KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF HARRIS &
That CITY OF LA PORTE, a Municipal Corporation ("Grantor"), for and in consideration
of TEN AND NO/I00 DOLLARS ($10.00) and other good and valuable consideration paid by
the CITY OF LA PORTE ("Grantee"), a Municipal Corporation, the receipt and sufficiency of
which are hereby acknowledged and confessed, has this day GRANTED, BARGAINED, SOLD
AND CONVEYED and by these presents does GRANT, BARGAIN, SELL AND CONVEY unto
said Grantee, its successors and assigns, the perpetual right, privilege and easement, with
appropriate rights of ingress and reasonable working area for construction and maintenance, to
enter upon and construct, reconstruct, maintain, operate, inspect, replace, repair and remove
sanitary sewer pipelines together with all necessary related facilities and improvements, over,
across, through and under that certain tract or parcel of land lying and being situated in Harris
County, Texas, and being more particularly described on Exhibit "A", consisting of three (3) pages,
attached hereto and made a part hereof for all purposes.
TO HAVE AND TO HOLD the above described easement, together with all and singular
the rights and appurtenances thereto in anywise belonging unto said Grantee, and its successors or
assigns, in accordance with the terms and conditions hereinabove set forth. The Grantor does
hereby bind itself, its successors or assigns to WARRANT AND FOREVER DEFEND, all and
singular the said easement upon the Grantee, and its successors or assigns, against every person
whomsoever lawfully claiming or to claim the same or any part thereof.

Being 0.5053 acres or 22,011 square feet of land situated in the Johnson Hunter Survey, Abstract
No. 35, City of La Porte, Harris County, Texas, being a portion of that certain called 3.399 acre
tract of land (Tract IV), conveyed to City of La Porte, by deed recorded under Harris County
Clerk's File No. K784741 on October 14, 1986. Said 0.5053 acres or 22,011 square feet of land
being more fully described by metes and bounds as follows:
➢ All bearings referenced herein were obtained from GPS observations and are referenced to
NAD83 horizontal projection zone Texas South Central Zone 4204.
➢ The coordinates referenced herein are Texas South Central Zone 4204 state plane coordinates
(NAD83) and may be brought to surface by applying a scale factor of 1.00011906609.
➢ The distances shown herein are surface distances and can be scaled to grid by applying a scale
factor of 0.99988094809.
COMMENCING at a 5/8-inch iron rod with plastic cap found for corner, said corner being the
southwest boundary corner of a called 19.169 acre tract of land, conveyed to Jabez
Development, LLC, by deed recorded under Harris County Clerk's File No. RP-2018-572514 on
December 26, 2018, same being the northwest boundary corner of a called 20.0001 acre tract of
land, conveyed to Hawthorne at La Porte, LLC, by deed recorded under Harris County Clerk's File
No. RP-2018-572510 on December 26, 2018, and being located in the east right-of-way line of
State Highway 146, a public right-of-way of varied width (Northing: 13,802,880,29, Easting:
3,229,535.94);
THENCE North 860 55' 55" East, along the south boundary line of said 19.169 acre tract, same
being the north boundary line of said 20.0001 acre tract, for a distance of 859.72 feet, to a 5/8-
inch iron rod with plastic cap found for corner, said corner being the southeast boundary corner
of said 19.169 acre tract, same being the northeast boundary corner of said 20.0001 acre tract, a
point in the west boundary line of said 3.399 acre tract, and being the POINT OF BEGINNING of
the herein described tract of land (Northing: 13,802,926.30, Easting: 3,230,394.32);
THENCE North 030 04' 05" West, along the east boundary line of said 19.169 acre tract, same
being the west boundary line of said 3.399 acre tract, for a distance of 10.00 feet, to a point for
corner,
THENCE North 860 55' 55" East, across said 3.399 acre tract, for a distance of 20.00 feet, to a
point for corner;
THENCE South 030 04' 05" East, continuing across said 3.399 acre tract, for a distance of
1,003.01 feet, to a point for corner;

feet, to a point for corner;
THENCE South 030 04' 05" East, continuing across said 3.399 acre tract, for a distance of 20.00
feet, to a point for corner, said corner being located in the south boundary line of said 3.399
acre tract, same being a point in the north boundary line of a called 41.922 acre tract of land
(Tract 9), conveyed to 92 Fairmont Lakes, Inc., by deed recorded under Harris County Clerk's File
No. 20110078076 on February 25, 2011;
THENCE South 860 55' 55" West, along the south boundary line of said 3.399 acre tract, same
being the north boundary line of said 41.922 acre tract, for a distance of 97.54 feet, to a 5/8-
inch iron rod found for corner, said corner being the southwest boundary corner of said 3.399
acre tract, same being the southeast boundary corner of said 20.0001 acre tract;
THENCE North 030 04' 05" East, along the west boundary line of said 3.399 acre tract, same
being the east boundary line of said 20.0001 acre tract, for a distance of 1,013.01 feet, to the
POINT OF BEGINNING and containing within these calls 22,011 square feet or 0.5053 acres of
land.
