SUMMARY
At the request of Councilman Zemanek, this item was placed on the agenda to discuss proposed
infrastructure improvements to facilitate economic development. The catalyst for the discussion
was the request from the property owner of 212 W. Main, who approached the City to discuss
options for the renovation of the building into a pool hall. The proposed renovation would bring
substantial capital investment and other benefits to the City.
The current infrastructure serving the building does not support the required sprinkler system.
Typically, this kind of improvement would be paid for through the standard utility fee charged
for new development. Since this is an existing building, the proposed renovation and required
utility upsize doesn't fit neatly into the City's traditional funding structure for infrastructure
upgrades for development. In the past, the City had a capital improvement project in the Utility
Fund that provided funds for this type of improvement associated with development. That
project was eliminated from the budget in FY 2010.
The City had tentatively agreed to provide labor to install a larger sized water line and the
developer would provide the materials cost. The total cost of the utility upsize is approximately
$7,500, with the developer funding the lion share of the amount for materials. The City portion
was proposed to be an "in -kind" contribution for the labor.
Staff would like direction from Council regarding future requests for infrastructure
improvements that facilitate development.

I want to let you know the latest with Mark Caffey's billiards room that he's trying to build on Main Street. This morning
we talked with him about approaching the EDC Board for a grant to help pay the materials and construction costs for the
6-inch water line upgrade to his property at 212 West Main, in the amount of roughly $7500.
Mark seemed to want to move forward with this at our meeting, but he called me later this morning and said that he's
now thinking that he and his brother would be willing to just pay the $7500 to the City so that the project can move
forward. Instead of a grant from the EDC, they are now thinking that they would prefer to ask the City for a tax
abatement for the first couple of years of business, which we're willing to present to Council, but which will obviously
not affect this particular issue.
So ... I sent him the cost estimate, which I've attached here for your reference, and told him to let me know what he
wants to do. I will keep you posted. If he does indeed decide to go ahead and pay for it, I'll work with you, Dave, to
figure out the best way to make that happen logistically..

What was the final determination on the proposed pool hall? The last I remember the owner was going to purchase the
materials to upsize the water main and we were going to install it. Do you have any a -mails pertaining to that? Mark
Huber advises that the gentleman is requesting a building permit and they want to put that agreement in as part of the

As per conversation at the proposed location commercial plans are required to be submitted to our office for review.
The list below is provided as an overview for this type of project.
• To add the 2nd floor to the existing structure you will need to speak with a structural engineer and provide the
sealed engineers report to the our department for review to ensure the existing 1" floor can adequately support
the addition.
• All building, electrical, plumbing & mechanical plans are required to sealed by a Texas licensed engineer and or
architect. This is required on any structure over 5000 Sq. Feet.
• With the change of occupancy to Assembly and increased occupant load some additional requirements may
also be required;
1.) Increased plumbing fixtures toilets sinks and urinals. ( The required plumbing fixtures are calculated per the
Uniform Plumbing Code table 4-1.
2.) Fire sprinkler/ fire alarm requirements. ( you can contact the fire marshal's office for any specific issues on
your project. (Cliff Meekins 281- 471-5076)
3.) Additional egress doors required for assembly occupancies.
4.) An elevator will be required for the second floor. You will need to contact the Texas Department of
Licensing and Regulation (Architectural Barriers Division). ADA
5.) All projects over $50,000. valuation are required to be registered with Architectural Barriers.
6.) Harris County Health department approved floor plans required to be submitted with the construction
drawings for our review.
7.) You will need to contact the City of La Porte's City secretary's office for requirements related to alcohol
licensing.
8.) A grease trap will be required.
9.) If the second floor will be a separate bar from the 1" floor separate stand alone plumbing fixtures will be
required:
30.)If the pool tables, pinball machines or any other machines you will need to obtain a Coin operated machine
permit. (the application is available at office).
11.)An electrical load analysis will be required to be submitted with engineer sealed electrical drawings. The
electrical service'mav or may not be adequately sized to support the proposed loads and electrical service
upgrade will most likely be needed.
12.)An asbestos survey will be required to be submitted with the construction drawings for review.
13.)Energy Code work sheets (Com Check) worksheets required to be submitted with the construction drawings
to show compliance with the 2009 International Energy Conservation Code. ( See attached Energy Code
Handout)
14.)New addition required to designed to meet the 120 MPH Wind load.
15.)Two complete sets of plans and supporting documents are required to be submitted for our office for plan
review.

I would like to convert More 4 Less into a billiards, dart, venu.
There will be a juke box, couches, large bar (mixed drinks, beer and wine), small amounts of food and a
pin ball machines, air hockey etc...
The building is roughly 10,000 sf.
On the right side of the building you have Chocolates by Mark and the left side of the building you have
Vicky's Antiques.
I would like to add roof top seating (about 15 feet from the edge of the front of the building, running the
width of the building. This will overlook
Main Street. There will be a second bar upstairs.
I have already applied for the 60 day sign from TABC and should pick it up tomorrow.
Please let me know if I need anything else, permits, plans etc...

