office
addition exterior wall shall be sealed with caulking materials.
EXTERIOR WALLS WILL HAVE R-19 INSULATION EXCEEDING THE MINIMUM
REQUIREMENT OF R-13. FOR GLASS IN NEW EXTERIOR WINDOWS THE MAXIMUM U-
FACTOR WILL BE 0.75 AND MAXIMUM SHGC WILL BE 0.40 AND COMPLY WITH THE 2009
IECC.
