§ KNOW ALL MEN BY THESE PRESENTS:

That JABEZ DEVELOPMENT, L.P., a Texas limited partnership ("Grantor"), for and
in consideration of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable
consideration paid by the CITY OF LA PORTE ("Grantee"), a Municipal Corporation, the
receipt and sufficiency of which are hereby acknowledged and confessed, has this day
GRANTED, BARGAINED, SOLD AND CONVEYED and by these presents does GRANT,
BARGAIN, SELL AND CONVEY unto said Grantee, its successors and assigns, the perpetual
right, privilege and easement, with appropriate rights of ingress and reasonable working area for
construction and maintenance, to enter upon and construct, reconstruct, maintain, operate, inspect,
replace, repair and remove sanitary sewer pipelines together with all necessary related facilities
and improvements, over, across, through and under that certain tract or parcel of land lying and
being situated in Harris County, Texas, and being more particularly described on Exhibit "A",
consisting of three (3) pages, attached hereto and made a part hereof for all purposes.
TO HAVE AND TO HOLD the above described easement, together with all and singular
the rights and appurtenances thereto in anywise belonging unto said Grantee, and its successors or
assigns, in accordance with the terms and conditions hereinabove set forth. The Grantor does
hereby bind itself, its successors or assigns to WARRANT AND FOREVER DEFEND, all and
singular the said easement upon the Grantee, and its successors or assigns, against every person
whomsoever lawfully claiming or to claim the same or any part thereof.

Being 0.0267 acres or 1,161 square feet of land situated in the Johnson Hunter Survey, Abstract
No. 35, City of La Porte, Harris County, Texas, being a portion of that certain called 19.169 acre
tract of land, conveyed to Jabez Development, LLC, by deed recorded under Harris County
Clerk's File No. RP-2018-572514 on December 26, 2018. Said 0.0267 acres or 11161 square feet
of land being more fully described by metes and bounds as follows;
➢ All bearings referenced herein were obtained from GPS observations and are referenced to
NAD83 horizontal projection zone Texas South Central Zone 4204.
The coordinates referenced herein are Texas South Central Zone 4204 state plane coordinates
(NAD83) and may be brought to surface by applying a scale factor of 1.00011906609.
The distances shown herein are surface distances and can be scaled to grid by applying a scale
factor of 0.99988094809.
COMMENCING at a 5/8-inch iron rod with plastic cap found for corner, said corner being the
southwest boundary corner of said 19.169 acre tract, same being the northwest boundary
corner of a called 20.0001 acre tract of land, conveyed to Hawthorne at La Porte, LLC, by deed
recorded under Harris County Clerk's File No. RP-2018-572510 on December 26, 2018, and being
located in the east right-of-way line of State Highway 146, a public right-of-way of varied width
(Northing: 13,802,880.29, Easting: 3,229,535.94);
THENCE North 860 55' 55" East, along the south boundary line of said 19.169 acre tract, same
being the north boundary line of said 20,0001 acre tract, for a distance of 743.72 feet, to a point
for corner, and being the POINT OF BEGINNING of the herein described tract of land (Northing:
13,802,920.09, Easting: 3,230,278.50);
THENCE North 030 04' 05" West, across said 19.169 acre tract, for a distance of 8.30 feet, to a
point for corner;
THENCE North 480 08' 45" West, continuing across said 19.169 acre tract, for a distance of 2.41
feet, to a point for corner;
THENCE North 86' 55' 55" East, continuing across said 19.169 acre tract, for a distance of 117.70
feet, to a point for corner, said corner being located in the east boundary line of said 19.169
acre tract, same being the west boundary line of a called 3.399 acre tract of land (Tract IV),
conveyed to City of La Porte, by deed recorded under Harris County Clerk's File No. K784741 on
October 14, 1986;
THENCE South 03" 04' 05" East, along the east boundary line of said 19.169 acre tract, same
being the west boundary line of said 3.399 acre tract, for a distance of 10.00 feet, to a 5/8-inch

being the north boundary line of said 20.0001 acre tract, for a distance of 116.00 feet, to the
POINT OF BEGINNING and containing within these calls 1,161 square feet or 0.0267 acres of
land.
