ORDINANCE NO.2023-3926 <br />AN ORDINANCE DETERMINING THE POPULATION OF THE CITY OF LA PORTE, <br />TEXAS, AND OF EACH OF THE SIX (6) SINGLE -MEMBER COUNCIL DISTRICTS, AS <br />ESTABLISHED BY THE 2020 U.S. CENSUS; FINDING THAT THE DISTRIBUTION OF <br />POPULATION AMONG THE CITY COUNCIL SINGLE -MEMBER DISTRICTS IS <br />MATERIALLY UNBALANCED; FINDING COMPLIANCE WITH THE OPEN <br />MEETINGS ACT; AND PROVIDING AN EFFECTIVE DATE HEREOF. <br />WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, requires <br />the City Council to conduct an investigation and determine the population of each of the districts <br />from which councilpersons are to be elected, and that such determination be expressed in an <br />ordinance; and <br />WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, requires <br />that the determination of population of each council district be based on the best available data, <br />including, but not limited to, the most recent federal census; and <br />WHEREAS, Section 2.01(b) of the City Charter of the City of La Porte, Texas, mandates <br />that the City Council establish new council district boundaries for the election of district <br />councilpersons if the determination of the city population reveals that the distribution of population <br />among the various districts is materially unbalanced; and <br />WHEREAS, the City Council is in receipt of the U.S. Census Bureau's official population <br />data for the 2020 U.S. Census — commonly known as "PL 94-171" data — which includes <br />population and demographic information for the City of La Porte, Texas, as of April 1, 2020; <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA <br />PORTE, TEXAS: <br />Section 1. That the facts and recitations set forth in the preamble of this ordinance are <br />true and correct. <br />Section 2. The City Council of the City of La Porte finds that the population of the <br />City of La Porte, as determined by the 2020 U.S. Census, is 35,134. The City Council of the City <br />of La Porte additionally finds that the population of each of the six (6) single -member council <br />districts, as determined by the 2020 U.S. Census, is as follows: Council District No. 1 -- 6264; <br />Council District No. 2 - 5733; Council District No. 3 - 5520; Council District No. 4 — 5402; Council <br />District No. 5 -- 6652; and Council District No. 6 — 5563, and that under applicable legal principles <br />and guidelines for redistricting such single -member council districts are materially unbalanced. <br />Section 3. The City Council officially finds, determines, recites and declares that a <br />sufficient written notice of the date, hour, place and subject of this meeting of the City Council is <br />posted at a place convenient to the public at the City Hall of the city for the time required by law <br />preceding this meeting, as required by Chapter 551, Tx.