1. Minimum six-inch (6") stud walls shall be required where drain, waste, & vent (DWV-
horizontal and/or vertical) plumbing is installed. The use of 2 x 6 studs (wood or metal)
shall be required for new construction and additions (additions of square footage) for
both residential and non-residential construction where DWV plumbing is installed.

"At the August 22, 2011 meeting, La Porte City Council approved Ordinance 43373. This ordinance

1. Minimum six-inch.(6",) stud walls shall be required where drain, waste, & vent (DWV-
horizontal and/or vertical) plumbing is installed. The use of 2 x 6 studs (wood or metal)
shall be required for new construction and additions (additions of square footage) for
both residential and non-residential construction where DWV plumbing is installed.
2. Call for City inspections - 281-470-5130.
3. Unload and keep materials on private property, not City right of way.
4. If a fence is proposed, verify with City regarding maximum height limitations.
5. Call for utility line locates at 1-800-669-8344 and also City of La Porte at 281-471-9650
6 Fire Marshal will need to review/ inspect prior to opening business.
7. Must obtain zoning permit prior to occupancy of lease space/building.
8. Separate permit required for all signage.
9. Sanitation facilities required on -site prior to first inspection and must remain available
until completion of sanitation facilities within the lease space and/or building.
10. Silt fencing required for duration of project.

12. Fill dirt permits are required prior to placement of fill dirt.
13. Grading/drainage must be maintained throughout entire project to ensure eligibility for
inspections and utility release.
14. Provide energy code compliance certification from "certified" energy code provider, prior
to issuance of the Certificate of Occupancy.
15. Any changes to the project after building permit is issued, must be submitted in writing
and approved by the City prior to changes being made
16. Provide Sample Well in accordance with "Sample Well Detail" handout. (Available upon
request)
17. Effective March 10, 2007, all electrical devices (including but not limited to outlets and
switches) shall be installed with the screw -wrap or approved screw clamp installation.
Back or quick stab installation is prohibited.
18. Building operations shall be limited to 7:00am-9:00pm and shall not exceed maximum,
permitted sound levels as described in Chapter 34 of the Code of Ordinances.
19. Commercial projects with detention pond requirements must be inspected and approved
by city Engineer and Inspection personnel prior to final inspection request. Contact
City Engineer at 281-470-5060.
20. Contractor/owner shall be responsible for ensuring all construction materials/debris
remains on the construction site. Failure to do so shall result in stoppage of inspections
and/or code enforcement action.
21. Owner/developer of commercial driveways in concrete shall be constructed 12" from the
adjacent asphalt street. The contractor shall clean the area between the driveway and
the street to a depth of at least 6". It is the responsibility of the
owner/developer/contractor to install the asphalt transition. C®

1. Minimum six-inch (6") stud walls shall be required where drain, waste, & vent (DWV-
horizontal and/or vertical) plumbing is installed. The use of 2 x 6 studs (wood or metal)
shall be required for new construction and additions (additions of square footage) for
both residential and non-residential construction where DWV plumbing is installed.

17. Effective March 10, 2007, all electrical devices (including but not limited to outlets and
switches) shall be installed with the screw -wrap or approved screw clamp installation.
Back or quick stab installation is prohibited.
18. Building operations shall be limited to 7:OOam-9:OOpm and shall not exceed maximum,
permitted sound levels as described in Chapter 34 of the Code of Ordinances.
19. Commercial projects with detention pond requirements must be inspected and approved
by city Engineer and Inspection personnel prior to final inspection request. Contact
City Engineer at 281-470-5060.
20. Contractor/owner shall be responsible for ensuring all construction materials/debris
remains on the construction site. Failure to do so shall result in stoppage of inspections
and/or code enforcement action.
21. Owner/developer of commercial driveways in concrete shall be constructed 12" from the
adjacent asphalt street. The contractor shall clean the area between the driveway and
the street to a depth of at least 6". It is the responsibility of the

Dear Mr, Suarez,
Loflin Environmental Services, Inc. (LOFLIN) has completed a limited asbestos survey of the
above referenced location. The purpose of this work was to identify the presence and quantity of
asbestos containing materials within the space potentially affected by renovations. This work was
performed on March 3, 2014, by Joshua Songster, DSHS Inspector ri'602374.
Visual observation of the building revealed floor tile and mastic and wallboard joint compound as
the only suspect asbestos containing materials. Representative samples of these materials were
collected and submitted to LOFLIN's Houston laboratory for asbestos analysis. All were
analyzed using Polarized Light Microscopy (PLM) coupled with dispersion staining in accordance
with EPA's "Method For The Determination Of Asbestos In Bulk Samples" EPA 600/R-93/116,
July 1993.
Based on laboratory analysis, one of the sampled materials was found to be asbestos containing.
Nine inch floor the was found to contain asbestos on concentrations greater than 1%.
Approximately 150 square feet are present. Underlying black mastic was not found to contain
asbestos. Joint compound was determined to have 1 % or less asbestos. Attached is a table of
laboratory results.
